An ordinance providing for the establishment of one or more
municipal markets, and for the control and government of the same;
and repealing an ordinance upon the same subject, passed by the
Board of Commissioners of Salt Lake City, March 26, 1914.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. The Board of Commissioners may establish one or
more public markets, the location of which within the city limits
shall be determined from time to time by the Board of Commissioners
as conditions and the convenience and necessities of the public
may require. Until otherwise provided by resolution of the Board
of Commissioners, the following street is hereby designated as,
and is made a public market: The south side of Fourth South Street
between State and Second East Streets.
SECTION 2. Said city market shall at all times, during the
hours it shall remain open, be under the immediate supervision
and control of a market master.
The office of market master is hereby created within the
department of Public Safety. The market master shall be appointed
by the Board of Commissioners, and he shall hold office during
such time as the Board of Commissioners may designate, being subject
at all times to removal by the Board. He shall receive a salary of
not to exceed 0150.00 per month. The Board of Commissioners may
employ suoh assistants to act under the direction of the market
master as may from time to time be necessary, and provide for the
. payment of their salaries in such sums as may be designated by the
Board of Commissioners.
The market master shall furnish a bond in the sum of $1,000.0'',
conditioned upon the faithful performance of his duties and proper
accounting of moneys.
SECTION 3. It shall be the duty of the market master to
attend the market on market days, to exercise general supervision
over the market, and to enforce such rules and regulations as may
be established for the government of the same; to assign places to
wagons or persons supplying the market, and maintain order among
them; to see that all weights and measures used by vendors are
approved by the City Sealer of Weights and Measures, having same
tested and sealed before vendor uses them; to collect all rentals
and make daily returns thereof to the City Treasurer; to have care
and custody of all property and fixtures of the market; to keep
the market clean and in good order at all times; to take all steps
that may be necessary to protect purchasers from imposition and to
prevent the sale of unwholesome articles of food; and to perform
such other duties as may be imposed on him.
SECTION 4. All spaces in the market, and all those doing
business there as suppliers and vendors, shall be subject to such
rules and regulations as to supervision and management as are
provided by the Board of Commissioners, and such other rules and
regulations as may be found necessary and adopted by the Commis-
sioner of Public Safety, from time to time.
SECTION 5. Spaces in the market will be rented to producers
only. A "producer" is designated as one offering for sale produce
of which at least 80% is of his own production. Spaces in the mar
ket may be acquired by the payment of market dues equal to twenty-
five cents for each market day. Space privileges shall be obtains•

from the market master who shall issue cards for not less than
eight days' privileges at one time, at a charge of twenty-five
cents per day, said cards to show on their face that they are good
for eight separate market days, numbered and designated according].;
and the market master shall demand of all those occupying space in
the market to show their cards before entering upon the sale of
their products, and he shall cancel out one day's privilege for
eaoh day the holder thereof avails himself of the same. Said card
shall not be assignable, nor shall any one byt the person named
therein do business by virtue of the same.
SECTION 6. It shall be unlawful for any person in the market
by agent or otherwise, to buy or receive or engage, promise or
propose to buy, acoept or receive, or negotiate in any way for the
buying, accepting or receiving for the purpose of reselling the
same; or to resell in the market any produce or other goods brough
to the market.
SECTION 7. All transactions in the market shall be on a reta 1
basis only.
It shall be unlawful for any person in the market to sell any
produce, goods or other articles brought to the market upon a
Wholesale basis.
SECTION 8. The market master shall have power to arrest any
person who shall violate any regulations respecting the public
' market; and it shall be unlawful for any person to resist, hinder
or obstruct such offioer in the discharge of his duties, or fail
to obey his lawful orders.
SECTION 9. Any person violating any of the provisions of
this ordinance shall, upon conviction thereof, be punished by a
fine in any sum not exceeding $50.00, or by imprisonment in the
city jail for a period not longer than thirty days. The court
may, in imposing the fine, enter as part of the judgment, that in
default of the payment of the fine, the defendant may be imprison®.

SECTION 10. The ordinance passed by the Board of Commissione s
of Salt Lake City, Utah, March 26, 1914. with reference to City
Markets, is hereby repealed, and all ordinances and parts of
ordinances in conflict herewith are hereby repealed to the extent
of suoh conflict.
SECTION 11. This ordinance shall take effect upon its first
publication.
