AN ORDINANCE ADOPTING AIR TRAFFIC RULES OF THE UNITED
STATES DEPARTMENT OF COMMERCE AND FOR THE REGULATION OF SALT
LAKE IiUNICIPAL AIRPORT AND LICENSING THE BUSINESS OF TRANSPORTING
PASSENGERS FOR HIRE AND PROVIDING PENALTIES FOR THE VIOLATION OF
SAID PROVISIONS.
Be it ordained by the Board of Commissioners of Salt
Lake City, Utah:
SECTION_.I. It shall be unlawful for any airman, as de-
fined by the Air Commerce Act of 1926 adopted by. the Congress of
the United States of America, or other person to navigate any
aircraft over the area of Salt Lake City limits or land any air-
craft upon or fly the same from such area otherwise than in con-
formity with the "Air Traffic Rules", effective larch 22, 1927,
as established by the United States Department of Commerce
(Aeronautics Branch) under the authority of the said Air Commerce
Act. For the purposes of this ordinance said air traffic rules,
as published in Chapter 5 of the Air Commerce Regulations of the
sad.d $epartment of bommerce, •are hereby adopted by reference and
made a part hereof as fully as if the same, and each of them, were
completely set forth herein.
SECTION 2. It shall be unlawful for any airman, or other
person to navigate any aircraft over, land upon or fly the same
from the said area unless such airman, or other person, possesses
a temporary letter of authority or a license issued by the Secretary

of Commerce under the authority of the said Air Commerce Act.
SECTION 3. It shall be unlawful for any airman, or other
person, to fly or otherwise navigate over, land upon or fly any
aircraft from the said area mentioned in Section I except aircraft
which has been registered and licensed by the Secretary of Commerce
and rated as to airworthiness, in accordance with the provisions
Iof said Air Commerce Act. Any unlicensed person landing aircraft
upon the said area, or any person navigating an unlicensed air-
craft thereupon, shall depart therefrom within twenty-four hours,
provided, however, the Commissioner of Parks and Public Property
may grant such person written permit to keep his aircraft on said
area for a longer period provided such aircraft is not navigated
in the meanwhile. Having once departed, the return of any such
aircraft to the airport shall be deemed a violation of this ordi-
nance.
SECTION 4. The municipal landing field shall be and the
same is hereby designated as Salt Lake City Municipal Airport and
shall be under the control of the Commissioner of Parks and Public
Property and within the Department of Parks and Publid Property.
SECTION 5. The Commissioner of Parks and Public Property
is hereby authorized and directed to promulgate rules and regula-
tions not in conflict with law or ordinance with reference to the
use of said Salt Lake City Municipal Airport and the control and
management thereof.
It shall be unlawful for any person to violate any of I
the rules and regulations promulgated by the Commissioner of Parks
and Public Property with reference to the said Salt Lake City
Municipal Airport.
SECTION 6. All persons being upon or handling aircraft
on said landing field shall exercise reasonable caution to guard
against fire. No rubbish shall be scattered about said area.
SECTION 7. No person shall engage in smoking or strik-
ing any match inside of or within twenty feet of any aircraft to
sated on the landing field.

SECTION 8. It shall be unlawful for any person to set
up or maintain within the limits of Salt Lake City any landing
field for aircraft without special permission first obtained from
the Board of Commissioners.
SECTION 9. It shall be unlawful for any person to engage
in the business of carrying passengers for hire or reward, or to
carry any passenger for hire or reward without first obtaining a
license permitting him so to do from the assessor of license taxes.
The license tax for said license shall be p25.00 for each aircraft
so used for the calendar year, or any portion thereof. No license
shall be issued for any aircraft which has not been licensed and
rated as to airworthiness by the Department of Commerce.
The license assessor and collector shall make such in-
spection and investigation as will satisfy him of compliance with
this ordinance by the applicant and he may take ten days' time
after application within which to make such investigation.
Any license may be revoked by the Board of Commissioners
upon notice and hearing upon proof of violation of ordinance or
any of the air traffic rules of the Department of Commerce by the
licensee or his employees or agent, or at any time the aircraft
licensed has become not airworthy.
The provisions of this section with regard to license
fee shall not apply to aircraft carrying passengers in interstate
business.
SECTION 10. It shall be unlawful for any person to carry
any passenger for hire or reward in any aircraft unless such person
has been licensed by the Department of Commerce as a transport pilot
or a limited commercial pilot, and it shall be unlawful for any per-
son to use any aircraft in commercial flights which has not been
licensed and inspected in accordance with air commerce regulations
iof the United States Department of Commerce.
It shall be unlawful for any person who has not been li-
censed by the Department of Commerce as a transport pilot or limit-
ed commercial pilot or private pilot not designated as student, to

fly or carry any passenger except that student fliers may fly or
carry instructor pilots.
SECTION 11. All officers and members of the United
States Army and Navy while actively engaged in the service of the
United States, and all aircraft owned by and operated exclusively
under the direction and authority of the Army or Navy, shall be
subject to the provisions contained in this ordinance except as
to the licensing of aircraft and airmen.
SECTION 12. It shall be unlawful for any person to enro-

batically fly an aircraft
(a) over any business, industrial or residence
area of said city;
(b) without the approval of the Commissioner of
Parks and Public Property over any open air
assembly of persons.
It shall be unlawful for any person to acrobatically
fly any airplane carrying passengers for hire or reward.
Ecrobatia flying means intentional maneuvers not neces-
sary to air navigation.
SECTION 13. Any person violating any of the provisions
of this ordinance shall, upon conviction thereof, be punished by
a fine in any sum not exceeding two hundred ninety-nine (099.00) 1
Dollars, or by imprisonment in the city jail for a period not
' longer than six months, or by both such fine and imprisonment.
The court may, in imposing a fine, enter as part of the judgment
that in default of the payment of the fine the defendant may be
imprisoned in the city jail for a period not exceeding six months.
SECTION 14. In the opinion of the Board of Commissioners,
it is necessary to the peace, health and safety of the inhabitants
of Salt Lake City that this ordinance become effective immediately.
SECTION 15. This ordinance shall take effect upon its
first publication.
