41 of 1909 - Ordinance 41 of 1909 – Sewer Extension No. 185, First Partial Estimate. I AN ORDINANCE . An ordinance levying a tax and for the assessment of property Ijwithin the district bounded on the north by the north side of Fifth (South Street, on the west by Main (formerly East Temple) Street, on lthe south by the center line of Ninth South Street, and on the east Iby the west line of Sewer Extension No. 180, in Sewer District No: 2, for the construction of sewers. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and Ilprovide for the assessment of the same upon the property hereinafter described in Sewer District No. 2, for the construction of sewers, to-wit: In Lots 1 and 2, Block 3; 1, 2, 3 and 4, Block 2; 1, 4, 5 and 8, Block 1; 1 to 11, inclusive, Block 1; ixtsxioxissixsixs 18 to 25, 'inclusive, Block 3; 12 to 22, inclusive, Block 2, City Hall Subsivi- ' sion, Block 1, Plat "A"; 4 and 5, Block 7; 1 to 26, inclusive, Block 2; 1 to 52, inclusive, Block 1, Blair & Curtis Subdivision, Block 7, ,Plat "B", Salt Lake City Survey, abutting on the north side of Ninth South Street between Main and Fourth Fast Streets; on both sides of )Third East Street between Eighth South and Ninth South Streets; on the east side of Second East Street between Eighth South and Ninth South Streets; on the west side of Fourth East Street between Eighth South and Ninth South Streets; on both sides of Blair Street between Eighth South and Ninth South Streets. This tax is levied to defray the expense of constructing vitri- fied pipe sewers eight (8) inches in diameter upon the portions of said streets opposite the property hereinbefore and hereinafter des- eribed to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said prop- llerty will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage _ 41 -2- i *on said portions of said streets fronting upon and to a depth of lltwenty-five (25) feet back therefrom, and the tax hereby levied and lto be assessed upon said paroels of land is seven thousand two hundred forty-one and 99/100 ($7,241.99) dollars; five thousand two hundred seventy-one and 38/100 ($5,271.38) dollars, or one and j4,928,856/10,000,000 (41.4928856) dollars per front or linear foot of abutting property for sewer on side of street, there being 3,531 feet of abutting property within the boundaries of the lots, blocks and j,streets above mentioned in said district; and one thousand nine hun- ldred seventy and 61/100 ($1,970.61) dollars, or 7464428/10,000,000 d (00.7464428) dollars per front or linear foot of abutting property Ifor sewer on side of street, there being 2,640 feet of abutting prop- erty within the boundaries of the lots, blocks and streets above men- i tioned, [3 which is the total coat and cost per front foot of !Ii said sewers according to the contract entered into for the performance of said work and making said improvement, with James Kennedy, 8atsslx (dated the 4th day of May, 1908, and the Treasurer is hereby authorize. and directed to assess in accordance with the provisions of this ordi nance for the purpose herein mentioned: Sewer on Side of Street. The east stag 305 feet of the south side of Lot 2, the west 306 feet of the south side of Lot 1, Block 3; the east 140 feet of the (south side of Lot 4, the west 140 feet of the south side of Lot l,all lof the south side of Lots 2 and 3, Block 2; the west 272 feet of the jlsouth side of Lot 1, Blook 1; all of the south side of Lots 1 to 10, inclusive, Block 1, City Hall Subdivision, Block 1, Plat "A"; the eas 1140 feet of the south side of Lot 4, Block 7; the west 105 feet of the south side of Lot 1, Block 2; the east 111 feet of the south side Iof Lot 2, Block 1; the west 111 feet of the south side of Lot 1, Bloc II I 11, Blair S. Curtis Subdivision, Block 7, Plat "B"; the east side of Lots 1 and 8, Block 1; the east side of Lots 18 to 25, inclusive,/r -3- Block 3; the west side of Lot 11, Block 1; the west side of Lots 12 to 22, inclusive, Block 2, City Hall Subdivision, Block 1; the west side of Lot 5, the north 82.5 feet of the west side of Lot 4, Block il, Plat "A". The west side<:of Lot°s °and 5, Block 7; the east side of Lots 1 to 26; inclusive, albok 4 the west side ofLots 8' to 27, inclusive, and the east side of}eot .<., and 28 to 52, inclusiVe, Block 1, Blair Curtis Subdivis1on, Block 7, Plat "B", Salt Lae City Survey, as the same are showm.upon the official plats of Salt-take City to a ; depth of twenty-five (25) feet back from said stre$$ , and to collect s,a,.ict tax. SECTION 2. Said tax shall become and be delinquent in five equ 1 ; installments, as follows, to-wit: One-fifth thereof one year after the approval of the ordinance confirming the levy of the tat for the payment for such improvement; one-fifth thereof in two years after such approval; one-fifth thereof in three years after such approval; one -fifth thereof in four years after such approval; and one-fifth thereof in five years after such approval. One or more of said in- stallments, or the whole tax may be paid on or before ten days after the approval of the ordinance confirming the levy of the tax. One or more installments, or the whole special tax may be paid on the day .any installment becomes due by paying the amount thereof and interest to date of payment. Each of said installments shall bear interest at the rate of six (6) per cent per annum from the date of the approval of the ordinance confirming the levy of said tax until date of delin- quency, and eight (8) per cent per snnum from delinquency until paid.
