Keyser " Matheson - - - - - Murdock - - - - Mr.Chairman - - - _ AN ORDINANCE Result AN ORDINANCE LEVYING A TAX AND FOR THE ASSESSMENT OF PRO- perty in Lighting District No. 7C-S, for the purpose of providing for the operation, maintenance and patrolling of grc lamps and the furnishing of electrical energy therefor. Be bt ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Lighting District No. 7C-S, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor, to-wit: Lots 1, 2, 3 and 4 of Blk. 56, and Lots 5 and 6 of Blk. 53, in Plat "A", Salt Lake City Survey, abutting on both sides of Third South Street from State Street to 2nd East Street in Salt Lake City. This tax is levied to defray the expense of providing for the operation, maintenance and patrolling of fourteen'(14) addition- al 6.6 ampere luminous arc lamps, on existing standards, said lamps to be illumined by electric current, and the furnishing of electrical energy for the same on the midnight schedule for a period of six years and seven months from March 5, 1938, to October 5, 1944, the circuits for the operation of said system of lamps to be underground and the portions of said streets opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and establish- ed that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform ratesli.p accordance with the linear i -2- 11 yfoot frontage upon and to the entire depth of the same ownership �Eback therefrom not exceeding 330 feet, and the tax hereby levied nand to be assessed upon said parcels of land is Five Thousand One II (Hundred forty-four and B8/100 ($5,144.88) Dollars or Four and • 019437/1000000 (44.019437) Dollars per front or linear foot of jiabutting property, there being 1280 feet abutting said portion of said improvement, and the cost of which operation, maintenance, patrolling and furnishing of electrical energy and the property Ibenefited thereby is hereinafter set out, and all within the bounda! Tries of the lots, blocks and streets above mentioned in said dis- jtrict, which is the total abutters' cost and cost per front foot (of said improvement for a period of six years and seven months, ac-! (cording to the contract entered into for the performance of said work and making said improvement with Utah Power & Light Company, Idated the 5th day of March, 1938, said levy to date and be effective from March 5, 1938, which is the date service began, and the city treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the purpose hereon mention- ed: Fronting on the south side of 3rd South Street: { All of Lots 5 and 6 of Blk. 53, Plat 'A', Salt Lake City lSurvey. Fronting on the north side of 3rd South Street: All of Lots 1 and 4, the west 78 ft. of Lot 3, the east 77 ft. of Lot 3, the west 50 ft. of Lot 2, and the east 85 ft. of Lot 2, of Blk. 56, Plat 'A', Salt Lake City Survey; as the same are 'shown upon the official plats of said city to the entire depth of !the same ownership back from said streets and to collect said tax. SECTION II. That the assessment list made by the City rfreasurer, as corrected, approved and completed by the Board of Equalization and Review of the property described in Section 1 of Ilthis ordinance in Lighting District No. 7C-S of Salt Lake City for the purpose of providing for the operation, maintenance and patrol-i ,ling of arc lamps and furnishing with electrical energy, is hereby ,confirmed and the assessments made and returned in said completed -3- lists and the report of the Board of Equalization and Review to the Board of Commissioners of Salt Lake City are hereby ratified, liapproved and confirmed. SECTION III. Said tax shall be payable in equal yearly installments, with interest on any delinquent installment unpaid ;i i at the rate of ten per cent per annum, which interest shall be charg- ed from and after the due date of each installment, to-wit: 7/79ths thereof fifteen days after the ordinance levying the tax for the Ipayment oftthe improvement becomes effective; 12/79ths thereof in seven months thereafter; 12/79ths thereof in one year and seven months thereafter; 12/79ths thereof in two years and seven months : thereafter; 12/79ths thereof in three years and seven months there- after; 12/79ths thereof in four years and seven months thereafter, : and 12/79ths thereof in five years and seven months thereafter; provided, however, that one or more of such installments in the order payable, or the whole tax, may be paid without interest with, in fifteen (15) days from the date this ordinance becomes effective I k and any such payments made within said fifteen days will be allow i ed a discount of three per cent (3%). Default in the payment of any such installment of princi. pal when due shall cause the whole of the unpaid principal to be- ' come due and payable immediately, and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per ' cent per annum until paid, but at any time prior to the date of sale or foreclosure the owner may pay the amount of all unpaid install-! ments past due, with interest at the rate of ten per cent per annuls t to date of payment on the delinquent installments, and all accrued' i costs, and shall thereupon be restored to the right thereafter to 1 Ipay in installments in the same manner as if default had not oc- Ij curred.
