AN ORDINANCE AMENDING CHAPTER XXIX of the Revised Olai-
nances of Salt Lake City, Utah, 1934, by adding in and to said
Chapter a new section to be known as Section 744, providing for the
protection of the inhabitants of Salt Lake City in the event of an
air raid.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION I. That Chapter XXIX di' the Revised Ordinances of
Salt Lake City, Utah, 1934, be and the same is hereby amended by
adding in and to said chapter a new section to be known as Section
744,. providing for the protection of the inhabitants of Salt Lake
City in the event of an air raid, which shall read as follows:
"SEC. 744 (a) This ordinance shall be known as the •Air
Raid Ordinance, ' and its purposes shall be to aid the United
States War Department in the proper defense of the inhabitants
of Salt Lake City in the event of an air raid and protect the
lives and property of the people of Salt Lake City.
(b) As used in this ordinance the following words and
phrases shall mean:
'Air Raid Warning Signal' shall mean a signal, by siren,
whistle, horn or other audible device, of two minutes' duration
consisting of either a fluctuating or warbling signal of vary-
ing pitch or a succession of intermittent blasts of about five
seconds' duration separated by a silent period of about three
second.
'All clear signal' shall mean a continuous signal, by siren,
horn or other audible device, of two minutes' duration at a
steady pitch.

!Blackout structure' shall mean any space so enclosed
that any illumination maintained or existing therein is not
visible from any point outside such enclosure.
'Blackout' or !Period of air raid alarm' shall mean the
interval of time between the giving of the air raid warning
signal and the giving of the next succeeding all clear signal,
'Hours of darkness' shall mean the time commencing one-
half hour after sunset and ending one-half hour before sunrise.
'Vehicle' shall mean every device in, upon or by which
any person or property is or may be transported, propelled or
drawn upon or over any street, alley, highway or ground.
(c) The Chief of Police in the exercise of a governmental
function for the protection of the lives and property of the
people of Salt Lake City is hereby authorized and directed to
cause the sounding of an air raid warning signal and of an all
clear signal when,he is notified to do so by the Utah District
Warning Center upon orders from the United States Army.
(d) Any person who effects or maintains any illumination
of whatsoever kind or character, pr permits any illumination o
whatsoever kind or character under his control to be effected
®r maintained at any place within Salt Lake City during any
period of air raid alarm in the hours of darkness, except with
in a blackout structure, shall be guilty of a misdemeanor.
(e) The maintenance or leaving of any illumination, excep
within a blackout structure, without provision for its extingu sh-
ment, within one minute after the commencement of a period of
air raid alarm, by a competent person over the age of eighteen
years attendant at the place where such illumination is contro -
ed, or by mechanical device approved by the Chief of Police, i-
hereby prohibited.
(f) It shall be unlawful to disobey any lawful direction
or order of any member of the Citizens Defense Corps of Salt
Lake City given in line of duty during a period of air raid
alarm, which order is reasonably necessary for the maintenance,.,
of public order or safety or to affect the extinguishment or'

obscuration of light.
(g) Any illumination contrary to the provisions of this
ordinance is hereby declared to be a public nuisance, and the
same may be summarily abated and any police officer or fireman
or an air raid warden of Salt Lake City may use reasonable for e
if necessary for the purpose of abating such a nuisance by ex-
tinguishing such illumination.
(h) This ordinance is an exercise by the city of its gove n-
mental functions for the protection of the public peace, healt ,
and safety and neither the City of Salt Lake City or any indi-
vidual lawfully acting hereunder or subject to regulations law
fully included herein or promulgated pursuant to authority
herein conferred shall be liable for any damage sustained to
person or property during, or as the result of, an authorized
blackout or air raid protection measure.
(i) At the commencement of a period of air raid alarm,
the operator of any vehicle shall forthwith bring such vehicle
except vehicles upon fixed rails, as far as possible to the
side of the street, road or highway off the main traveled por-
tion thereof, and the operator of any such vehicle shall bring
such vehicle to a stop clear of any crossing, intersection,
bridge or approach thereto, fire house, fire plug, hospital or
other emergency depot or area, and during the hours of darknes.

(j) The provisions of this ordinance shall not apply to
blackout emergency vehicles, which shall include the following
1. Vehicles of the Armed forces of the United States
of 9merica.
2. Ambulances, municipal, county, State and federal
police and fire vehicles, and vehicles being then officially
used by the several branches of the Citizens Defense Corps of
Salt Lake City.

3. Vehicles actually in emergency service for the
repair or control of public utility equipment, whether private
ly or publicly owned.
4. Vehicles of the State Guards under actual control
of officers or enlisted men of the State Home Gt3iards and actual-
ly in emergency service.
5. Such other vehicles as may be required to move by
order of the Chief of Police of military authorities.
Provided, however, that such emergency blackout vehicle.
as in this paragraph (j) set forth shalleonform to the lightin:
regulations approved by the Defense Council of Salt Lake City
or by the United States Army or Navy for blackout emergency
vehicles.
(k) During any period of air raid alarm all pedestrianb an;
vehicular traffic except as berein provided within Salt Lake
City is hereby prohibited and declared unlawful; provided, tha
immediately upon the sounding of any air raid warning signal,
pedestrians shall take shelter.
(1) The provisions of paragraph (k) of this ordinance sha'l
not apply to members of the armed forces of the United States ,
of America, members of the Citizens Defense Corps of Salt Lake.
City, duly licensed physicians, surgeons and nurses and other
officially authorized persons when acting in the line of the
respective duty, and using great caution for their own safety
and the safety of others.
(m) It shall be unlawful for any person without authority
to use, or exhibit or possess any uniform, insignia, credential
or other indication of authority, or any imitation thereof,
adopted and issued by any official defense organization or
any authorized law enforcement officer or agency.
(n) Any person who shall operate a siren, whistle, horn o
other audible device in such a manner as to simulate an air
raid warning signal or an all clear signal, except upon order
of the Chief of Police shall be guilty of a misdemeanor.

shall be deemed suspended during the period between any air
raid warning signal and the next succeeding all clear signal.
SECTION 2. Any person violating any provision of this
ordinance shall be punished by fine in any sum not exceeding $299.0n,
or by imprisonment in the city jail not longer than six months, or
