Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sec. 30-1-20, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to stolen property and the duties of the Chief of Police with regards thereto, be, and the same is hereby amended to read as follows: "Sec. 30-1-20. Lost, abandoned or unclaimed property. Duties of Chief of Police. (a) Definitions. Lost property is property the whereabouts of which is unknown to the owner; abandoned property is property found under such circumstances as reasonably indicates that the owner does not intend to possess it; and unclaimed property is property held by the Police Department for a period of three (3) months (other than in connection with a court proceeding) and is unclaimed within said period of time by the owner. "(b) It shall be the duty of the Chief of Police to keep all lost, abandoned or unclaimed property which comes into the possession of the Police Department or any of its members, and he shall make all reasonable efforts to discover the owner or owners thereof and restore said property to such person or persons. Whenever the owner of such lost, abandoned or unclaimed property is discovered and determined, if the said property is unclaimed by the owner after the expiration of fifteen (15) days from the date of mailing a written notice, describing such property, its present location and any other facts to properly identify it, to the last known address of the owner thereof, such property may be sold as hereinafter provided. In any event, the Chief of Police shall not be obligated to keep said property for a period of time exceeding three (3) months; and if the owner of such property shall not be found within the period of three months, the Chief of Police shall advertise for at least ten days in a newspaper of general circula- tion in Salt Lake City, the sale of such property, and may on the date specified in such advertisement, offer to the public at private or public sale all such property which has been in his possession for three months or more prior to such date, and may sell the same for the highest and best price obtainable. 40 4 a -2- "The Chief of Police shall make full report to the City Treasurer of the articles sold and the amount of money received by him for the same at any such sale, and the moneys received at such sale shall be covered into the city treasury." SECTION 2. In the opinion of the Board of Commissioners it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publi- cation. Passed by the Board of Commissioners of Salt Lake City, Utah, this 23rd day of March, 1966.
