BE IT ORDAINUJ) BY THE CITY COUNCIL Oi+ SALT LAKE CITY, UTAH: Section 1. That the franchise heretofore granted to the Salt Lake & Fort JJouglas Railway Company and its successors and aseigre to con— struct anti operate a line of railroad in Fourth. "'est. Buri:1T the term of this franchise the said grantee shall be subject to the following conditions, viz: First: That said railway track shall be laid upon and conform to the established grade of the several streets upon which it may be laid, and if said grade is afterward changed by order of the City Council, the said grantee shall at its own expense change the said track so as to conform to the same, and shall between Eighth South and Fifth north Streets keep the road ballasted with gravel to within two inches of the top of the rails, provided that whenever any of tee streets along which the said railway track is eeilt shall be paved, then said grantee, its su„cessors and assigns shall pave between the rails .'O" a space of two feet outside of each rail, with the same material as that used in the street pavement. Second: That said grantee shall gravel and maintain in good con— dition at the established grade, the streets exclusive of the' sidewalks 1].ong which the said track runs, subject tc the approval of tee .c— -:visor of Streets. Third: Said grantee shall put in and maintain such crossings where the line of said railway track intersects the streets of said City as shall from time to time be required by the City Council. Fourth: That said tracks shall be laid and the road operated. so as -3— to cause no unnecessary impediment to the common and ordinary use of said streets upon which it is laid, except as hereinbefore provided. Fifth: Good and sufficient boxes to convey water shall be laid and maintained in good, condition, at the expense of said grantee, at all the water ditches crossed by said railway tract; so as to admit of free passage of water. Section 4, The rights and franchise hereby confirmed and, granted. r..Y°e for the term of fifty years from and after the passage of this ordi— nance. Section I.f. the franchise for a union depot, granted concurrent herewith. to William H. Bancroft and David C. Dodge, be not accepted, then the franchise ' ersin granted shall be null and void and of no efCecto ;ectfon 6, If this grant be not accepted on or before the first • day of Hay, 1900, the same shall be void and of no effect.
