Result AN ORDINANCE AN ORDINANCE AMENDING SECTIONS 200, 201, 212, 215, 216, 217, 218, 219, 223, 224, 225, 226, 227, 228 and 229 of Article V, Chapter V, Revised Ordinances of Salt Lake City, Utah, 1920, re- pealing Section 210 of Article V, Chapter V, and amending said Article V, Chapter V, by adding in and to said Article V, fifteen new sections to be known as Sections 229X1, 229X2, 229X3, 229X4, 229X5, 22936, 229X7, 229X8, 229X9, 229X10, 229X11, 229X12, 229X13, 22.9X14 and 229X15., relating to dairy, milk, meat and food inspec • - tion. Be it ordained by the Board of uommissioners of Salt Lake Cityr, Utah: SECTION I. That Sections 200, 201, 212, 215, 216, 217, 218, 219, 223, 224, 225, 226, 227, 228 and 229, of Article V, Chapter V, Revised Ordinances of Salt Lake City, Utah, 1920, be and the same are hereby amended to read as follows: SEC. 200. CHIEF VETERINARY INSPECTOR. DUTIES. The Chief Veterinarg. Inspector shall, under the direction of the health commissioner, have charge of the dairy, meat and food inspection and such other duties as may be assigned by the health commissioner. The chief veterinary inspector or his duly quali- fied assistants shall personally inspect any dairy,or cream- ery products, meat or meat food products manufactured, pro- duced, stored, kept, sold or offered for sale within Salt 77' to Lake Ct '; which he may suspect, or have reason to believe 1 li j era impure, unhealthy, adulterated, misbranded or counter- feit. He shall visit and inspect the various dairies, creameries, cheese and butter factories within Salt Lake City, or those whose products are sold within Salt Bake City, and enforce proper sanitary regulations in their management, li surroundings, production, manufacture, storage, keeping and sale of all dairy products. He shall enforce proper sanitary regulations in the management, manufacture, storage, keeping and sale of all meat, meat food products, and other articles li of food, and shall have charge, supervision and maintain in- speotion of all slaughter houses, factories and places, where animals are slaughtered for food, or where any article of food is prepared for human consumption, and shall report the results of his inspection monthly to the Board of Health, or oftener if required by said Board. He shall also have power and authority to open any li package, can or vessel containing or supposed to contain any , article of food manufactured, sold or exposed for sale, or held in posaession with intent to sell, in violation of the provisions of this ordinance or other laws of this city, and may inspect the contents thereof, and may take samples there- from for analysis. kll dealers, clerks, bookkeepers, express agents, railroad officials, employees, or common carriers shall render them all the assistance in their power, when so requested, in tracing, finding or discovering the presence of li any article prohibited by law, and in securing samples there- of as herein provided. V. All samples of milk or cream taken or brought to the office of the Board of Health, by any inspector, shall be' analyzed or otherwise satisfactorily tested, and whenever li said milk or cream so tested, or analyzed, shall be found violative of any of the provisions of this ordinance, the necessary steps shall be taken for the prosecution of personal -2- L violating the same. An accurate record of the results of all tests or analyses shall be kept and shall be accessible as a matter of public information. • SEC. 201. DEFINITIONS. Milk. Milk is hereby de- fined to be the clean, fresh, lacteal secretion of one or more healthy cows, which are properly fed and cared for; ex- cluding that obtained from cows within fifteen (15) days be- fore or within ten (10) days after parturition, or such longer period as is necessary to render the milk colostrum li free; and excluding that from cows whose placenta has been retained, and excluding milk from such cows for a period of jl at least ten (10) days after such placenta has been complete- ly removed; which contains not less than 12% solids, and not less than three and two-tenths per cent (3.2%) of milk fat. it Ziik Fat. Milk or butter fat is the fat of milk. Skimmed Milk. Skimmed milk is milk from which all or a portion of the milk fat has been removed and which con- tains by weight not less than eight and one-half per cant I'd (tra) of milk solids not fat. Whey. Whey is the product remaining after the re- moval of fat and casein from milk in the process of cheese making. Modified Milk. By the term "modified milk" is meant milk conforming to the standard of any subdivision of the classification known as "Inspected Raw", which has been changed by the addition of water, sugar or milk or other sub- stance intended to render the milk suitable for special infant feeding. Milk Produots. Unless otherwise expressly stated, whenever used in this ordinance, the term "milk products" shall be taken to mean and include skimmed milk,'cream, sour cream, buttermilk, condensed or concentrated milk, condensed -3-� t 71 I �� I i skimmed milk, or modified milk, or any other product made from milk. Condensed Skimmed Milk. Condensed skimmed milk is skimmed milk from which a considerable portion of Water has been evaporated. Milk other, than Cow's Milk. Goat's, ewe's milk, or milk of other animals than cows is the fresh, lacteal secretion, free from colostrum, obtained by the complete milking of healthy animals other than cows, properly fed and kept, and conforms in name to the species of animal from which it is obtained. all such milk shall be produced and said in conformity to the sanitary requirements of this ordinance. Butter. Standard butter is the clean, non-rancid it product made by gathering in any manner the fat of fresh or ripened cream or milk into a mass which also contains a smell portion of other milk constituents, with or without salt, or added harmless coloring matter and contains not less than eighty (80%) per cent of milk fat, and less than sixteen (16%) per cent moisture. aeeso. Cheese is the sound, solid and ripened product made from milk or cream by coagulating the casein thereof with rennet or lactic acid, with or without the addi- tion ripening ferments and seasoning, and contains in the water free substance not less than fifty per cent (50%) of milk fat. Cottage, Cheese. Cottage cheese is the sound, solid and ripened product made from skim-milk, whole milk, or cream, it by coagulating the casein thereof, with rennet or lactic acid or by allowing the casein to coagulate by the action of a culture of lactic acid bacteria, and by expelling the water with the aid of heat. Only the grades of milk provided for 1 in this ordinance shall be used for the manufacture of such cheese. g„ ICI Kumiee. Kumiss is the product made by the alcoholid fermentation of mare's or cow's milk, Buttermilk.. Buttermilk is hereby defined as (1) the product that remains when butter is removed from milk or cream in the process of churning, or (2) the product result- ing from the souring or treatment of milk, cream, skim-milk, dried milk, or milk products in any way so that it resembles1 the product defined in (1). Evaporated milk, (unsweetened). Avaporated milk is milk from which a considerable portion of water has been evaporated and which contains not less than twenty-five and five-tenths per cent (25.5%) of milk solids; and seven and eight-tenths per cent (7.8%) milk fat. Condensed Milk. (Sweetened). Sweetened condensed milk is milk from which a considerable portion of water has been evaporated and to which sugar (sucrose) has bean added, and which contains not less than twenty-eight per cent (28%) of milk solids, and eight per cent (8%) milk fat. Pasteurization. .Wherever used in this ordinance the term Milk", "Skimmed Milk, or Cream, Pasteurized," shall be taken to mean and include milk, skimmed milk, or cream ' it which has been heated to a temperature of not less than one li hundred and forty-two degrees (142`) Fahrenheit and held at such temperature for not less than thirty minutes (30). No milk, skimmed milk, or cream shall be designated "Pasteurized" unless it shall have been heated in conformity with the pro- visions of this ordinance. No milk, skimmed milk or cream shall be pasteurized. a second time. Pasteurized milk shall be bottled only at the place of pasteurization. Milk Producer. A milk producer is any person, firm' or corporation who owns or controls one or more cows, a part -5- 41 or all of the milk from which is for sale or is sold or de- i livered to another person, firm or corporation. ii Milk Distributor, A Milk Distributor or Milk dealer is any person, firm or corporation who has in posses- sion for sale, offers for sale, sells or delivers to another , any milk or milk products for consumption or manufacturing purposes. Milk Consumer. A Milk Consumer is any person, firm or corporation who buys or receives from another any milk on milk products for such food or manufacturing purposes as will fully and permanently remove such milk or milk products from further sale or transfer to another as such milk or milk pro- ducts. Milk Plant. A Milk Plant is any place, plant or premises, or establishment where milk or cream is collected, handled, processed stored bottled pasteurized or prepared for distribution. Baix,y. Farm. A Dairy Farm is any place or premises where one or more cows are kept, p , part or all of the milk it or milk products from which is sold or delivered in bulk to any person, firm or corporation. ; I:abeling; Bottled Milk. No words, statements, designs mark or devise shall appear on that part of the outer side of any cap on any bottles bearing the grade and designation of milk and milk products unless authorized and permitted by the Board. of Health. A proof print of suoh cap, showing the size and arrangement of the lettering thereon, shall be submitted 1 II to and approved by the said Board before being attached to the bottle containing milk, skimmed milk or cream of the said 1 grade and designation. SEC. 212.lANS AND BOTTLES TO BE CLEANSED BEFORE FILLING. It shall be unlawful for any person, for the purpose of sale, to fill or re-fill with milk, cream or other milk • product any glass jar or bottle,can, container, or other receptacle without first thoroughly washing the same with hot water, alkali, or other suitable cleansing material, and thereafter sterilizing the same with live steam for at least fifteen minutes. II SEC. 215. MILE, BUTMR AND CASE. It shall be unlawful for any person to keep at any place where milk, butter or cheese is sold, or to sell or deliver, or offer or have for sale, or keep for use, or to bring to Salt Lake City any unwholesome, skimmed, watered, or adulterated milk, or milk known as swill milk, or milk from cows or other ani- mals,it which for the most part have been kept in stables, or have been fed on swill or milk from sick or diseased cows or other animals, or any butter or cheese made from any such milk; or any unwholesome butter or cheese. No person, by himself, or by his agents or employees, shall sell, offer or expose for sale, or have in his posses- sion with intent to sell in salt Lake City, any renovated butter, unless the same shall have printed upon each and every package, roll, print, square or any container of such renovated butter, the words "Renovated Butter", in letters not less than one-half inch in height, or shall.?mmt have se- cured from the state food and dairy commissioner a license, as provided by the laws of the State of Utah. No milk adulterated, reduced or changed in any re- spect by the addition of water or other substances, or by the removal of cream, except as hereinafter provided, shall be brought into Salt Lake City, or held, kept, sold or offer- ed for sale; nor shall any person, keep, have, sell or offer for sale, or have in his possession with intent to sell in said pity any such milk. Milk and cream shall be deemed to be adulterated in any one of the following cases: -7- 11 ai (a) Milk containing more than eighty-eight per cent of water or fluids. (b) Milk containing less than twelve per cent of ' milk solids. (c) Milk containing less than three and two-tenths jl per cent of fats. (d) Milk drawn from animals within twenty days be- fore or five days after parturition. (e) Milk drawn from animals fed on any substance in a state of decomposition or putrefaction, or any unwholesome food. (f),Milk drawn from cows kept in a crowded or un- healthy condition. (g) Milk from which any part of the cream has been removed. li (h) Milk which has been diluted with water or any other fluid, or to which has been added, or into which has been introduced any foreign substance whatever. II (i) Milk the temperature of whioh is higher than sixty degrees Fahrenheit, or which contains an excess of bacteria; all milk found to have a higher temperature than jl sixty degrees Fahrenheit, the commissioner or any officer of the Health Department may seize, denature and destroy. (.) Milk having a specific gravity of less than one and twenty-nine thousandths at 60 degrees Fahrenheit. (k) Milk containing any pathogenic bacteria. (1) Milk containing any boraoia or salycylic acid, formaldehyde or other foreign chemical, or any preservative whatsoever. (m) Milk containing bacteria of any kind, more than Ili two hundred fifty thousand per cubic centimeter. • 4. I!, (n) Milk drawn from any cow having a communicable it disease, or from any cow or cows in a herd which contains any diseased cattle, or from a cow or cows in a herd the attend- ants of which are afflicted with or have been exposed to any communicable disease. SEC. 216. MILK. INSPECTION OF. ADULTERATION. DAIRIES ETC, It shall be unlawful for any person to bring or send into Salt Lake City for sale, either at wholesale or retail, or to offer for sale, or have in his possession with intent to sell therein, any milk, without having obtained from the said Board of Health, annually, a permit in writing, so to do. Such permit shall be given by said Board of Health when upon inspection of the premises where cows are kept, in, speotion of the vessels used to hold such milk, and test of i jl the milk, it shall appear that said premises and vessels are kept in good sanitary condition; that the milk meets the re- quirements of the ordinances of the city and rules of the Board of Health, and upon condition that none but pure, un- adulterated and undiluted milk shall be sold. All dairymen selling milk or cream in the city of Salt Lake shall furnish the Board of Health a certificate from the State Veterinarian or United States Government In- spector, showing that cows furnishing milk or cream brought within the city limits to be sold or otherwise disposed of for human food, are free from tuberculosis or other dangerous disease, and annually thereafter all such cows shall be sub- jected to the tuberculin test by either the Board of Health, the state veterinarian or United States government inspector, and all reacting animals shall be excluded from the herd and ; isolated. No person shall bring into the city for sale, or shall sell or offer for sale, or have in his possession with intent to sell, any milk which has been obtained from any _9- t� milk dealer,dairyman or other person not having a permit from the Beard of Health of Salt Lake City. Any dairy, milk dealer or other person, upon appli-' cation to the Board of Health for a permit to sell or deliwer milk, shall file a sworn statement giving his name and ad- dress, the number of cows he owns or has charge of, the aver- age amount of milk, (estimated) sold by him each day, the names, addresses and permit numbers of all persons from whom he buys milk, the average amount of milk (estimated) sold by each of them each day, and the number of cows owned by or in charge of each. Every person using in the sale or distribution of milk a delivery wagon or other vehicle, shall keep the same at all times clean and free from any substance liable to contaminate or injure the purity of the milk. SEC. 217. STORING OP MILK AND MILK PRODUCTS. QUAL- ITY, ETC. OP SKIMMED MILK. No person shall store any milk in any basement, cellar, milk house, dairy or other place l i unless such place is well lighted and ventilated, and if such room or space is a cellar or sub-cellar or is located jl in a cellar or sub-cellar, the same shall be properly con- 1 crated, guttered and drained. No person shall store any milk in any basement, cellar, refrigerator, milkhouse, dairy, or other place which is within fifty feet of any closet or privy vault or cess- pool or any horse or cow stable or any chicken or poultry ji yard or coop. No person shall bring into Salt Lake City for sale or to sell, offer for sale, or have in his possession with intent to sell, milk from which the cream has been removed, either in whole or part, unless sold as skimmed milk, and unless on both sides of the vehicle from which such milk• is sold there is displayed in letters not less than four inches. -10- in height, the words "Skimmed Milk". The "Slimmed Milk" shall be sold or delivered from the containers, vessels or receptacles as heretofore provided. No person shall bring into the city for sale, or sell or offer for sale, or have in his possession with intent to sell, any so-called skimmed milk containing less than nine) i I and five-tenths per cent of milk solids, and not to exceed 1� an acidity corresponding to 3 C.O. of normal 1-10 solution of soda per 100 cubic centimeters of milk, and must be de- livered to purchasers at the same temperature as provided in this ordinance for sweet milk. It shall be unlawful for any person to ship or jil transport to Salt Lake City, for sale or delivery or to be used as human food, any milk or cream except in sanitary bottles or single service containers unless the container in which the same is shipped or transported is sealed with a suitable seal. 1 Any person who shall have in his possession with intent to sell, exchange or deliver skimmed milk in any manner other than as above prescribed, shall be subject to the same 11 penalties as are provided for the sale of whole milk in qual- ity contrary to this ordinance. CREAM. No person shall bring into Salt Lake City, or hold keep, sell or offer for sale, or have in his possession with intent to sell any cream to which any foreign substance has b been added or containing less than 18 per cent butter fat, and when sold to any person must be truly represented, as to its being "ooffoe" or "whipping cream" and if sold as "whipping j cream" must contain not less than 30 per cent butter fat, it I with the acidity not greater than 14 degrees. The term "cream", means that portion of milk repre- !i sented in milk fat which rises to the surface of milk on -11- standing or is separated from it by contrifugal force and which is fresh and clean. SEC. 218. DAIRYMEN TO REPORT COT:II',:UNICABLE DISEASES. Any milkman or dairyman being afflicted, or any member of whose family is afflicted with a communicable disease, shall 1 1 report the same to the Board of Health within twenty-four hours after he knows or has reason to suspect such communica- ble disease, and said Board shall take such steps as are pre-1 scribed by the local or state board of health for the preven-'I it tion of the spread of said communicable disease by the milk- man, dairyman, his family, hired help or their families. c .very person handling milk must be free from the i following communicable diseases: actinomycosis, anterior poliomyelitis, anthrax, bubonic. plague, cancer, cerebrospinal meningitis, chickenpox, cholera, diphtheria, epidemic dysen- tery, erysipelas, German measles, glanders, influenza, leprosy, malarial fever, measles, mumps, ophthalmia, neonatorum, pellagra, pneumonia, puerperal fever, rabies, relapsing fever, a scarlet fever, septic sore throat, smallpox, tetanus, trachoma, 3 trichiniasis, tuberculosis, typhoid fever, typhus fever, un- cinariasis (hookworm), venereal diseases, whooping cough, scabies, impetigo contagiosa, or any disease accompanied by discharge of pus. any person having any of the foregoing diseases shall be excluded from handling milk until free of said diseases, and all persons handling milk shall be subject' to examination by the Iaedical Inspectors of the .Board , T Health. No milk or cream shall be sold or dispensed as food from any house, store, shop, dairy or other place in which there is a case of contagious or infectious disease as aforesaid, until all danger of contagion has been removed and permission in writing is obtained from the Board of • Health, authorizing the sale of milk or cream from said -12- house, shop, or from said dairy or other place. SEC. 219. ICE CREAM. STANDARD OF. All ice cream manufactured and sold in Salt Lake City must conform to the following standards as regards purity: li All ice cream not conforming to the standard here- inafter set forth shall be deemed to be adulterated. Ice cream as contemplated in this ordinance is a frozen product made from cream and sugar, with or without a natural flavoring, and must contain not less than fourteen (14) par cent of milk fat. Fruit ice cream as contemplated in this ordinance is a frozen product made from cream, sugar and sound, clean, mature fruits, and shall contain not less than twelve (12) per cent of milk fat. Nut ice cream as contemplated in this ordinance is, a frozen product made from cream, sugar, and sound, non-rancid, nuts, and shall contain not less than twelve (12) per cent of milk fat. Provided, that the sale of ice cream, defined as above, when mixed with gelatin not to exceed three ounces of gelatin to ten gallons of ice cream, or with tragacanth or other vegetable gum, or with eggs, will be allowed if the same is labeled and sold as "gelatin ice cream" or "gum ice cream" or "egg ice cream", as the case may be, and provided, that the °utter fat shall not fall below the standards, as stated above; and provided further, that all persons selling ice cream in any form at retail shall place conspicuously, within plain view of customers, a legible sign indicating the quality of ice cream in accordance with the above standards, or sold or dispensed in said establishment. Ice cream must be made and stored in sanitary premises. 1 It must not be made or stored in living rooms. -13- ail II Cases of communicable disease where ice cream is li • sold or manufactured must be reported. The name and address of the maker must appear on street barrows or ice cream carts. SEC. 223. MILS TO BE GRADED. All milk held or kept for sale, offered for sale or sold and delivered in Salt Lake 1 City, shall be so held, kept, offered for sale or sold and delivered under either or any of the grades or designations 1 I• hereinafter enumerated., and under no other, and in accordance with such rules and regulations as may be adopted by the Board of Health. 1. Paw IeIilk. 2. Inspected raw milk. 3. Pasteurized milk. 4. Buttermilk. 5. Skimmed milk. 6. Condensed milk, evaporated milk and fluid milk products not otherwise specified. SEC. 224. RAW MILS GRADED. Raw milk shall apply to I milk which is produced on dairy farms holding a producer's permit from the Salt Lake City Board of Health, and the herds producing such milk shall be free from tuberculosis provided for in Section 216 of this ordinance; such milk be consigned or delivered to pasteurizing plants for pasteurization and to all other places in which milk is used for manufacturing purposes, but shall not be sold or otherwise disposed of in its raw state, nor shall such raw milk be used in the manu- facture of ice cream or butter without having been pasteurized.. SEC. 225. INSPHCTED RAW MILS. Inspected raw milk is milk produced by dairies holding a special permit from the Board of Health and conforming to Sec. 216 of this ordinance,) in addition to which: (a) All cows shall be examined clinically at least -14- once a month by a veterinarian from the Board of Health; all cows with any disease or pathological condition shall be excluded from the herd and premises. (b) Such milk shall not contain more than 15,000 bacteria per cubic centimeter when delivered to the consumer. (o) Such milk shall immediately upon being drawn from the cow, be cooled to a temperature of at least 56 de- grees .Fahrenheit, and shall within one hour after the comple- tion of the milking be put and kept in the closed final con- tainer. (d) Such milk shall be delivered to the consumer wi4 tin 7.4 hours"after milking. (e) It shall be produced on farms scoring not less li than 80 on the following score card: Score. B(UIPHDN T. (a) All milk or cream used for pasteurization must come from dairy farms holding a producer's permit from the Salt Lake City Board of Health and shall contain not more than 500,000 bacteria per cubic centimeter. 1 (b) Only such milk and cream shall be regarded pasteurized as has been subjected to a process in which the I�I it temperature and exposure conform to the following: bested to one hundred and forty-two degree$ (142°) Fahrenheit and held at this temperature for thirty minutes. (c) The pasteurized product shall be cooled at once II to a:temperature of fifty (50°) Fahrenheit or less. This cooling shall be so conducted that the pasteurized product is not exposed to contamination. (d) Pasteurized milk must be delivered to the con- sumer it within thirty-six. (36) hours after pasteurization. (e) All bottles in which pasteurized milk is de- livered to the consumer shall be plainly labeled "Pasteurized." (f) Pasteurized milk shall not contain more than 50,000 colonies of bacteria per cc in samples taken from con-1 tainers at the plant which are ready for delivery to the consumer. 4 I (g) Pasteurized milk must be kept below (50`) de- greea Fahrenheit up to the time of delivery to the consumer. -18- li .(h) An approved form of time and temperature recording apparatus shall be installed on pasteurizing appliances and shall be so maintained that it will accurate- ly record time and temperature of milk during process of pasteurization. The records shall be dated and filed at the pasteurization plant and subject to inspection of the Board of Health. SEC. 227. MILK HOUSE.. Construction. Every dairy farm shall be provided with a milk house which shall be it separated from the stable and dwelling houses and shall be kept clean and not used for any purpose except the handling of milk. The milk house shall have a tight floor, preferably of cement or other impervious material. It shall be kept clean and in good repair. The floor shall have sufficient slope to provide proper drainage. A floor drain shall be prodided,',and shall be connected with either a drain ditch or a sewer outlet. All drainage must be carried completely away from the premises. The walls and ceilings of the milk houses shall be of tight and smooth construction which permits easy clean- ing. If a milk house is used for bottling purposes the walls shall be painted with a high grade paint of a light color. Walls and ceilings shall be kept clean at all times. Sufficient windows shall be provided for adequate light; properly screened; be so constructed that they can be opened; and be kept clean. Doorways shall be provided with a self-closing screen door during fly time. The solid door of the milk houses shall be kept closed when there is opportunity for duet to be blown into the milk house thereby contaminating the milk and utensils. ii The milk house, in which milk is stored or prepared for sale, shall not be located in proximity to any privy • -19- �= I I I, i vault, water closet or other contaminating surroundings. II 1 SEC. 22S. WET MILKING AND USE OF EMOLLIENTS PROHIBITED, NETHOI'S. MILKING. Cow's flanks, udders and teats shall be kept 1 clean. If necessary, udders and teats shall be washed with clean water and dried with a clean cloth immediately before milking. Milkers shall wash their hands with soap and water and dry them with a clean towel before milking. Milkers shall keep hands dry and clean during milking; they shall not come in con- tact with the milk. The use of vaseline, lard, oil, or other sub- stance is strictly prohibited on cows' teats during the process of milking. All milking must be done into covered buckets or vessels with clean, dry hands. All milk buckets, vessels, strain- 1 ere and strainer clothe must be thoroughly washed with soap and water and thoroughly sterilized with boiling water before use. Milkers shall wear clean outer garments during milking. Only covered milking pails shall be used. Milk shall be poured into cans in a clean place, prefer- ably the milk house. The mouth of milk cans and strainers shall be protected against flies, preferably by a cheese cloth cover. The pouring of milk into cans placed in the stable is prohibited. Where the milk house is adjacent to the stable, cans shall be filled in tha milk house. Where the milk house is at a distance from the stable, cans shall be filled outside the stable in a clean, sheltered place and shall be removed to the milk house immediately after milking. Where milk is cooled at a shipping station, cans shall I be delivered to the station within two hours after the comple- tion of milking. If filth gets into the milk by accident, the entire con- I tents of that pail shall be discarded. The pail shall not be used again until it has been thoroughly cleansed as provided in this ordinance. SEC. 229. CLEANSING AND STERILIZING UTENSILS. All 1 2U' 11111 utensils which have contained milk or have been in contact with milk shall be cleaned in the following manner: 1. Rinsed with cold water immediately after use. 2. crubbed with brush and alkali solution. 3. Rinsed with clean water. 4. Scalded with boiling water or sterilized with steam. 5. Utensils shall be stored in clean place until again used. 6. Cloth strainers shall be boiled for one-half hour to render them sterile. No cloth shall be used more than once jl unless it is again sterilized. SEC. 2. That Section 210 of Article V, Chapter V, Re- vised Ordinances of Salt lake City, Utah, 1920, be and the same is hereby repealed. li SEC. 3. That .:rtiele V, of Chapter V, Revised Ordinances of Salt Lake City, Utah, 1920, be and the same is hereby amended , by adding in and to said Article fifteen new sections to be known as Sections 229x1, 229AZ, 22913, 22914, 22915, 229ii6, 22927,229X81 22919, 2292C10, 229111, 229112, 229E13, 229E14 and 229X15 and to read as follows: II SEC. 229X1. CLEANLINESS OF STABLES. No acoumula- Ii tion of manure, urine, stagnant water or other filth shall be permitted in or within fifty (50) feet of said stalls, stanchions or places where milking is done. Cow manure shall be removed from cow-stables twice. jj daily. Ceilings, walls, ledges and stanchions in the cow- stables shall be kept clean, and windows shall be washed as 11 often as is necessary to keep them clean. Horse manure shall not be used in a cow-stable for any purpose. The milking barn used for housing or stabling of milk cows shall not be used for housing or stabling of any animals other than milk cows, except as otherwise provided. SEC. 229X2. ROOF AND BARN YARD. The roof of the II . _ -81_ cow atabie shall b.e watertight. No manure or rubbish shall be allowed to accumulate in the barn yard. The barn yard shall be sufficiently drain4 ed to keep it reasonably dry. SECTION 229X3. MILS UTENSILS. (a) Constructions. Utensils shall be of such construction so as to be easily cleaned. Joints, seams and rims of utensils shall be smooth ! and entirely filled with solder. No milk vessels shall be used which are old, rusty or dilapidated. Vessels used for carrying milk shall be used for no other purpose. (b) Buckets. All milk buckets used by milkers for drawing milk from the cows shall be of a small top design, approved by the Board of Health. (c) Cans. Milk cans and covers shall be of smooth II metal with inside seams soldered flush. (d) Strainers. The use of wire mesh strainers is forbidden. Metal holders used for the support of cotton disc or cl th strainers shall be of such construction as permits easy cleaning and proper sterilization. (e) Aerators and Coolers. Mechanical coolers, if it used, shall be of a type and construction easily cleaned, with Joints and seams soldered flush. (f) Stirring rods. Stirring rails, if used, shall be of metal construction with smooth surface and seams sol- dered flush. (g) Milking machines. Mechanical milkers shall be of a pattern approved by the Board of Health. They shall be of sanitary construction and capable of being easily taken apart. SEC. 229X4. REerQUIREFLATS OR CIEAJTEDS, SHIPPING STATIONS,, FARM AND CITY BOTTLING AND PASTEUB1ZINq PLANTS, SUPPLYING MILK AND MILK PRODUCTS TO SAGT LAKE C_ITY.a Employees. No person who is affected with any -22- 1.1 infectious, contagious or communicable disease or who re- ' II sides, boards, or lodges where he comes in contact with any person affected with such disease, or who is a carrier of the disease germ of typhoid fever, scarlet fever, diphtheria, poliomyelitis or dysentery shall be employed in any creamery, shipping station, bottling, pasteurizing plant, ice cream plant; or shall handle or deliver milk or milk products or milk and milk product utensils in any manner whatsoever. Clean, washable outer garments shall be provided for and worn by employees while handling milk and milk pro- I 11 ducts. SEC. 229.0. BUILDINGS. (a) Location. No milk plant shall be located within the city limits where there are con- taminating surroundings which, in the opinion of the Board of Health, would endanger the public health. The location of a bottling plant outside of the city limits shall be subject to! it the same restrictions that govern milk houses on dairy farms. (b) Floors. The floors of all rooms in which milk is handled shall be smooth, impervious and graded to permit the quick removal of waste fluids to properly constaucted and trapped drains. (c) 'Valla and Ceilings. All walls and ceilings of rooms in which milk is exposed to the air shall be smoothly finished, kept in good repair, and frequently painted with a I � it paint of light color. (d) Doors and windows. All doors must be provided with self-closing devices. All doors and windows opening into the outer air shall be well lighted and ventilated. (e) Milk receiving room. A separate room shall be provided for receiving and dumping milk. (f) Cdaeh room. A separate room for washing, clean- 1 ing, and sterlizing receptacles shall be provided. (g) Bottle r?illing :doom. A. separate room for the filling and capping of bottles shall be provided. Cases of -23- washed bottles may be stored in this room. (h) Refrigerator. Cord. storage rooms shall be pro- vided with proper drainage, and cleaned as frequently as necessary to prevent bad odors. (i) Plumbing. All plumbing, connected with the milk plants, shall be installed in accordance with the city ordinance governing plumbing. Sewers, connected with such milk plant drains, shall be properly trapped and ventilated. (j) Boiler Room. All boiler and engine rooms shall be separated from milk handling rooms by tight partitions and self-closing doors. SECTION ZZ9X6. PRIVIES. Suitable toilet facilities ji skill' be provided for the use of employees, but no water- y closet shall communicate directly with any room used for ujhandling milk ormmilk products, or any room in which utensil are washed. Privies or earth closets shall be situated at least one hundred feet (100) from the milk plant and shall have fly-proofvaults. Seat covers shall be self closing. it SECTION 229X.7. MACHINERY ;HD E4UIPL'1ENT. (a) Con- struction of Ap paratus. All weigh cans, storage vats, mixing vats, and similar apparatus shall be of stationary construe- tion, all angles and joints being smoothly soldered. Vats u " shall be provided with closely fitting metal covers of simi- I lar construction. All pumps and pipes shall be of sanitary construction and so arranged that they can be easily taken apart for cleaning. The use of tightly soldered joints is prohibited. (b) Condemning pparatus. The Board of Health shall have power to, and it is hereby made their Butt to condemn and mark all cans, utensils, apparatus, or other vessels in which milk is handled, when same has become unfit for storage or handling of milk. (e) Piping. All milk piping shall be of the type known as 'Sanitary Milk Piping" in lengths short enough to be taken apart and cleaned with a brush. (d) Cooler. urface cooler, unless located in a room used only for cooling milk, shall be protected by suit- able metal or glass covers. (e) Bottling Machine. All bottles shall be capped by machinery approved by the Board of Health and the capping of bottles by hand is hereby prohibited. (f) Storage of Caps. Bottle caps before use shall be stored and kept in such a manner as to be p protected from Ii contamination until used. Caps shall be purchased and stored only in sanitary tubes. • (g) VWashing Facilities. Adequate facilities for the sterilization of all utensils and containers used in, the handling and storage of milk and milk products shall be pro- 1 v ided. (h) Racks or Can Dryers. Racks constructed of metal, shall be provided for the storage of washed and sterilized cans in an inverted position, unless dryers are used after the process of sterilization. Ci) Storage of lashed Bottles. All washed bottles shall be stored in an inverted position and protected from r contamination until filled. SECTION 229.18. $MOXING AND SPITTING PROHIBITED. Smoking and spitting is prohibited in any room used for the handling of milt or in any room in which milk utensils are stored. SECTION 22919. TASTING OP MINN,. Milk shall not be tested by taste in any bottling plant, milk house, other place, in any way that may render it liable to contamination. SECTION 229,110. RETURNED BOTTLES. No person shall place or permit to be placed in any bottle, vessel, utensils, or vehicles used in the production, sale or delivery of milk,. it any offal, swill, oil, garbage or other offensive material; Li nor shall any person place or permit to be placed in any milk or cream bottle any jelly, jam, catsup, chili sauce, pickles, or any preserved or prepared fruit or vegetable; nor shall any person return or permit to be returned any milk or cream bottle which is in an unclean or offensive condition. SECTION 229%11. BOTTLES TO BE RETURNED TO OWNERS. It shall be unlawful for any person to throw, place or deposit, or cause or permit to be thrown, placed or deposited any milk or cream bottle in any container used for the reception of garbage or rubbish; or to wilfully or maliciously break or destroy any such bottle; or to use or cause cr permit to be used any such bottle for any purpose other than a receptacle or container for milk or cream. All bottles or containers used for dispensing milk or crew or milk products shall be emptied within a reasonable length of time after being received and promptly returned to the owner thereof. No milk bottles recovered from any dumping place for ashes or refuse shall be returned to the owner or owners or shall be sold until they have first been washed and sterilized. SECTION 2291E12. SALT, OF MILK IN RESTAURANTS, SODA FOUNTAINS ETC. No person, firm or corporation shall serve any milk to be drunk on the premises where served, unless such milk is contained in individual sealed receptacles, contain- ing only the quantity of milk intended for use of the person served. SECTION 229X13. MI53RANDIING. Milk or milk products shall be deemed to be misbranded within the meaning of this ordinance, when the package, can, or bottle or other container containing same, or any cap, label, or tag attached thereto, shall bear any statement, design, mark or device regarding -26- I I the milk or milk products so contained in such package, can, bottle or other container, which is false or misleading in any particular; or when any milk or milk product shall be falsely branded or labeled or false representations are made 1 concerning same as to the place where, or breed or character of cows from which or the person by whom such milk or milk products were produced, obtained, handled or supplied. Any label, brand or device, or any oral or written or printed representation signifying or indicating that the milk or milk products in any bottle, can or container upon which label, brand or device appears or concerning which re- presentgtion is made, or in any dairy or milk plant, store or vehicle where such milk or milk product is sold, handled, had in possession, or delivered, or offered for delivery or for sale, has been certified, approved or recommended by any commission, organization or official, when in fact such milk or milk products has hot been so certified, approved or re- commended, shall be deemed and shall constitute a misbranding within the meaning of this ordinance. No person, firm or corporation shall within the limits of SaltmLake City sell or offer or expose for sale, or have in possession with intent to sell, any milk or milk products which is misbranded within the meaning of this ordi- nance. SECTION 229X14. REVOCATION, OI? PERMIT OR LICENSE. Any permit or license issued or required under the provisions of this Article may be suspended or revoked at any time by the Board of Commissioners upon the recommendation of the Health Commissioner for a violation of any of the provisions of this Article, or any other ordinance of Salt Lake City, or law of the State of Utah, or for any other reason the Board 1 of Commissioners deem right and proper, and such decision by the Board of Commissioners shall be final. Any such suspen -27- 11 ,n i 1 1' I i,1/41 .. sion shall be noted on the license, together with a statement of the reasons therefor and the period of suspension. A se- cond suspension for the same reason, or in any case a third suspension shall revoke the permit or license. No person whose permit or license has been revoked shall again be granted such license in the city except upon the presentation of reasons satisfactory to the Board of Commissioners. SECTIQN 229X15. Any person violating any of the 1 provisions of this chapter shall upon conviction thereof be punished by a fine in any sum not exceeding 299.00, or by imprisonment in the City Jail for a period not longer than Six months, or by both such fine and imprisonment.
