Be it ordained by the Board of Commissioners of. Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby- levy the tax and provide for the assessment of the same upon the property hereinafter described in Lighting District No. 1.1-B, for the purpose of providing for the operation, maintenance and patrol- ling of arc lamps and the furnishing of electrical energy therefor, to-wit: In Lots 5 and 6 of Blk. 75 and Lots 5, 6, 7 amd 8, of Blk. 76, Plat 'A', Salt Lake City Survey, abutting on the south side of South Temple Street from West Temple Street to State Street, in Salt Lake City. This tax is levied to defray the expense of providing for the operation, maintenance and patrolling of arc lamps (said lamps to be forty-two (42) in number; seven (7) ornamental iron standards on each block in said district, each standard to carry three inverted type ornamental 6.6 ampere luminous arc lamps), said lamps to be il- luminated by electric current; said standards to be approximately 110 feet apart, and to be supplied with electric current for the il- lumination of the same each night from fifteen minutes before dark until midnight, five (5) lamps in said district, however, to be light- ed all night (the cost of operation of the all night lamps being Four Thousand One Hundred Seven and Z0/100 ($4,107.30) Dollars, and the same to be paid for by the city), for a period of ten years from November 3 14, 1937, to November 14, 1947, the circuits for the operation of said system of lamps to be underground, and the portions of said streets opposite the property hereinbefore and hereinafter describe to be especially affected and benefited by said improvement and it is hereby adjudged, determined and established that said property •.nill be especially benefited thereby to the full amount of the tax Thereby levied, and said parcels of land are hereby assessed at an equal and. uniform rate in accordance with the linear foot frontage upon and to the entire depth of the same ownership back therefrom not exceeding 330 feet, and the tax hereby levied and to be assess- ed upon said parcels of land is Nineteen 'Thousand,Seven Hundred Seventy-six and 89/100 ( 19,776.89) Dollars or Ffteen and 949105/1000000 ($15.949105) Dollars per front or linear foot of abutting property, there being 1,240.0 feet abutting said portion liof said improvementtand.the cost of which operation, maintenance, patrolling and furnishing of electrical energy and the property benefited therety is hereinafter set out, and all within the bound - ries of the lots, blocks and street above mentioned in said distri t, which is the total abutters' cost and cost per front foot of said { improvement for a period of ten years, according to the contract entered into for the performance of said work and making said im- provement with Utah Power & Light Company, dated the 14th day of November, 1937, said levy to date and be effective from November 1 , 1937, and the City Treasurer is hereby authorized and directed to i! assess in accordance with the provisions of this ordinance for thel purpose herein mentioned: Fronting on the south side of South temle Street: li All of Lots 5 and 6 of Elk. 75; all of Lots 5 and 6, ', the east 99 ft. of Lot 7, and the east 110 ft. and the west 41 ft. of Lot 8, of Elk. 76; Plat 'As, ;salt Lake City Survey, as the same are shown upon the official plats of said city to the entire depth i of the same ownership back from said streets not exceeding 330 feet and to collect said tax. SECTION II. That the assessment list made by the City II 1 Treasurer, as corrected, approved and completed by the Board of Ecuali nation and Review of the property described in Section I of this ordinance in Lighting District No. 11=D of Balt Lake City, fort the purpose of providing for the operation, maintenance and patrol- ling of arc lamps and furnishing with electrical energy, is hereby ( confirmed and the assessments made and returned in said completed ' lists and the report of the Board of Equalization and Review to the Board of Commissioners of Salt Lake City are hereby ratified, ap- i -proved and confirmed., ii SECTION III. Said tax shall be payable in advance in ten, equal yearly installments, with interest on any delinquent instal,.- merit unpaid at the rate of ten per cent per annum,which interest 1 shall be charged from and after the due date Hof each installment, to-wit: One-tenth thereof fifteen days after the ordinance levying the tax for the payment of the improvement becomes effective; one- 1 i IItenth thereof in one year thereafter; one-tenth thereof in two years thereafter; one-tenth thereof.' in three years thereafter; one--tenth thereof in four years thereafter; one-tenth thereof in five year thereafter; one-tenth thereof in six years thereafter; one-tenth thereof in seven years thereafter; one-tenth thereof in eight years thereafter; one-tenth thereof in nine years thereafter; provided, I however, that one or more of such installments in the order payabl- , or the whole tax, may be paid without interest within fifteen (lb) 1 days from the date this ordinance becomes effective and any such payments made within said fifteen days will be allowed a discount of three per cent (3%), liDefault in the payment of any such installment of princi4 1 pal Then due shall cause the whole of the unpaid principal to become due and payable immediately, and the whole amount of the unpaid 1 principal shall thereafter draw Interest at the rate of ten per ceilit per annum until paid, but at any time prior to the plate of sale orl i foreclosure the owner may pay the amount of all unpaid installment past due, with interest at the rate of ten per cent per annum to date of payment on the delinquent installment:, and all accrued costs, and shall thereupon be restored to the right thereafter to I -4- pay in installments in the same manner as if default had not 1 occurred.
