A roaolution granting to the Consolidated Railway and Power Company a franchise and permission to construct and operate a double track street railroad from a convenient point on State Street in Salt Lake City, up First Street to the east side of A Street. Be it resolved by the City Council. of Salt Lake City, Utah: SECTION 1. That the Consolidated Railway & Power Company, its successors and assigns, have the authority and consent of the City Council, and the permission is hereby granted it to construct and operate by electric mot±ve power, a double track street railroad , together with. all the necessary switches and turn-outs for the ac- comrmodation of said road from a convenient point on State Street,up First Street to the east side of A Street, upon the following conditions: First. All tracks are to be laid on such grades as are now or may be hereafter established by the City Council, and the grantee herein, its successors and assigns in accepting this franchise and grant, hereby agree to keep in good repair with the same material, { and in the same manner as the rest of the street is at present con- structed or may be hereafter constructed or paved, the space inside its tracks and for a distance of two (2) feet on the outside of the outer rails including all spaces between double tracks where the same may be constructed. Second. The rails used by the grantee in construction of the double track street railway for which this franchise is granted, must be of a weight of not less than fifty-six g (58) pounds per run- ping yard. Third. The grantee must place cars upon said railroad, the franchise for the construction of which is hereby granted, with all !necessary modern improvements for the convenience and comfort of passengers, which shall be run thereon each and every day, both ways as often as the public convenience may require, and at a rate of speed not exceeding twelve (l )miles per hour, and under such ICI 1 -3- grant of this franchise. SECTION 4. This grant and all the terms and conditions thereof shall be accepted in writing by the Consolidated Railway and Power Company within thirty (30) days after its approval. SECTION 5. In ease the grantee herein shall fail to give the bond as in Section 3 of thds resolution provided, or shall fail to accept this grant in writing as in Section 4 provided,for a period • of thirty days after the approval of this resolution, the grant herein contained shall, without further action, become null and void. . yC'--`. iC (."°'.. _'v :.
