AN ORDINANCE
AN ORDINANCE AMENDING SECTIONS 4603, 4611 and 4622 of the Revised Ordinances
of Salt Lake City, Utah, 1944, and enacting Section 4626 of the Revised Ordinances of
Salt Lake City, Utah, 1944, relating to assistant chiefs in the police department pre-
scribing the duties of office, method of appointment and removal of such assistant chiefs.,
Be it ordained by the Board of Commissioners ofSalt Lake City, Utah:
SECTION 1. There is hereby enacted a new section to be known as Section 4626,
Revised Ordinances of Salt Lake City, Utah, 1944, as follows:
"SEC. 4626. ASSISTANT CHIEFS. DUTIES. APPOINTMENT. REMOVAL. Three assistant
chiefs shall be appointed by the Chief of Police with the advice and consent of the board
of Commissioners from the members of the police department. Such assistant chiefs
shall act with the chief of Police in supervising the operations of the department and
shall confer with the chief of police to establish policies for the functioning of
the department and conduct of the personnel therein.
The offices of assistant chiefs shall become vacant, and the terms of office
of all assistant chiefs then in office shall cease, upon a vacancy occuring in the
office of the Chief of Police whether by death, resignation or removal, but such
assistant chiefs shall continue to serve until their successors are duly appointed
and qualified. Any assistant chief whose term of office shall terminate as herein pro-
vided shall be eligible for reappointment.
Assistant Chiefs may at any time be removed by the chief of police without
cause, without charges being preferred and without trial, hearing or opportunity to
be heard, except as required by law, whenever in the opinion of the chief the good of
the service will be subserved thereby.
Any assistant chief' removed from office as herein provided shall be restored

SECTION 2. That Section 4603, Revised Ordinances of Salt Lake City, Utah,
1944, is hereby amended to read as follows:
"SEC.4603. APPOINTMENTS. The chief of police shall, by and with the advice
and consent of the board of commissioners and subject to the rules and regulations of
the civil service commission, appoint from the classified civil service list furnished
by the Civil Service Commission, all subordinate officers and employees, except
assistant chiefs, in said police department.

All subordinate officers and employees in the police department, other than
assistant chiefs, as provided for in Section 4626 , shall be subject to removal from
office or employment by the chief of police, for misconduct, incompetency or failure
to perform their duty or failure to observe and obey city ordinances, rules and regu-
lations of the Civil Service Commission , or the rules of the chief of the department
subject to an appeal by the aggrieved party to the Civil Service Commission. Any
such person discharged may, within five days of the order discharging him, appeal
therefrom to the Civil Service Commission, which Commission shall hear and determine
the matter. The discharged person shall be entitled to appear in person and have
counsel and a public hearing. The finding and decision of the Civil Service Commission
upon said hearing shall be certified to the chief of police and shall be enforced and .
followed by him."
SECTION 3. That Section 4611 of the .Revised Ordinances of Salt Lake City,
Utah, 1944, shall be amended to read as follows:
"SEC. 4611. RANKING OFFICERS. Command shall be exercised by virtue of
office and special assignment of officers eligible by law and ordinances to command.
The officers of the department shall rank in the following order:
let --Chief of Police
2nd --Inspector
3rd --Assistant Chiefs of Police in order of seniority
4th --Captains in order of seniority
5th --Lieutenants in order of seniority
6th --Sergeants in order of seniority
In the absence of the chief of police the performance of his duties shall
devolve upon the inspector, and in the case of the absence of the inspector through
disability or otherwise, upon the next ranking officer."
SECTION 4. That Section 4622 of the Revised Ordinances of Salt Lake City,
Utah, 1944, is hereby amended to read as follows:
"SEC.4622. INSPECTOR AND CAPTAINS. The inspector of police, assistant
chiefs of police, and the captains shall each, before they enter upon the duties of
their respective offices, take and subscribe the constitutional oath of office, and
execute a bond, payable to the city, in the penal sum of two thousand dollars, con-
ditioned as provided by law. Such bond to be filed with the recorder and approved
by the board of commissioners."
SECTION 5. In the opinion of the board of commissioners, it is necessary
to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance
shall become effective immediately; therefore, this ordinance shall take effect upon
