AN ORDINANCE
AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF TOO HUNDRED
TWENTY-FIVE THOUSAND DOLLARS ($225,000.00) REFUNDING BONDS OF SALT LAKE
CITY, UTAH, SERIES OF DECEMBER 1, 1934.
WHEREAS, at a regular meeting of the Board of Commissioners of
Salt Lake City, Utah, held on October 4, 1934, said Board of Commissioners
provided for the issuance of Two Hundred Twenty-five Thousand Dollars
($225,000.00) Salt Lake City Tax Anticipation Bonds, Series of October 5,
1934, bearing interest at the rate of one per cent (1%) per annum, both
principal and interest on said bonds being due and payable on December 5,
1934, said bonds being numbered from one (1) to twenty-three (23), both
inclusive, bonds numbers one (1) to twenty-two (22), both inclusive, in
the denomination of Ten Thousand Dollars ($10,000.00) each and bond
number twenty-three (23) in the denomination of Five Thousand Dollars
($5,000.00), and
WHEREAS, said issue of Two Hundred Twenty-five Thousand Dollars
($225,000.00) Tax Anticipation Bonds was not in excess of the estimated
revenues for the year 1934 and all,of said bonds were duly and lawfully
issued and sold and are now the lawful and valid outstanding obligations
of Salt Lake City, and none of said bonds has ever been adjudicated to
be invalid and there is no litigation pending or threatened involving the
validity of said bonds, or any of them, said bonds being the legal, valid
and binding obligations of said Salt Lake City, and
WHEREAS, general taxes in the State of Utah become delinquent
on November 30th in each year, and at the time said bonds were issued it
was estimated that sufficient revenues from the collection of taxes would
be available for the payment of said bonds at maturity, but the Board of
County Commissioners of Salt Lake County, Utah, has extended the delinquent
date for the payment of taxes to December 20, 1934, so that Salt Lake City
will not have available on December 5, 1954 sufficient funds to retire
said bonds, or any of them, and it is necessary for the best interests of

said City that Refunding Bonds of said City be issued to provide funds for
the payment of said Two Hundred Twenty-five Thousand Dollars (4225,000.00)
Tax Anticipation Bonds at maturity.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Salt
Lake City, Utah:
SECTION 1. That for the purpose of paying and redeeming Two Hundred
Twenty-five Thousand Dollars (4225,000.00) Salt Lake City Tax Anticipation
Bonds, Series of October 5, 1934, dated October 5, 1954, and due and payable
December 5, 1934, being bonds numbers one (1) to twenty-three (23), both
inclusive, bonds numbers one (1) to twenty-two (22), both inclusive, in the
denomination of Ten Thousand Dollars 410,000.00) each and bond number
twenty-three (23) in the denomination of Five Thousand Dollars ($5,000.00),
bearing interest at the rate of one per cent (1%) per annum, payable at
maturity, there shall be issued Refunding Bonds of Salt Lake City in the
amount of Two Hundred Twenty-five Thousand Do]] rs ( 225,000.00), dated
December 1, 1934, in denominations of One Thousand Dollars (41,000.00) each,
numbered from one (1) to two hundred twenty-five (225), both inclusive,
payable aerially in numerical order Twenty-two Thousand Dollars (422,000.00)
on December 1 in each of the years 1935 to 1939, both inclusive, and Twenty-
three Thousand Dollars (423,000.00) on December 1 in each of the years 1940
to 1944, both inclusive, bonds numbers one (1) to one hundred ten (110), both
inclusive, to bear interest at the rate of Three and One-quarter per cent (34%)
per annum, and bonds numbers one hundred eleven (111) to two hundred twenty-
five (225), both inclusive, to bear interest at the rate of Three and One-half
per cent (31%) per annum, interest payable semi-annually on June 1 and December 1
in each year, commencing June 1, 1935. Said bonds and each of them shall be,
except as to numbers, maturities and rate of interest, in substantially the
following form, to-wit:

Salt Lake City, in Salt Lake County, State of Utah, hereby acknowledges
itself to be indebted and for value received hereby promises to pay to the
bearer hereof the sum of
ONE THOUSAND DOLLARS ($1,000.00)
on the first day of December, A. D. 193 with interest thereon at the rate
of ) per annum from date until paid,
payable semi-annually, on the first day of June and the first day of December
in each year, commencing June 1, 1955, said interest to maturity being
represented by interest coupons hereto attached, both principal and interest
being payable in such funds as are, on the respective dates of payment of the
principal of and interest on this bond, legal tender for debts due the United
States of America, at the National City Bank of New York, in New York City.
This bond is issued for the purpose of refunding legal and valid
outstanding bonded indebtedness of said City and is one of a series of bonds
of like date and amount and known as "Salt Lake City Refunding Bonds, Series
of December 1, 1934," issued under and pursuant to the provisions of the
Constitution and Laws of the State of Utah.
The Board of Commissioners of Salt Lake City shall annually levy a
sufficient tax to pay the interest on this bond as it falls due and also to
constitute a sinking fund for the payment of the principal thereof as the same
falls due.
It is hereby certified, recited and declared that all conditions, acts
and things essential to the validity of this bond exist, have happened and
have been done and that every requirement of law affecting the issue hereof
has been duly complied with, and that this bond is within every debt and other
limit prescribed by the Constitution and Laws of said State, and that the full
faith and credit of said Salt Lake City are hereby irrevocably pledged to the
punctual payment of the principal and interest of this bond, according to its
terms.
IN WITNESS WHEREOF, Salt Lake City has caused this bond to be signed
by its Mayor and its City Treasurer and its corporate seal to be hereunto
affixed, attested by its City Recorder, and the annexed coupons to bear the
facsimile signature of the City Treasurer, as of the first day of December,
A. D. 1934.

To each of said bonds she11 be attached a coupon for each installment
of interest contemplated by said bond, which coupons shall be numbered
consecutively, beginning with No. 1, with the several dates of payment and
number of bond and shall bear the facsimile signature of the City Treasurer.
Coupons attached to bonds numbers one (1) to one hundred ten (110), both
inclusive, which bonds bear interest at the rate of Three and One-quarter
per cent (5i%) per annum, shall provide for the payment of $16.25, and coupons
attached to bonds numbers one hundred and eleven (111) to two hundred and twenty-
five (225), both inclusive, which bonds bear interest at the rate of Three and
One-half per cent (3 ) per annum, shall provide for the payment of $17.60.
Said coupons and each of them, except as to dates of payment and amount, shall
be in substantially the following form, to-wit:

limit of Salt Lake City, Salt Luke County, State of Utah,
and is issued according to law.

All the covenants, statements, representations and agreements contained
in said bonds and coupons and all recitals and representations of this
ordinance, are hereby considered and understood and it is hereby ordained
and declared that said covenants and promises therein are the covenants and
promises of said Salt Lake City and that the representations and statements
therein are the representations and statements of said City and it is further
stated and represented that Salt Lake City is a municipal corporation of the
first class under the Constitution and Laws of the State of Utah.
SECTION 2. The interest falling due on said bonds on June 1, 1935,
shall be paid out of the general fund of said City, and to reimburse said
general fund for said installment of interest and to meet the interest falling
due on said bonds on December 1, 1955 and June 1, 1956 and to pay principal
due December 1, 1955, there shall be levied in the year 1935 on all taxable
property within said City, in addition to all other taxes, a direct tax
sufficient to produce the sum of $55,042.50, being $11,042.50 for interest
and $22,000.00 for principal, and thereafter in order to raise the necessary
funds with which to pay the interest promptly, as the same falls due, and
also to constitute a sinking fund for the redemption of said bonds when due,
there shall be levied in each of the years 1956 to 1944, inclusive, a direct
annual tax on all taxable property in said City, in addition to all other
taxes, sufficient to produce sums as follows:

Said taxes, when collected, shall be applied solely for the purpose
of paying the interest and principal of said bonds respectively and for no
other purpose whatever until the indebtedness so contracted under this
ordinance, principal and interest, shall have been fully paid, satisfied
and discharged, but nothing herein contained shall be so construed as to
prevent said City from applying any other funds that may be in the treasury
and available for the purpose to the payment of said interest or principal,
as the same respectively mature, and the levy or levies herein provided for
may thereupon to that extent be diminished, and the sums hereinbefore provided
for to meet the interest on said bonds and to discharge the principal when due,
are hereby appropriated for that purpose, and said amount for each year shall
also be included in the annual appropriation bills passed by the Board of
Commissioners of said Salt Lake City in each year respectively.

SECTION 5. Said bonds and each of them shall be signed by the Mayor
and the City Treasurer and attested by the City Recorder and the coupons
attached to said bonds shall be signed by the facsimile signature of the City
Treasuror. The Mayor and City Treasurer are hereby authorized and directed
to sign, and the City Recorder to attest and affix the seal to each of said
bonds and the acts of said Mayor, City Treasurer and City Recorder in so
doing are and shell be the act and deed of Salt Lake City.
SECTION 4. Said bonds shall be issued in place of the bonds to be
refunded and simultaneously with the cancellation thereof.
SECTION 5. That all ordinances and resolutions or parts of ordinances
and resolutions in conflict with the provisions hereof, be and the same are
hereby repealed, and after said bonds are issued, this ordinance shall be
and remain irrepealable until said bonds and the interest thereon shall have
been fully paid, satisfied and discharged as herein provided.
SECTION 6. The City Recorder is hereby instructed and directed to
cause copy of this ordinance to be published immediately in one issue of the
Deseret News a daily newspaper of general circulation in and
printed and published in Salt Lake City, Utah.
SECTION 7. That an emergency is hereby declared end in the opinion
of the Board of Commissioners because of the necessity of raising funds with
which to meet maturing obligations of said City, it is necessary for the
peace, health and safety of the inhabitants of Salt Take City that this
ordinance take effect immediately.
SECTION 8. NOW, ThEREFORE, BE IT ORDAINED that an emergency is
hereby declared and this ordinance shall take effect end be in force upon
the day of its passage, approval and publication.
Passed by the Board of Commissioners of Salt Lake City, Utah, and
