EXTENDING THE LIFE OF SAID FRANCHISES AND AMENDING THE SAME,
INCLUDING THE FRANCHISE TO UTAH POWER COMPANY,' APPROVED AUG-
UST 4, 1905," APPROVED THE 3D DAY OF DECEMBER, 1907, AMENDED
AND CONFIRMED BY AN ORDINANCE PASSED DECEMBER 21, 1914, EN-
TITLED, "AN ORDINANCE RATIFYING AND CONFIRMING THE TRANSFER
TO THE UTAH LIGHT AND TRACTION COMPANY„ITS SUCCESSORS AND
ASSIGNS, OF THE RIGHTS, PRIVILEGES, AND FRANCHISES COVERED BY
CERTAIN ORDINANCES OF SAIMP LAKF CITY AMENDING SAID ORDINANCE
AND REORDAINING THE SAME AS SO AMENDED."
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF SALT TARP CITY;
Section i. That that certain ordinance of Salt Lake City entitled,
"An ordinance amending and confirming an ordinance of Salt Lake City entitled, 'An
ordinance ratifying and oonfirming the transfer of franchises to Utah Light and Rail-
way Company, a corporation, extending the life of said franchises and amending the
same, including the franchise to Utah Power Company,' approved August 4, 1905," ap-
proved the 3d day of December, 1907, amended and confirmed by an ordinance passed
December 21, 1914, entitled, "An ordinance ratifying and confirming the transfer to
the Utah Light and Traction Company, its successors and assigns, of the rights, privi-
leges, and franchisee covered by certain ordinances of Salt Lake City amending said
ordinance and reordaining the same as so amended," be and the same hereby is amended
by inserting in said ordinance approved December 3, 1907, a new Section immediately
following Section IV, to be known as Section IV-A, and to read as follows:

Section IV-A. In addition to and in lieu of the rights or some
of them granted by Section IV of this ordinance, permission and authority is
!hereby granted to eaid Utah Light and Traction Company, its successors and as-
signs, until July 1, 1955, to construct, maintain, and operate in any of the
streets, alleys, and public places of Salt Lake City described in Section IV
'hereof, or in any ordinance supplemental to or amendatory of said Section IV,
in lieu of or in addition to the street railway tracks therein described, an
electric bus transportation system consisting of poles, span wires, overhead
trolley wires for direct transmission and return of electrical current, end all
',necessary feeder wires and all appurtenances, and electric motor trolley busses
!,operated by electric current from said trolley wires, the same to be operated
!in conjunction with the street railway system of said Utah Light and Traction
t!Company, in lieu of or in addition to any part of said street railway system now
!!existing upon streets, alleys, and public places of Salt Lake City where the
!'street railway traoks are now laid and operated; provided, however, that the Gran
tee, its successors and assigns, before commencing theAopera ion ofsaidelectric!
bus system upon any such street shall procure the permission of the Board of
.Commissioners of Salt Lake City and shall procure authority of the Public Utili- j
ties Commission of Utah, or of such other regulatory body or commission as may
hereafter be created by law for the removal of such tracks and the operation of
said electric bus system.
In addition to the streets, alleys, and public places mentioned
in said Section IV of this ordinance, or other ordinances amendatory thereof or
'supplemental thereto, the Grantee, its successors and assigns, shall have the
right, privilege, and authority until July 1, 1955,to construct, maintain, and
!operate said electric bus system as hereinabove defined; upon the following
'streets in Salt Lake City, to-wit:
On Seventh South Street from Main Street to State Street
and from Third East Street to Fourth East Street, thence on
Fourth East Street to Ninth South Street.
Whenever the Grantee, its successors and assigns, shall exercise
;the rights hereby granted on any street, alley, or public place of Salt Lake
City, to construct, maintain, and operate such electric bus system in lieu of
;said street railway system, it shall immediately notify the City Commission and
!jforthwith remove or abandon its track thereon, and thereafter all rights of the
Grantee to relay or reestablish or reconstruct or maintain or operate tracks upon
such street, alley, or public place, under said Section IV of this ordinance, or
' otherwise, shall cease and terminate; and the said Grantee, its successors and
assigns, shall have no further right to construct, maintain, or operate tracks
upon any such street, alley, or public place. It is recognized and understood
that on certain of said streets, alleys, and public places, both street railway
cars and motor trolley busses may be operated, and nothing herein contained
shall be construed to forfeit or annul the franchise rights of the Grantee,
its successors and assigns, to maintain and operate its street railway tracks
,land cars thereon, where both such cars and motor trolley busses are operated.
Whenever the Grantee, its successors and assigns, shall exercise
, any of the rights herein granted to construct, maintain, and operate its elec-
tric bus system in lieu of said street railway system on any street, alley, or
public place, it shall forthwith remove or abandon its track consisting of
rails, ties, frogs, spikes, and other property composing any part of said track
on said street, alley, or public place, and shall replace and repair the pave-
' ment or other surface of the street, alley, or public place with materials and
to a condition comparable with the remainder of said street, alley, or public
place, and to the satisfaction of the Board of Commissioners; provided, however,
that the said Grantee, its successors and assigns, may with the
j, approval of the City Commission, leave any part of said track in place buried
it in the roadway, and cover the same over with asphaltum, concrete, or other satis-
factory paving material approved by the City Commission. In any such case,
however, the rails, ties, or other property of the Grantee, its successors and
assigns, so remaining in the streets shall become the property of Salt Lake City
and the Grantee, its successors and assigns, shall have no further title or
rights with respect thereto.
Electric motor trolley busses operated under the provisions of
this section shall be classified as "motor cars" within the meaning of Paragraph,
2, Section C, of Section II, of that certain ordinance passed by the City
Council of Salt Lake City on the 21st day of December, 1914, entitled, "An ordi-

nance ratifying and confirming the transfer to the Utah Light and Traction Com-

!'pany, its successors and assigns, of the rights, privileges, and franchises
[covered by by certain ordinance of Salt Lake City amending said ordinance and rear-
idaining the same as so amended," and the Grantee, its successors and assigns,
ishall pay to Salt Lake City Twenty-five Dollars ($25.00) per bus per annum for
j;the average number of said electric busses operated under this section in the samle
!manner as if such electric trolley busses were railway motor cars. Such payment
shall be in lieu of all other franchise, license, or occupation tax for the
''operation of said electric bus system as herein defined.
Section 2. This ordinance, being necessary for the immediate
'!preservation of the peace, health, and safety of the inhabitants of the City,
;it shall take effect upon its publication.
