AN ORDINANCE AMENDING Sections 41-5-8, 41-5-11, 41-5-12, 41-5-20
and 41-5-22, of the Revised Ordinances of Salt Lake City, Utah, 1965,
and adding four new sections to Chapter 5, Title 41, of said Revised
Ordinances of Salt Lake City, Utah, 1965, to be known as Sections 41-5-22.1,
41-5-22.2, 41-5-22.3, and 41-5-22.4, all relating to excavations in streets
and alleys.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
SECTION 1. That Sections 41-5-8, 41-5-11, 41-5-12, 41-5-20 and
41-5-22, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating
to excavations in streets and alleys, be, and the same hereby are, amended
to read as follows:
"Sec. 41-5-8. Excavation by city employees. When authorized
by the head of the department involved, it shall be lawful for a
city employee to make an excavation without first having obtained
a permit from the city engineer.
"Sec. 41-5-11. Conditions of bond. The bond required by the
preceding section shall be conditioned that the person making the
excavation shall:
(1) Verify with the city or the utility companies concerned
the location of all underground facilities which might be located
within the limits of said excavation and will be responsible
for any damage to such underground facilities and will pay the
cost of repairs, the repairs to be made by the utility whose
facility is damaged.
(2) Erect and maintain about said installation during the
excavation and until the street is restored to its normal con-
dition, sufficient guards, signals, barricades and lights to
prevent accident.
(3) As soon as reasonably possible after the completion of
said work, restore the street to the same condition in which it
existed prior to said excavation, including the removal of
rocks, dirt, rubbish and all other materials from the street
which exist as a result of excavation.
(4) In case the excavation is through asphalt or cement or
beneath stone blocks, make the cut perpendicular at the sides
and ends from the surface for the full length and width of all
excavations to the necessary depth.

(5) In case the excavation is through concrete, place on
top of the back filling a base of concrete, uniform in con-
struction and depth with the base of the pavement and place
on top thereof a sand joint one-half inch in thickness and fill
the balance of said excavation with cement mortar in the pro-
portion of one part cement to two parts sand, flush with the
surface of the pavement as a temporary surface, all of such
construction in character of materials and workmanship to be
according to the city's specifications for street paving.
(6) After an excavation is commenced, the permittee shall
prosecute with diligence and expedition all excavation work
covered by the excavation permit and shall promptly complete
such work and restore the street to its original condition,
or as near as may be, so as not to obstruct the public place
or travel thereon more than is reasonably necessary.
(7) Notify the city engineer at least four hours prior
to back filling, indicating the time the trench is to be
back filled.
(8) Not permit any excavation to remain open in any street
in the city for a period longer than ten days.
(9) Be responsible for preventing any dust nuisance that
may arise or be created by his operations, maintaining and
guarding and cleaning up the excavated area until necessary
pavement has been replaced, including the use of metal bridging
on heavily travelled streets.
(10) Fine material, free from lumps and stone, selected from
the spoil shall be thoroughly compacted around and under the
substructure to the upper level of such substructure. Above
the upper level of the substructure, back fill material shall
be placed to the subgrade of the pavement in lifts consistent
with the type of soil involved and the degree of consolidation
to prevent settlement. Broken pavement, large stones, roots
and other debris shall not be used in the back fill. The
number and size of each lift shall be dependent upon the type
of soil involved. Such back fill shall be done in a manner
that will permit the restoration of the surface to a density
condition not less than that existing prior to excavation
unless otherwise specified. All back fill shall be properly
tamped by a mechanical tamper.
(11) In case the excavating or related work is done by
machine, do such work with a machine which does not have cleats,
spikes or other protruding metal parts which will come in
contact with the street surface when such machine is in motion.
(12) Pay to Salt Lake City all required fees for street
excavation and replacement.
(13) Hold the city harmless from any and all claims, lia-
bility, demands or damages for any and all injury to persons or
property arising in any manner out of or by reason of such
excavation.
(14) Respond to the city in damages for failure to conform
to any or all of the requirements set forth in this section.

(15) When traffic conditions, the safety or convenience
of the travelling public or the public interest require that
the excavation work be performed as an emergency work, the
city engineer shall have full power to order, at the time the
permit is granted or during the course of the work, that a
crew of men and adequate facilities be employed that such
excavation work be completed as soon as reasonably possible.
"Sec. 41-5-12. Permit must be obtained prior to excavation.
It shall be unlawful for any person, except as provided in Sec.
41-5-8 and 41-5-22.1 to make any excavation in any street, land
or alley, or remove any pavement or other materials forming any
street or improvement thereon without a permit from the city
engineer. The required permit must be obtained before excavation
is commenced, and must be obtained by the person or firm doing
the excavating."
"Sec. 41-5-20. Excavations must be guarded with barricades
and lights. It shall be unlawful for any person, by or for whom
any excavation is made in a public street for any purpose, to
fail to cause a barricade, rail or other sufficient fence to
be placed so as to enclose such excavation, together with dirt,
gravel or other material thrown therefrom, and to maintain such
barricade during the whole time for which such excavation
continues; and it shall be unlawful for any person to fail to
have lighted lanterns or some other proper and sufficient lights
fixed to parts of such barricade, or in some other proper
manner, over or near the excavation, and over and near the dirt,
gravel or other material taken therefrom, and so kept from the
beginning of twilight through the whole of every night during
all the time such excavation exists.
"Lanterns shall burn kerosene or a similar fluid, and have
clear red or ruby globes. Electrical markers or flashers shall
emit light at sufficient intensity and frequency to be visible
at a reasonable distance for safety. Reflectors or reflecting
material may be used to supplement, but not replace, light
sources. The city engineer may restrict the use of lanterns
or other flame devices in fire hazard areas.
"The permittee shall take appropriate measures to assure
that during the performance of the excavation work, traffic
conditions as near as normal as possible shall be maintained
at all times so as to minimize inconvenience to the occupants
of the adjoining property and to the general public.
"Warning signs shall be placed far enough in advance of the
construction operation to alert traffic within a public street
and cones or other approved devices shall be placed to channel
traffic in an orderly and safe manner.
"The permittee shall maintain safe crossing for at least
one of the lanes of traffic in each direction on all streets,
except in cases of streets having only one lane in each
direction, at which times the permittee will insure safe and
adequate traffic flow through the use of flagmen if required
by the city engineer.

"When traffic conditions permit, the city engineer may,
by written approval, permit the closing of streets and alleys
to all traffic for a period of time prescribed by him, if
in his opinion it is necessary. The written approval of the
city engineer shall require that the permittee give notifica-
tion to public agencies and to the general public. In such
cases police and fire departments must be notified and the
city engineer may require notification to the general public.
Such written approval shall not be valid until such notice
is given.
"If any excavation is made across side streets, alleys,
sidewalks, business and residential driveways, adequate
crossings shall be maintained.
"'Closed Street' warnings must be posted at the nearest
intersections whenever a street is completely blocked."
"Sec. 41-5-22. Laying underground mains and laterals before
paving. Prior to the paving of any street, all underground mains
and laterals, pipes and conduits which are to be laid in the street
between the curb lines, together with necessary connections to prop-
erty lines that should be laid in order to avoid the cutting of the
pavement, shall be laid, provided that water and gas laterals need
not be installed when there are no buildings to be served. When-
ever the board of commissioners shall have ordered the paving of
any streets, any person having a franchise from the city for the
laying of underground mains or conduits, shall be notified by the
city engineer in writing, which notice shall be delivered at the
place of business of said person, to proceed to lay such mains or
conduits and connections to the property lines, except in cases where
there are no buildings to be served, as may be necessary to avoid
cutting of the pavement thereafter, within a reasonable time, to
be specified in said notice prior to the laying of the pavement."
SECTION 2. That there be added to Chapter 5 of Title 41, Revised
Ordinances of Salt Lake City, Utah, 1965, four new sections to be known
as Sections 41-5-22.1, 41-5-22.2, 41-5-22.3 and 41-5-22.4, to read as
follows:
"Sec. 41-5-22.1. Emergency action. Nothing in this ordinance
shall be construed to prevent the making of such excavations as may
be necessary for the preservation of life or property or for the
location of trouble in conduit or pipe, or for making repairs, pro-
vided that the person making such excavation shall apply to the
city engineer for a permit on the first working day after such work
is commenced.
"Sec. 41-5-22.2. Heavily travelled streets and highways. (a)
There is hereby adopted as indicating the heavily travelled streets
and highways in Salt Lake City for the purpose of this chapter a
street map, prepared by the city engineer, and designated by him as
the official map describing the heavily travelled streets and high-
ways in the city, as the same appears on file in his office on the
effective date of this ordinance and as amended from time to time
hereafter and kept up to date to reflect the changes in such desig-
nated streets and highways.

"(b) In addition to all other requirements contained in Chapter
5, Title 41, Revised Ordinances of Salt Lake City, Utah, 1965,
relating to excavations in streets and alleys, the person to whom
a permit is issued, when excavating in a heavily travelled street
or highway shown on the street map referred to in subsection (a)
hereof, shall observe the following additional regulations:
"1. He shall place elevated yellow diamond shape warning signs,
no less than 48 inches by 48 inches in dimension, so placed as to
be visible at least 300 feet in advance of the job site during day-
light and illuminated warnings visible at least 300 feet in advance
during nighttime.
"2. Metal bridging shall be used to bridge all excavations in
all travelled lanes left open during peak', hours or overnight so as
to insure a minimum interruption of traffic.
"3. The back fill shall be done in a manner that will permit
the restoration of the surface to a density condition not less than
that existing prior to the excavation. If the excavated material
is of such nature that this density cannot be attained, it shall
be hauled away and satisfactory back fill material used to attain
the required density.
"4. The maximum length of open trench permissible at any time
shall be in accordance with regulations as may be specified by
the city engineer and no greater length shall be open for pavement
removal, excavation, construction, back filling, patching and all
other operations without the written permission of the city engineer.
"5. Every effovt must be made to excavate in these streets during
periods of moderate or low traffic flow; preferably before and/or
after the peak morning (7:00 a.m. to 9:00 a.m.) travel load and
before and /or after the peak evening (4:00 p.m. to 7:00 p.m.)
travel load.
"6. Back filling and replacement of the road surface must be
expedited. The use of temporary surfacing materials shall be used
to reduce the hazard and inconvenience to the motorist using the
so named travelled street or highway."
"Sec. 41-5-22.3. Restoration of surface. (a) By administra-
tive authority. Permanent resurfacing of excavations shall be
made by the city street department. The top surface of the back
fill shall be covered with one inch of bituminous temporary
resurfacing material by the permittee. Such temporary paving material
shall conform closely enough to the level of the adjoining paving
surface and shall be compacted so that it is hard enough and
smooth enough to be safe for pedestrian travel over it as well as
for vehicular traffic to pass safely over it at a legal rate of speed.
The permittee shall maintain temporary paving for a period of not
exceeding fifteen days after all back filling is completed, unless
additional time is required by the city engineer, and shall keep
same safe for pedestrian and vehicular traffic until the excavation
has been resurfaced with permanent paving by the Street Department,
except that if it is not possible to maintain the surface of the
temporary paving in a safe condition for pedestrian travel or vehicular
traffic, then the permittee shall maintain barriers and lights where
required herein.

"(b)By permittee. Upon completion of the back filling and when
required, temporary resurfacing of an excavation within a public
place for the installation or removal of substructures, the city
engineer, at his option, may require the permittee to resurface
that portion of the street surface damaged by the permittee's
excavation as provided in paragraph (a) in which event resur-
facing shall be done immediately in a manner and under specifica-
tions prescribed by the city engineer and subject to the inspection
of the city engineer."
"Sec. 41-5-22.4. Identification of permittee. Any contractor,
individual or other entity which makes an excavation in a Salt
Lake City street shall provide, at the site of the excavation dur-
ing the entire course of work, a wood or metal sign on which is
painted a clearly legible name and emergency phone number and the
name of the contractor, individual or other entity having full
responsibility for the proper completion of the work. All letter-
ing shall be a minimum 2 inches high."
SECTION 3. In the opinion of the board of commissioners it is
necessary to the peace, health and welfare of the inhabitants of Salt Lake
City that this ordinance become effective immediately.
SECTION 4. This ordinance shall take effect upon its first publi-
cation.
