40 of 1910 - Ordinance 40 of 1910 – Paving Extension No. 54, Fourth Partial Estimate. AN ORDINANCE . As ordinance levying a tax and for the assessment of property on West Temple Street between Fifth South and Ninth South Streets; and on Fifth South Street between Main and First West Streets, in Paving District No. 28, for the purpose of providing for the grading, gutter- ing and curbing, and paving thereof. • Be it ordained by the City Council of Salt Lake City, Utah : SECTION 1. That the City Council does hereby leTy the tax and provide for the assessment of the same upon the-property hillOnafter' described in ;Paving District No. 28, for the purpose of„provIding for the grading, guttering and curbing, and paving of n pertion;Tof'said district, to-wit: In Lots 1 and 8, Block 32; and 1, 6, 7 and 8, Block 23, all in Plat "A", abutting on the west side of West Temple Street between Fifth South and Seventh South Streets. This tax is levied to defray the expense of grading, guttering and curbing with cement, and paving with asphalt (said asphalt pave- ment to be eighty (80) feet wide between curbs, and nine and 1/2 on (9-1/2) inches thio West Temple Street betweon Fifth South and Seventh South Streets; seventy-two (72) feet wide and nine and 1/2 (9-1/2) inches thick on West Temple Street between Seventh South and Ninth South streets, and on Fifth South Street between Main and West Temple Streets; and sixty (60) feet wide and nine and 1/2 (9-1/2) inches thick on Fifth South Street between West Temple and First West Streets), the portions of said streets opposite the property herein- . before and hereinafter described to be especially affected and bene- fited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets fronting 40 e j -2 upon and to a depth of twenty-five (25) feet bask therefrom, and the tax hereby levied and to be assessed upon. said parcels of land is thirteen thousand five hundred seventy-three and 87/100 (413,573.87) dollars,or ten and 283235/1,000,000 (410.283235) dollars per front or linear foot of abutting property for roadway eighty feet wide, there being 1320 feet of abutting property within the boundaties of the lots, blocks and street above mentioned in said district, which is the total cost and cost per front foot of said pavement acoording to the contract entered into for the performance of said work and making said improvement, with P. J. koran, dated the 16th day of August,1909, and the Treasurer is hereby authorized and directed to assess in ace eordance with the provisions of this oniinance for the purpose herei• mentioned: Eighty Foot Roadway. The east side of Lots 1 and 8, Block 32; the east side of Lots 1. 6, 7 and 8, Block 23, Plat "A", Salt Lake City Survey, as the same ar shown upon the official plats of said city to a depth of twenty-five (25) feet back from said s treet, and to collect said tax. SECTI014 2. Said tax shall become and be delinquent in ten equal installments, as follows, to-wit: One-tenth thereof one year after the approval of the ordinance confirming the levy of the tax for the payment for such improvement; one-tenth thereof in two years after such approval; one-tenth thereof in three years after such approval; one-tenth thereof in four years after such approval; one-tenth there- of in five years after such e proval; one-tenth thereof in six years after such approval; one-tenth thereof in seven years after such ap- proval; one-tenth ther®of in eight years after such approval;( one- tenth thereof in tine years after such approval; and one-tenth there- Hof in ten years after such approval. One or more of said installments or the whole tax may be paid on or before ten days after the approval of the ordinance confirming the levy of the tax. One or more install- ments, or the whole special tax may be paid on the day any install- meat becomes due by paying the amount thereof and interest to da e 0 - i -3 -3- payment. Each of said installments shall bear interest at the rate of six (6) per cent per annum from the date of the approval of the ordinance confirming the levy of said tax until the date of delin- quency, and eight (8) per cent per annum from delinquency until paid.
