AN ORDINANCE AMENDING SECTION 674, Revised Ordinances of
Salt Lake City, Utah, 1934, relating to licenses.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. That Section 674, Revised Ordinances of Salt
Lake City, Utah, 1934, relating to licenses, be and the same is here-
by amended to read as follows:
SEC. 674. RESTAURANT LICENSE. (a) It shall be unlawful
for any person to commence or carry on a restaurant in Salt Lake
City without first obtaining a license so to do. Application
therefor shall be made to the License Assessor and Collector
showing the location of said restaurant and also the greatest
number of persons such applicant can furnish with food at any
one time in such restaurant.
(b) The license fee therefor shall be at the rate of
$1.00 for each person per year for the maximum number of persons
that can be accommodated at any one time; provided that no li-
cense shall be issued for less than $10.00 and no fee shall be
charged in excess of $100.00.
(c) The term "restaurant" as used herein shall be de-
fined to be any place where food or drink is prepared, served,
or offered for sale or sold for human consumption on or off the
premises.
(d) Every person desiring a license to open or con-
duct a restaurant shall make application therefor accompanied
with the license fee addressed to the License Assessor and Col-
lector. Said application shall be then referred to the Health

Commissioner who shall inspect such premises. In the event
that the premises are satisfactory to the Board of Health, a

permit shall be issued.to applicant and the application shall
be returned to the License Assessor and Collector marked "Per-
mit issued." The License Assessor and Collector may then is- 1
sue the license. In the event that premises are not satis-
factory application shall be filed with th! Health Commission-I
er in his office with findings and applicant notified thereof 1

and shall be given an opportunity to comply with this ordinanci
or may at his option be entitled to a refund of the license •
fee.
(e) Any permit issued may on recommendation of the
Health Commissioner be suspended for a period to be determined
by the Board of Commissioners, or any license may be revoked by
the Board of Commissioners when it appears that the operation
of the restaurant may become a health menace. In any such case
the Health Commissioner shall serve notice on the proprietor
ii
of such restaurant by leaving a copy thereof with the proprietor
or any employee, which notice shall require the proprietor •
thereof to appear at a hearing before the Board of Commissioners
and show cause why permit should not be suspended or license
and permit revoked.
(f) It shall be the duty of the Health Commissioner
to check and inspect the sanitary condition of all restaurants,
and all inspections shall be recorded in duplicate, one copy
of which shall be conspicuously posted and maintained by the
proprietor on an inside wall of the restaurant and the other
copy shall be filed with the Board of Health. In checking
the sanitary condition of restaurants the Health Commissioner
• shall use, as a guide, the following items, each of which
shall be known as an item of sanitat2on; provided, however,
that the enumeration of such items shall not be construed as a1
limitation of the general power and duty of the Health Commis-

,sinner to inspect and regulate restaurants in the interest of
health and sanitation:
Items: Walls, floors, basements, lighting, ventila-1
tion, toilet facilities, wash rooms, flies, rodents, insects,
garbage disposal, sewage disposal, water supply, sanitation, 1
bacteria, filth, employee's clothing, health and personal
habits of all persons handling food, equipment, linen, dishes,
silverware, utensils, cooking utensils, refrigeration, hot
water, food preparation, sterilization.
The Board of Health may make and enforce rules and
regulations to provide sanitary standards with respect to the
above items and to better administer the terms of this ordin-
ance.
(g) Every person engaged in the manufacturing, prepar-
ation or handling of food or employed in or around food in a I
restaurant shall submit to medical examination when and as re-,
quired by the Health Commissioner by a competent licensed
physician and certificates of such examination on forms pro-
vided by the city shall be filed with the Health Commissioner.
Every healthy person shall be entitled to a certificate of
health.
(1) Any person who violates the terms or provisions r
of this ordinance or any lawful rule or regulation promulgated
by the Board of Health to enforce the provisions of this ordi-I
nance shall be punished by a fine in any sum not exceeding
$299.00 or by imprisonment in the city jail for a period not
longer than six months, or by both such fine and imprisonment.
SECTION 2. In the opinion of the Board of Commissioners,
it is necessary to the peace, health and safety of the inhabitants
of Salt Lake City that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its
first publication.
