the Bamberger Electric Railroad Company, its successors and assigns,
a franchise and right of:.way to construct, maintain and operate a
single spur track upon Third ,'lest street near second North ,street
in salt Lake City, Utah, passed by the Board of Commissioners on
July 28th, 1921.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION I. That sections 1 and 5 of an ordinance granting
to the Bamberger Electric Railroad .;ompany, its successors and as-
signs, a franchise and right of way to construct, maintain and
operate a single spur track upon Third Jest Street near second Berth
Street in Salt Lake City, Utah, passed by the Board of Commissioners ,
on July 28th, 1921, be and the same are hereby amended to read as
follows:
Section I. A franchise and right of way is hereby
granted to the 1.,amborger Electric Railroad Company, its suc-
cessors and assigns, to construct, maintain and operate a
single spur track upon 'Third vest Street near Second North
Street in Salt Lake City; the center line of said spur track
being described as follows:
Commencing at a point 21.03 ft. E. and ap-
proximately 385 feet S. of the intersection monument
of Third Jest and Second North Streets in Salt Lake
27 City survey, and running thence N. on a curve to the
right of 527.65 ft. radius for a distance of 70.46
ft. to the point of frog; thence continuing on a
curve to the right of 200 ft. radius for a distance
of approximately 80 feet; thence on 200 ft. radius
curve to the left for a distance of approximately
105 ft.; thence due N. 70 ft. to a point within the
N. property line of Block 102, Plat ram, Salt Lake City
Survey, and as shown on the accompanying blue print.
Section 5. This franchise is granted for a period
of;twenty-five years from and after the date of the passage
of this ordinance; provided, however, that if for a period
of nine consecutive months during the life of this franchise
said spur track is not used for the purpose for which this
franchise is granted, or if there is a substantial abandon-
ment of said spur track, said franchise shall be voidable
at the option of the Board of Commissioners, and if so order-
ed by the Board of Commissioners said spur track shall,with-
in thirty days after notice, be removed and the street re-
stored to a condition uniform with the balance of said street
with respect to grade and materials and construction, said
work to be done to the satisfaction of the supervisor of
streets. In the event of the failure of said company to re-
move said track and restore said street upon such notice
and within said thirty days' time, said woxk may be done
by Salt Lake City at the expense of said railroad company.
SECTION 2. This ordinance shall take effect thirty-one
days after its passage.
