Ordinances of Salt Lake Gity, Utah, 1934, by adding in and to said Article a new section to be known as section 259X5; tela.tinp to milk and dairy inspection and ice cream. SECTION I. Ihat sections 252X25 and 252X96 of the Revised Ordinances of Salt Lake City, Utah, 1934, as amended by ordi.nanc-s passed by the hoard of Commissioners of salt Lake City, Utah, on October 25, 1934, November 8, 1934, and December 26, 1935, relating to milk and dairy inspection, be and the same are hereby amended to read as follows: 010 CLC. 252X25. SEC. 252X26. FEES. All raw milk separated, bottled or pasteurized shall be subject to an. additional fee of one- twelfth of a cent per gallon payable by the separator, bot- tler, or pasteurizer on or before the fifth day of each month for the calendar month. preceding to the board of Health for deposit with the Iroasurer of salt Lake City; provided that such fee shall not be in any one month less than $5.00 nor more than $75.00. SECTION 2. That Section 257 of an ordinance passed by the board. of Commissioners of Salt Lake City, Utah., on September 2.0, 1934, and designated as bill No. 25 of 1934, relating to ice cream and ice cream products, be and the same is hereby amended by amend- ing the last two paragraphs of said Section 257, relating: to ice Cream Mix which shall read as follows: "ICE CshAM MIX. ice Cream Mix is the unfrozen mix- ture from which ice cream or any other frozen milk or cream product is made. No ice cream mix: shall contain any boracic or sali- syl.ic acid, formaldehyde or other chem]_cel or preservective of any pathogenic bacteria and shall be graded into two grades to be known as Ura.des P. and B. GRADE "A". No more than 50,000 living bacteria per cubic centimeter after pasteurization shall be permitted in any Ice cream Mix to be labeled as Grade A. GRADE "B". No more than 100,000 bacteria per cubic centimeter after pasteurization shall be permitted. in any Ice Cream Mix to be labeled as Urade B. • -3- l'he bacteria. count for the above graded ice cream mix shall be based upon the average for four consecutive specimens or samples according to the American public Health Association standard, and must be pasteurized by the method prescribed in ;section 252 (i) Hevised Ordinances of salt Lake City, Utah, 1934. It must at all times be transported and handled under such temperature and conditions as to check bacterial growth and prevent contamination. SECTION 3. that particle 5 of Chapter 7 of the £,evised Ordinances of salt Lake `'ity, Utah, 1934, be and. the same is hereby amended by adding in. and to said Article 5 a :new section to be known as Lection f59X5, relating to Ice Cream, Frozen Milk and Cream Products, •which shall read as follows: SEC. 259k5. ICC. CREAM RLGULATIONS. (A) No partially filled cans or containers of bulk ice cream shall be delivc,r- ed to the dealer. (B) All can liners shall be kept clean and be stor- ed and handled in a clean manner. (C) At no time during; the ,gae ca.;-sing operations shall any person permit his hands to come in contact with ice cream or his fingers or hands to sample ice cream or dairy products used in ice cream. (D) Ice cream shipping boxes and containers shall be clean and dry when leavincr the ice cream plant and it shall be unlawful to use plain felt shipping containers to park or ship any ice cream or dairy product. (E) Broken packages and partially empty cans shall not be accepted from dealers. Products returned in en unbro- ken condition should be _momptly removed from the vehicles and kept properly refrigerated. (I) No person shall sell, advertise or offer or ex- nose for sale any frozen dessert or frozen dairy product in. this ity unless the manufacturer thereof has a permit to do so under the provisions of this ordinance. (G) No person shall sell, offer for sale, or adver- tise for sale any frozen dairy product, if the brand or trade . E _4- name of the frozen dairy product or the label upon it or the advertising accompanying it shall give a false indication of origin, character, composition, or name of manufacturer, or is otherwise false or misleading in any particular. The label or mark shall be in letters of size, kind and color approved by the Health Officer and shall contain. no marks or words not approved by the Health Officer. (H) No person shall sell or offer or expose for sale ice milk unless contained in a package or enclosed in a wrap- per, upon which package or wrapper shall be conspicuously printed. the words ' Ice Milk." (I) No person shall sell, advertise or offer or ex- pose for sale for human consumption any imitation ice cream. (J) No person shall sell, advertise or offer or ex- pose for sale a frozen dairy product if .it contains any fats, oils, other than milk or egg fats added to or blended or com- pounded with them provided, however, that chocolate ice cream and the coating, or coated ice cream and ice milk may contain cocoa butter. (K) The milk products used. in the manufacture of ice cream, sherbet, ice milk and similar frozen products made in Salt Lake Lity must be obtained from producers holding per- mits issued by the Board of Health of Salt Lake City, in ac- cordance with hrticle 5 of Chapter 7 of the devised urdinan.ces of Salt Lake City, Utah, 1934, and amendments thereto.
