Greece(/ 4141 —4"._ G� bpt Phillips Result AN ORDINANCE 7A_ AN ORDINANCE AMENDING Section 51-12-2 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to rezoning and fixing boundaries of use districts. WHEREAS, the Board of Commissioners of Salt Lake City, have deter- mined that the rezoning of certain property located near the corner of Foothill Avenue and Emerson Avenue, presently abutting a Business "B-3" District but zoned Residential "R-2", currently used as a parking lot for the abutting businesses, should be rezoned Business "B-3" in the best interest of the inhabitants of said community to encourage exist- ing and planned commercial activity in a manner which is compatible with abutting residential districts, said Board hereby adopts the following amendments to the Use District provisions of Title 51. NOW, THEREFORE, be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the use and "Use District Map" as adopted by Section 51-12-2 of the Revised Ordinances of Salt Lake City, Utah, 1965, as amended, relating to fixing the boundaries of Use Districts, be, and the same hereby is, amended as follows: That the following described parcel of real property in a Residential "R-2" District, situated on the Northwest corner of Foothill Drive and Emerson Avenue, is hereby zoned Busi- ness "B-3" and the "Use District Map" is amended and changed accordingly: Commencing at a point in the north line of Emerson Avenue, said point being 4.0 feet east of the southwest corner of Lot 7, Block 4, Wasatch Heights Subdivision, a part of the south 1/2 block 16, Five Acre Plat "C", Big Field Survey, running thence east along the north line of Emerson Avenue 160.1 feet to the west line of Foothill Drive; thence N. 33°15'54" W. along said west line of Foothill Drive 132 feet more or less to the south line of the existing Business "B-3" District; thence N. 89°49'34"' W. along the south boundary of the existing Business "B-3'," District 90 feet, more or less, to a point 4 feet east of the west line of said Lot 7; thence S. 0°02'52" E. 110 feet, more or less, to the point of beginning. 23 SECTION 2. This ordinance and its effectiveness are subject to the condition precedent that the proposed use and extension of the existing business uses into the rezoned area obtain the approval of a conditional use for a parking lot in abutting property with the final plans to be approved by the Planning Department, Board of Adjustment and City Commission. The ordinance is further conditioned upon the requirement that in the event that such a conditional use and plans receive final approval that they are implemented as approved; any un- authorized derivation from said approved plan will cause the reclassi- fication to terminate and revert to the existing Residential "R-2" classification. SECTION 3. Subject to the conditions set forth in Section 2, this ordinance shall be effective thirty (30) days from the date hereof.
