AN ORDINANCE AMENDING Chapter 1 of Title 30 of the Revised
Ordinances of Salt Lake City, Utah, 1965, by adding thereto new
Sections 30-1-27, 30-1-28, 30-1-29 and 30-1-30, relating to the
dissemination and regulation of criminal history record information.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Chapter 1 of Title 30 of the Revised Ordinances
of Salt Lake City, Utah, 1965, be amended by adding thereto new
Sections 30-1-27, 30-1-28, 30-1-29 and 30-1-30, relating to the
dissemination and regulation of criminal history record information,
to read as follows:
Sec. 30-1-27. Dissemination of criminal record history in-
formation. The chief of police or his designated agent shall have
authority to disseminate non-conviction criminal history record
information as defined by federal regulations 28 CFR Part 20
Subpart A Section 20.3, to such persons and agencies within the
limits set forth by state and federal statutes and regulations.
Sec. 30-1-28. Authorized agencies. The chief of police or his
designated agent shall have authority to require state criminal
and non-criminal justice agencies and private non-criminal justice
agencies to enter into a User's Security and Privacy Non-Disclosure
Agreement prior to the police department's dissemination of any
criminal history record information to such agencies and to comply
with such other regulations as required by the state and federal
governments.
Sec. 30-1-29. Fees. Any individual seeking access and review
of his or her own personal criminal history record shall be charged
a service fee of $5.00 per record search. Any non-state non-criminal
justice agency or other person entering into a User's Security
and Privacy Non-Disclosure Agreement with Salt Lake City Corpora-
tion or its designated agent shall be charged a service fee of
$5.00 for such signed agreement.
Sec. 30-1-30. Unlawful dissemination. Penalty. It shall be
unlawful for any person or agency to violate the terms of this
ordinance or the terms of the User's Security and Privacy Non-
Disclosure Agreement. Any person violating the terms of this
ordinance or the terms of the User's Security and Privacy Non-
Disclosure Agreement shall be subject to immediate temporary or
permanent loos of dissemination privileges and criminal prosecu-
tion.
SECTION 2. In the opinion of the Board of Commissioners of Salt
Lake City, it is necessary to the peace, welfare and health of the

immediately.
SECTION 3. This ordinance shall take effect upon its first
publication.
Passed by the Board of Commissioners of Salt Lake City, Utah,
