AN ORDINANCE AMENDING Sections 105(1), 105(2) (b), (2) (c)
and Sec. 106, under Article 6 of the Traffic Code, Revised
Ordinances of Salt Laku City, Utah, 1965, relating to quali-
fications of drivers while abilities are impaired.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. That Sections 105(1), (2) (b), (2) (c) and Sec.
106, under Article 6 of the Traffic Code, Revised Ordinances of
Salt Lake City, Utah, 1965, relating to qualifications of drivers,
be, and the same hereby are, amended to read as follows:
"Sec. 105. Users of drugs and intoxicants. (1) it
shall be unlawful for any person who is under the influence
of intoxicating liquor or is an habitual user or under the
influence of any narcotic drugs or any other drug to a
degree which renders him incapable of safely driving a
vehicle, to drive or be in actual physical control of any
vehicle within this city.
"(2) (b) . If there was at that time in excess of 0.05
percent but less than 0.08 percent by weight of alcohol in
defendant's blood, such shall not give rise to any presump-
tion that the defendant was or was not under the influence
of intoxicating liquor, but such fact may be considered
with other competent evidence in determining the guilt or
innocence of the defendant.
"(2) (c) . If there was at that time 0.08 percent or more
by weight of alcohol in the defendant's blood, it shall be
presumed that the defendant was under the influence of in-
toxicating liquor."
"Sec. 106. Habitual user of drugs. Tt is unlawful and
punishable, as provided in Section 110 of this article, for
any person who is an habitual user of or under the influence
of any narcotic drug or any other drug to a degree which

renders him incapable of safely driving a vehicle to
drive or be in actual physical control of a vehicle
within Salt Lake City's corporate limits. The fact
that any person charged with a violation of this section
is or has been entitled to use such drug under the laws
of this state shall not constitute a defense against
any charge of violating this section.'
SECTION 2. In the opinion of the Board of Commissioners it
is necessary to the peace, health and welfare of the inhabitants
of Salt Lake City that this ordinance become effective immediately.
SECTION 3. This 'ordinance shall take effect upon its first
publication.
Passed by the Board of Commissioners of Salt Lake City, Utah,
this loch day of May, 1967.
