Be it ordained by the Board of Commissioners of Salt Lake City, Utah: a..o1 Z SECTION 1. That Sectionsl„of an ordinance passed by the City Council May 3, 1909 , and approved by the Mayor May 4, 1909 , provid ing when special taxes shall be payable, and as to issuing warrant- for special improvements, and as to interest on said taxes and cite_ warrants , be , and the same 4-s. hereby amended and re-enacted so as to read as follows : SECTION 1. The assessment of special taxes for improve- ment purposes shall be made as follows: The total cost of the improvement, including contract price, engineering, inspectio , publishing notices and making the levy, shall be levied at on- time upon the property and become delinquent as follows : For paving, in ten equal yearly installments, with inter est on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due , to-wit : One-tenth thereof one year after theordinance confirming the levy of the tax for the payment for the improvement becomes effective; one-tenth thereof in two years after such ordinance becomes effective : one-tenth thereof in three years after sue ordinance becomes effective; one-tenth thereof in four years after such ordinance becomes effective; one-tenth thereof in five years after such ordinance becomes effective ; one-tenth thereof in six years after such ordinance becomes effective ; one-tenth thereof in seven years after such ordinance becomes effective; one-tenth thereof in eight years after such ordi- nance becomes effective; one-tenth thereof in nine years after years after such ordinance becomes effective. For sidewalks , sewers , curbing and guttering, in five equal yearly installments , with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due , to-wit: One-fifth thereof one year after the ordinance confirming the levy of the tax for the pa, - ment for such improvement becomes effective; one-fifth thereo in two years after such ordinance becomes effective ; one-fift thereof in three years after such ordinance becomes effective one-fifth thereof in four years after such ordinance becomes effective; and one-fifth thereof in five years after such or- dinance becomes effective . One or more of said installments , in the order in which they are payable , or the whole special tax may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, without interest . In the event of any installment , or the interest aforesaid not being paid on the date the same becomes due , the whole amount of th special tax unpaid at the time said installment and interest are due, shall become due and payable , and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided , that one or more installments in the order in which they are payable , or the whole special tax unpaid, may be paid on the day any installment becomes due , b paying the amount thereof and interest to said day. SECTION 2. All special tax warrants shall be due and par able as follows: If issued on account of paving improvements , in ten equal yearly installments ; if issued on account of side walk, sewer, or curbing and guttering improvements, in five equal yearly installments . Said warrants shall indicate the time when each installment is due , and provide that interest shall be due and payable at the time each installment is due, and in case of failure to pay any installment at the time the same is dam payable, the unpaid principal due at said time shall draw interest at the rate of eight per cent per annum, and that one or more installments, in the order in which they are payable, or the whole warrant, may be paid on the day any installment be Tomes due, by paying the amount thereof and in- terest to date of payment.' It is further provided that said warrants shall not be issued until thirty days after the ordinance confirming the levy of said tax shall become effective; and that any payment• received within said thirty days, on account of the special tax for which said warrants are payable, may be paid to the contractor as a partial payment, and that the balance shall b: paid in special tax warrants, bearing the date the ordinance confirming the levy of said tax became effective. SECTION 2. All ordinances and parts of ordinances, and all resolutions and parts of resolutions in conflict with this ordinance are hereby repealed. SECTION 3. This ordinance shall take effect one day after publication.
