Keyser - - - - Matheann 4, r Mr.Chairman - - - RDINANCE Rosult - - - - AN ORDINANCE !AMENDING CHAPTER 47 OF PART XI OF THE 1933 EDITION OF THE SALT LAKE CITY BUILDING CODE by enacting, designating and placing the sections of said chapter in the revised ordinances of Salt Lake City, Utah, 1934, to be known as Chapter LXXIV and con- taining sections 1701 to 1723 inclusive of the revised ordinances of Salt Lake City, Utah, 1934. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapter 47 of Part XI of the 1933 edition of Salt Lake City Building Code containing the following sections, to wit: Sections 4701, 4702, 4703, 4704, 4705, 4706, 4707, 4708, 4709 as amended by ordinances passed November 21, 1935, June 25, 1936, March 16, 1937, February 24, 1938, August 30, 1938, December 20, 1939, (Bill 53), December 20, 1939 (Bill 54), March 26, 1940, May 9, 1940, and October 23, 1940; 4710 as amended by an ordinance passed by the Board of Commissioners January 10, 1939; 4711, 4712, 4712X passed by the Board of Commissioners May 14, 1935; 4713, 4713X passed be the Board of Commissioners March 26, 1940; 4714, 4715, 4716, 4717, 4718, as amended by an ordinance passed by the Board of Commissioners September 22, 1937; 4719, 4720, 4721, 4722, 4723, as amended by an ordinance passed by the Board of Commissioners on January 8, 1941; 4724 as amended by an ordinance passed by the Board of Commissioners September 2, 1936; 4725, 4726, 4727, 4728, 4729 is hereby enact d,„Sed and amended and placed in the revised ordinances of Salt Lake City, Utah, 1934 to read as follows, to wit: ,CHAPTER LXXIV, ZONING. SECTION 1701. DEFINITIONS. For the purpose of this ordinance certain terms and words are hereby defined as follows: Words used in the present tense include the future; words in the singular number include the plural number; and words in the plural ?6 -2- include the singular number. Any words not defined herein shall be construed as defined in the building code if defined therein. 1. "Accessory use or building." A subordinate use or building customarily incident to and located upon the same lot occupied by the main use or building. 2. "Alley." A strew or thoroughfare less than twenty-six (26) feet wide. 3. "Apartment House." A building or portion there- of used or intended to be used as the home of three or more fami- lies or householders living independently of each other. 4. "Approach Zone." An area at each end of each airport runway broadening from a width of 1000 feet at the end of runway to a width of 4000 feet at a distance of two miles from the end of such runway, and its center line being a continuation of the center line of the runway. 5. "Established Grade." "Grade." (a) For buildings adjoining one street only, the elevation of the sidewalk at the center of that wall adjoin- ing the street. (b) For buildings adjoining more than one street, the average of the elevations of the sidewalk at the centers of all walls adjoining street. (c) For buildings having no wall adjoining the street, the average level of the ground (finished surface) ad- jacent to the exterior walls of the building. All walls approxi- mately parallel to and not more than five (5) feet from a street line are to be considered as adjoining a street. 6. "Family." Any number of individuals living to- gether as a single housekeeping unit, and doing their cooking on the premises, independent of and separated from any other group or family. 7. "Front Yard." For an interior lot, an open un- occupied space on the same lot with a building between. the front line of the building (exclusive of steps) and the front lot or street line and extending across the full width of the lot. For a corner lot, an open unoccupied space on the same lot with a build- ing between the front line of the building (exclusive of steps) and the front lot line or street line also between the side line of the building (exclusive of steps) adjacent to the street, and the side lot line or street line and extending for the full widthi and depth of the lot. -3- 3. "Height of Building." The vertical distance from the "grade" to the highest point of the coping of a flat roof or to the deck line of a mansard roof or to the average height of the highest gable of a pitch or hip roof. 9. "Lot." Land occupied or to be occupied by a building and its accessory buildings, including such open spaces as are required under this ordinance, and having frontage upon a street or alley. 10.' "One-Family Dwelling." A building arranged or designed to be occupied by not more than one family. 11. "Public Building." A building owned or leased by the city, county or state, and used for recreational, educa- tional and or administrative or protectional purposes. 12. "Public Garage." Any building or premises used for the storage or housing of more than five (5) steam or motor driven vehicles, or where such vehicles are repaired or kept for hire or sale. 13. "Rear Yard." An open unoccupied space, except as hereinafter provided, on the same lot with a building between the rear line of the building (exclusive of steps) and the rear lot line and extending for the full width of the lot for an in- terior lot and extending from the side lot line to the front yard line for a corner lot. 14. "Side Yard." An open unoccupied space on the same lot with a building between the side line of the building (exclusive of steps) and the side line of the lot and--extending from the front yard line to the rear yard line. 15. "Two-Family Dwelling." A building arranged or designed to be occupied by two families. 16. "Corner Lot." A lot fronting on two or more intersecting streets, both of which are at least twenty-six (26) feet wide. -4 •- SECTION 1702. That in order to designate districts and regulate the location of dwellings, business, trades, industries, and the location of buildings erected or altered for specified uses, Salt Lake City is hereby divided into ten (10) use districts to be known as: Residential "At district Residential IA-21 district Residential 'B' district Residential 'B-2, district Residential 'B-3' district Business 'A' district Commercial district Industrial district Industrial 'BT district Unrestricted district The boundaries of said districts, as shown upon the map attached hereto and made a part hereof, are hereby established, said map being designated as the "Use district map" and said map and references, notations and other information shown thereon shall be as much a part of this ordinance as if the information and matters set forth by said map were all fully described herein. Except as hereinafter provided, no building shall be erected or altered, nor shall any building or premises be used for any purpose other than is permitted in the use district in which such building or premises is located. SECTION 1703. RESIDENTIAL 'A' DISTRICT. (a) In Residential SAT district no building or premises shall be used, and no building shall be erected which is arranged, intended or designed to be used for other than one of the following uses: 1. One-family dwellings 2. Two-family dwellings 3. Schools 4. Churches 5. Libraries and museums 6. Public parks, public recreation grounds and playgrounds, but not including privately owned commercial amuse- ment parks or commercial recreation grounds; 7. Farming and truck gardening, nurseries and greenhouses, provided that greenhouses shall be set back at least sixty (GO) feet from the front lot line. S. Railroad or street railway passenger stations and rights of way, not including railroad yards or sheds. 9. Public buildings, except penal or mental in- stitutions.. 10. Cemeteries adjoining or in extension to exist- ing cemeteries. 11. Telephone exchange where no public business office and no repair or storage facilities are maintained. (b) In a Residential IA' district buildings and uses, such as are ordinarily appurtenant to any of the uses listed above -5- but not involving the conduct of business, shall be permitted, subject to the limitations herein provided. 1. Accessory uses customarily incident to the above uses. 2. The office of a physician, musician or other pro- fessional person, when located in his or her dwelling; also cus- tomary incidental home occupations engaged in by individuals with- in their dwellings, provided that no window display is made. 3. A name plate not exceeding one and one-half (ij' square feet in area, stating only the name and or occupation of the person. 4. A signboard not exceeding eight (a) square feet in area, appertaining to the lease or sale of the property; also a bulletin board not exceeding eight (S) square feet in area ' erected upon the premises of a church or other institution for the purpose of displaying the name and activities or services therein, provided, when set back within two (2) feet of the building line. 5. Renting of rooms for lodging purposes only, or the furn'.shing of table board for not to exceed six (6) persons in a one-family dwelling. 6. Dormitories, fraternity or sorority houses or boarding houses occupied only by the faculty or students of a public educational institution and supervised by the authorities thereof, subject, however, to the express condition that such houses shall not be located or established more than 600 feet dis- tant from the lands and premises occupied by the institution to which they are incident. 7. A private garage that shall occupy not more than seven (7) per cent of the area of the lot and shall be located not less than sixty (60) feet from the front lot line, thirty (30) feet for a corner lot on the side street and not less than fifteen (15) feet from any dwelling on an adjacent lot, un- less it is part of the main building or located in a terrace or retaining wall. If located in a terrace or retaining wall, such garage shall not project in front of the terrace or retaining wall and shall not extend above the top of said terrace or re- taining wall more than two (2) feet, and in no case above the level of the ground floor of a dwelling on an adjacent lot. SECTION 1704. RESIDENTIAL +A-2+ DISTRICT. In a Residential +A-2+ district no building or premises shall be used and no building shall be erected which is arranged intended or designed to be used for other than any use permitted in a Residential +A+ district. SECTION 1705. RESIDENTIAL +B+ AND +8-2+ DISTRICTS. (a) In Residential +B' and +8-2+ districts no building or premises shall be used, and no building shall be erected which is arranged, intended or designed to be used for other than one of the following uses: 1. Any use permitted in a Residential 'A' or +A-2+ district. 2. All dwellings, flats, apartment and boarding or lodging houses without stores. 3. Hotels. 4. Clubs or fraternal societies, except those the chief activity of which is a service customarily carried on as a business. -6- 5. Hospitals, sanitariums and institutions for ' philanthropic or eleemosynary uses, other than correctional or for insanity or other mental diseases. o. An institution for subnormals when located not less than six hundred (600) feet from any dwelling or apartment house. 7. Public utility buildings, from which no .noises, vibration, fumes or odors are emited. 8. Outdoor advertising structures that otherwise comply with city ordinances. (b) Accessory uses shall be as seecified under a Resi- dential 'A' district, Section 1703, paragraph (b) in conformity with the requirements governing such uses. In addition thereto public garages may be maintained for storage purposes only, where no repair facilities are provided, when located not less than sixty (60) feet from the front lot line and not less than thirty (30) feet from any other street line on which the property faces; provided, that there shall be no entrance or exit for motor ve- hicles within one hundred fifty (150) feet of an entr.nde or exit of a public school, church, playground or other public or semi- public institution; concessions and service shall also be per- mitted as adcessories within hotels, etc., provided that access to such uses is only from within the building. SECTION 1706. RESIDENTIAL "B-3" In a. Residential 1B-3' district no building or premises shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one of the follow- ing uses: (a) Any use permitted in a Residential 'A', ?A-2t1 1B', or 'B-2' district. b Sps for retail business. c. Drug stores. d Banks or office buildings. e Barber shops and beauty parlors. f Theatres. p Restaurants and tea. rooms. h Gasoline service stations. 2. No building or structure shall be erected or altered in a Residential tB-3t district for any of the uses enumerated in items (b) to (h) inclusive, of this section, unless the plans for such building or structure including all signs and advertising emblems shall have been submitted to and approved by the Board of Commissioners of Salt Lake City. 3. In a Residential tB-3t district, for every building erected, they c shall be a 'front yard' and 'rear yard' of such -7- dimensions as are required for all buildings erected in a Res- idential 'B-2' district. SECTION 1707. BUSINESS 'Al DISTRICT. 1. In a Business 'Al district no building or premises shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one of the fol- lowing uses: (a) Any use permitted in a Residential 'A', 'A.-2', 'B', 'B-2' or 'B-3' district. (b) Wholesale distributor. c)3) Printing plant. d Storage warehouses (for wars and merchandise which would not create a nuisance). (e) Soft drink bottling plant. (f) Automobile salesroom, exclusive of used car lot. 2. No building or structure shall be erected or altered in a Business 'A' district for any of the uses enumerated in items (b) to (f) inclusive of this section, or as specified in items B to H inclusive of Residential 'B-3' district, unless the plans for such building shall have been submitted to and approved by the Board of Commissioners of Salt Lake City. 3. In a Business 'A' district the height and area reg- ulationt shall be as specified for a Residential 'B-2' district. SECTION 1708. COMMERC L,L DIS'RICT. (a) All buildings and premises may be used for any purpose permitted in Residential 'A;, 'A-21, 'Bj 'B-21, and 'B-3' 1 districts and Business 'A' district and also for any trade, industry or use except as prohibited in Part IV of Salt Lake City Building Code and, except the following, which are hereby l prohibited, subject to the provisions of Section 1716 of this ordinance and of paragraph (b) hereunder. 1. Any trade or use prohibited in an industrial district. 1 2. Acid manufacture. 3. Bag cleaning. 4. Boiler works. 5. Breweries or distilleries. 6. Brick, tile or terra cotta manufacture or storage, except storage within a building. 1 7. Celluloid or similar manufacture. 8. Charcoal manufacture or pulverizing. 9. Chemicals manufacture of objectionable or dan- gerous nature, including coal tar products. 10. Contractoris' plant or storage, except where set back at least one hundred (100) feet. 11. Coal yards except where set back two hundred (200) feet from street line or where located upon property abut- ting railroad tracks. 12. Dog pound. • _8- 13. Dyestuff manufacture. 14. Electrical central station power plant. 15. Emery cloth or sand paper manufacture. 16. Enameling. 17. Excelsior fibre manufacture. 18. Exterminators or insect poisons manufacture. 19. Feed or cereal mill using power in excess of 50 horse power. 20. Fish smoking and curing. 21. Flour mill. 22. Foundaries. 23. Forge plant. 24. Glass or glass products manufacture. 25. Glucose manufacture. 26. Ice manufacturing plant or storage, except the manufacture by electricity. 27. Japanning. 28. Junk, rags, etc., storage. 29. Lamp black manufacture. 30. Lubricating grease or oil compounding. 31. Lumber or shingle mills using more than 50 H.P. 32. Machinery manufacture. 33. Machine shops using in excess of 50 H.P. 34. Malt Manufacture. 35. Match manufacture. 36. Mattress manufacture using in excess of 50 H.P1 3?. Oilcloth or linoleum manufacture. 38. Oiled rubber manufacture. 39. Oxygen manufacture. 40. Ore reduction. 41. Packing plants. 42. Paint, oil, etc., manufacture. 43. Paper and pulp m-.nuf'acture. 44. Petroleum refining or by-products manufacture, or storage of petroleum products or by-products in excess of seven thousand (7000) gallons, except that two (2) 7000 gallon tanks are hereby permitted at any one service station. 45. Pickle factory. 46. Planing mill or woodworking plant using in excess of 50 H.P. 47. Plaster manufacture. 48. Power, light or steam plant central station. 49. Railroad yard shows or roundhouse, ascent street car barns and shops. 50. Reducing or refining metals. 51. Rock crushing. 52. Rolling or blooming mill. 53. Rubber or gutta percha manufacture from crude material. 54. Salt norks. 55. Sauercraut manufacture. 06.Sausage me; ufacture, except where manufactured for retail trade. 57. Shoddy manufacture. • 58. Shoe blacking manufacture. 59. Slaughtering or cle.ning of animals, fowl or fish. 60. Soap manufacture. 61. Soda and compotnld manufacture. 62. Starch, glucose, etc., manufacture. 63. Steel or iron mills. 64. Stone or earthenware manufacture. 65. Stone mill or quay .y. 66. Stove polish manufacture. 67. Tanning, curing or storage of hides or skins. 68. Textile mills. 69. Vegetable oil or other oil manufacture. 70. Vinegar manufacture. 71. Yeast plant. • -9- • • (b) Stables, lumber yards, fuel yards, dyeing and clean- ing establishments, public garage, mortuary, wholesale milk dis- tributing stations, sheet metal works, machine shops, laundries, mattress factories, lumber mills, planing mills, or food products manufacture shall not be permitted in Commercial districts within one hundred (200) feet of a dwelling or apartment house. • S -CTION 1709. INDUSTRIAL DIS'TRIC'T. (a) In an Industrial district all buildings and premises may be used for any purpose permitted in Residential TA1 'A-2;, 'B'„'B-2;. tB-3?,Business 'At and Commercial districts, and also for any other trade, industry or use, except the fol- lowing, which are prohibited, subject to Provisions of Section 1716 of this ordinance. 1. Ammonia, bleaching powder or chlorine manufacture. 2. Asphalt manufacturing or refining. 3. Arsenals. 4. Blast furnaces. 5. Cement, Lime or plaster of paris manufacture. 6. Coke ovens. 7. Crematory other than a crematory located. in a cemetery. 8. Creosote treatment or manufacture. 9. Disinfectant and insecticide manufacture. 10. Distillation of bones, coal or wood. 11. Fat rendering. 12. Fertilizer manufacture, except the cold com- pounding of non-odorous materials. 13. Fireworks, explosive manufacture and storage. 14. Gas: manufacture or storage in excess of 10,000 cubic feet. 15. Gelatine, glue or size manufacture. 16. Grease or tallow manufacture or refining. 17. Hair factory. 18. Hydrochloric, nitric, sulphuric or sulphurous acid manufacture. 19. Incineration or reduction of garbage, offal or refuse. 20. Petroleum refining or storage in excess of the capacity of two (2) 7000 gallon tanks. 21. Potash manufacture or refining. 22. Raw hides or skins, storage, curing or tanning. 23. Rubber manufacture from the crude material. 24. Slaughter houses. 25. Smelting of iron, copper, zinc or tin ores. 26. Stock yards. 27. Sugar refining. 28. Tannery. 29. Tar distillation or manufacture. 30. Tar roofing or tar waterpr.wln_g manufacture. 31. Wool pulling, scouring or shoddy manufacture. 32. Any other trade, industry or use that is noxious or offensive by reason of the emission of odor, smoke, gas, vi- bration or noise. -10 • - SECTION 1710. INDUSTRIAL Bt DISTRICT. In an Industrial BT district all buildings and premises may be used for any purpose permitted in Residential 'A.;, 'A-2 , 'Bt, IB-2t,and ?B-3' districts, Business IAA Commercial and. Industrial districts and also for the storage of petroleum products or by- products not to exceed a total capacity of 100,000 gallons on any property held under one ownership. SECTION 1711. UNN'lsSTRICTED DISTRICTS. (a) In an unrestricted district all buildings and premises may be used for any lawful purpose except those which by ordinance are excluded from within the city limits. (b) Any uses prohibited in Section 1709 (Industrial district) that are to be undertaken in this district shall be located at least 660 feet distant from the boundary line of any Residential !At, 'A-2 Tq 'B',, IB-2 7; TB-3',or Business 'A' or Commercial district. SECTION 1712. FRONT YARDS. In all residential districts no part of any building; (exclusive of steps) shall be erected nearer to the property line on which it faces than the average alignment of existing buildings within the same block frontage, except that a front yard need not be more than 30 feet in depth. Where there are no existing build- ings within the same block frontage, the minimum depth of the front yard shall he 20 feet. One street frontage only of a corner lot shall be exempt from these provisions, except that in such event the building on that side shall be set back not less than ten (10) feet. In a district where the street widths are less than one hundred (100) feet no wall, fence or other structure shall be erected and no hedge, shrub, tree or other growth shall . be maintained in such location as to cause danger to traffic by ' obstructing the view. Where a residential district and a commer- cial district adjoin each other within the same block, the front and side yard regulations shall apply to the commercial district as well as to the residential district on the residential street. -11- SECTION 1713. SIDE YARDS. In all Residential 'A; 'A-e; 'B, and. 'B-2' districts, for every building erected there shall be a side yard along each lot line. The least dimension of any such side yard shall be 35$1 of the building height, out in no case less than eight (8) feet for Residential 'A'; 30% of the building height, but in no case less than six (6) feet for Residential 'B' and 25% of the build- ing height, but in no case less than four (4) feet for Residential 'A-2' and 'B-2', and the total width of the two side yards for any one lot shall be 70% of the building height but in no case less than twenty (20) feet for Residential 'A', 60% of the build- ing height, but in no case less than seventeen (17) feet for the Residential 'B' and 50% of the building height, but in no case less than fourteen (14) feet for Residential 'A-2' and 'B-2'. In a Residential 'B-3' district side yards are not re- quired, except that whenever the boundary line of a Residential 'B-3' district forms a common boundary line with a Residential 'B; or 'B-2' district, then a side yard of a width equal to that required for maximum side yards in the adjoining district shall be required on that side adjacent to the common boundary. SECTION 1714. REAR YARDS. In all residential districts there shall be a rear yard not less than twenty-five (25) feet, _provided, however, that not more than 40% of the area of the rear yard may be occupied by a one-story accessory building not over fifteen (15) feet in height. Where the garage is located within or made a cart of the dwelling and no accessory building is erected in the rear yard, then the depth of such rear yard may be reduced not more than 40%. SECTION 1715. SIDE AND REAR YARD EXCEPTIONS. (a) The area of a side or rear yard shall be open and unobstructed, except for the ordinary projections of window sills, belt courses, cornices and other ornamental features to the ex- tent of not more than four (4) inches, except that where the building is not more than two (2) stories in height the cornice or eaves may project not more than two (2) feet into such yard and a bay window or chimney breast not over ten (10) feet long may extend into the side yard not more than two (2) feet, provided -12- such extension maintains the minimum side yard requirements. (b) An open iron fire excaee may project noT more than four (4) feet into a side or rear yard. (c) Where a rear yard or a side yard in a residential district abuts on an alley or permanent open way, the yard shall be deemed to extend to the center of such alley or way. (d) In all Luset districts there shall be maintained a side yard and a rear yard for all dwelling and apartment houses, tenement houses and hotels as required for minimum side yards in Residential tB-21 districts. (e) On any lot held under separate ownership from ad- the Zoning Ordinance., September jacent lots, and of record at the time of the passage ofLxxxxxxrxx 4Fk3Fi the side yard requirements may be waived to the extent that the buildable width of such lot is not reduced to less than twenty-six (26) feet, except that at least a three (3) foot side yard is required on both sides of all lots. (f) On rear yard for a corner lot an accessory build- ing may be built nearer to the front lot line than thirty (30) feet provided such building be not over twenty (20) feet long and be located as near to the side line, farthest from the street, as the width of the lot will permit. S_'.CTION 1716. NON-CONFORMING USE. Any use of buildings or premises at the time of the 7 passage of this ordinance may be continued, although such use ' does not conform to the provisions hereof. In the case of a build- ing such use may be extended throughout the building, provided that no structural alterations are made therein, except those required by law or ordinance. Providing no structural alterations are made, la non-conforming use may be changed to any use permitted in a dis- trict where such non-conforming use would be permitted. Any non- conforming use changed to a more restricted use or to a conforming use shall not thereafter be changed back to a less restricted use. No non-conforming building which has been damaged by fire, explosion, act of God or act of the public enemy, to the extent of more than sixty (60) per cent of its assessed value, shall be re- stored except in conformity with the regulations of this ordinance. -13- Any non-conforming use building, existing in any resi- _ th.e Zonin Ordinance, eSept_emr #N19v7, dential district at the time of t o passa e 9}�Li7� [ may be reconstructed or replaced to conform with all requirements for a Residential 1B-31 district, including all required yard spaces. SECTION 1717. HEIGHT REGULATIONS.--GENERAL. (a) No dwelling or hotel, unless of fireproof construc- tion, shall be erected to a height of more than three (3) stories. No dwelling shall be erected to a height less than ten (10) feet or one (1) story. No building or structure shall be erected with- in the approach zone of any airport runway within 600 feet of same to a height of more than one (1) story or 15 feet, and no building or structure shall be erected in the vicinity of any airport and located within any approach zone more than 600 feet from any air- port runway to a height greater than one foot of height for every 40 feet of distance from said runways, and no building or structure shall be erected in the vicinity of any airport that would in any way constitute a hazard and endanger life or limb of any person. .(b) Residential Districts. In a Residential !At district no dwelling shall be erected to a height in excess of thirty-five (35) feet and no building shall be erected to a height in excess of forty-five (45) feet. In a Residential +Bt district no building shall be erected to a height in excess of forty-five (45) feet. In a Residential 1B-2, and Business 'A' district no building shall be erected to a height in excess of fifty-five (55) feet, In a Residential 'B-31 district no building shall be erected to a height in excess of forty-five (45) feet. (c) Commercial District. In a Commercial district no building shall be erected to a height in excess of one and one- quarter (1*) times the width of the street on which it fronts. Where a building fronts on two or more streets, the greater height of building permitted on the wider street shall apply within a distance of 120 feet from such street. (d) Industrial and Unrestricted Districts. In an In- -14- iustrial or Unrestricted district, no building other than a grain elevator or a gas holder shall be erected to a height in excess of eighty (80) feet. (e) E:oceptions. General. The following exceo,tions apply to the foregoing height regulations except as outlined in paragraph (a) above, realting to buildings and structures within the vicinity of airports. (1) The provisions of this section shall not apply to restrict the height of a church spire, tower or belfry, or a flagpole, wireless tower, monument, chimney, water tank, elevator bulkhead, stage tower or scenery loft. (2) Nothing in these regulations shall ap;:ly to prevent the erection above the height limit of a parapet wall or cornice for ornament and without windows, extending above such height limit not more than five (5) feet. (3) Any portion of a building may be erected to a height in excess of the respective height limits as herein pre- scribed; provided such portion of such building is set back from all street, alley and required yard lines, one (1) foot for each three (3) feet of such additional height if in an industrial or commercial district, and one (1) foot for each two (2) feet of such additional height if in any residential district. SECTION 1718. AREA REGULATIONS. In all use districts for buildings hereafter erected or altered to accommodate or make provision for additional families the required lot area per family housed shall be as follows: 3000 square feet for a one-family dwelling. 3500 square feet for a two-family dwelling with an additional 500 square feet required for each family added. Provided., that in any district a single family dwelling ' may be erected on any lot held in separate ownership at the time the Zoning Ord inance, September 1, 1927 of the passage ofL xxxxxxxxxxxx=x A lot extending to a. rear alley shall be deemed to extend to the center of such alley, and a lot abutting upon two or more streets (a corner lot) shall be I deemed to extend to the center of the side street in computing its area for the purpose of this section. For the purpose of this section the number of families which a building is designed. to accommodate, shall be determined by the number of separate house- keeping units in such building. A suite of rooms without a kitchen or facilities for cooking meals, shall not be deemed a house- keeping unit for the purpose of this section. 1 • -15- SECTION 1719. PLATS. All applications for building permits shall be accompanied by a plat in duplicate drawn to scale showing the actual dimensions of the lot to be built upon, the size and location of the existing buildings and buildings to be erected, and such other information as may be necessary to provide for the enforcement of this ordin- ' ance. A careful record of such application and plats shall be kept in the office of the Building Inspector. No yard or other open spaces provided about any building for the purpose of com- plying with the provisions of these regulations shall be used as a yard or open space for another building. SECTION 1720. INTERPRETATION AND APPLICATION. In interpreting and applying the provisions of this ordinance they shall be held to be the minimum requirements for the promotion of the public health, safety, order, convenience, prosperity and general welfare. It is not intended by this ordinance to interfere with or abrogate or annul any easement, covenants or other agreements between parties; provided, how- ever, that where this ordinance imposes a greater restriction upon the use of building or premises or upon height of building, or requires larger open spaces than are imposed or required by other laws, ordinances or restrictions, the provisions of this ordinance shall control. SECTION 1721. VIOLATION AND PENALTY.. Any person convicted of violating or refusing to comply with any of the provisions of this ordinance shall be punished by fine in any sum not exceeding Two Hundred Ninety-nine (8299.00) Dollars, or by imprisonment in the city jail for a period of not longer than six months, or by both such fine and imprisonment. The court may, in imposing the fine, enter as part of the judgment, that, in default of the payment of the fine, the violator may be imprisoned in the city jail for a period of not exceeding six months. Each day a violation is -permitted to exist shall con- stitute a separate offense. SECTION 1722,BOUNDARILS OF DISTRICTS. Where uncertainty exists with respect to the boundaries of the various districts hereby established and as shown on the i � M -16- i maps and made a part of this ordinance, the following rules shall 'reply! (1) The district boundaries are either center lines Ilof streets or alleys, unless otherwise shown, and where the designa Ition on the maps accompanying and made a part of this ordinance ind4.- eating the Various districts are approximately bounded by street oro alley lines, said center lines of streets or alleys shall be con- strued to be the boundary of such district. (2) Where the district boundaries are not otherwise indicated and where the land has been, or may hereafter be, divided; into lots or blocks and lots, the district boundaries shall be con- strued to be lot lines, and where the designation on the maps accom- panying and made a part of this ordinance indicating the various districts are approximately bounded by lot lines, the nearest lot line shall be construed to be the boundary of such district. (3) Where land has not been subdivided into lots or 'blocks and lots, the district boundary lines on the map accompany- ing and made part of this ordinance shall be determined by the use of the scales of measurement shown on such maps. (4) All property hereafter annexed to Salt Lake City shall be deemed to be classified as Residential A upon the Use Dis ltrict Map of Salt Lake City unless such property is otherwise zoned by the ordinance of annexation. SECTION 1723. VALIDITY. Should any section, clause or pro- vision of this ordinance be declared by the courts to be invalid, the same shall not affect the validity of the ordinance as a whole � or any part thereof, other than the part so declared to be invalid. SECTION 2.
