41 of 1911 - Ordinance 41 of 1911 – Paving Extension No. 67, Fourth & Final Estimate. AN ORDINANCE . An ordinance levying a tax and for the assessment of the property !hereinafter described on Second West Street from Third South Street tlio the Warm Springs, in Paving District No. 28, for the purpose of (providing for the grading, guttering and curbing, and paving thereof.. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and !provide for the assessment of the same upon the property hereinafter !described in Paving District No. 28, for the purpose of providing for (the grading, guttering and curbing, and paving of a portion of said disi�let, to-wit: In Lots 1, 6, 7 and 8, Block 79; 1, 6, 7 and 8, Block 97; 1 and 8, ';Block 102; 1, 6, 7 and 8, Block 116; 1 and 8, Block 120; 1, 6. 7 and 8, Block 133; 1 and 8. Block 138, all in Plat "A", Salt Lake City - !Survey. abutting on the west side of Seoond West Street between First. !South and Sixth North Streets. This tax is levied to defray the expense of grading, guttering Viand curbing with cement, and paving with asphalt (said asphalt pave- ment to be eighty (80) feet wide between curbs and nine and 1/2 (9-1/2) !inches thick between Third South and South Temple Streets, and sevsnt7- one (71) feet wide between curbs and nine and.1/2 (9-1/2) inches think ;between South Temple Street and the Warm Springs), the portions of (said Second West Street hereinbefore and hereinafter described to be !especially affected and benefited by said improvement, and it is !hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby 1levied, and said parcels of land are hereby assessed at an equal and :!uniform rate in a000rdanos with the linear foot frontage upon said !portions of said street fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed ;upon said parcels of land is forty-two thousand three hundred forty- 'five and 60/100 ($42,346.60) dollars; eight thousand six hundred !ninety-eight and 80/100 ($8,698.80) dollars, or thirteen and 18/100 -2- ($13.18) dollars per front or linear foot of abutting property for roadway 80 feet wide, there being 660 feet of abutting property within the bouMaries of the lots, blocks and street above mentioned im said. Idistriet; seven thousand six hundred nine and 80/100 ($7,609.80) ldollars, er eleven and 53/100 ($11.53) dollars per front or linear foot of abutting property for roadway 71 feet wide, there being 660 feet of abutting property within the boundaries of the lots, blocks and street above mentioned in said district; and twenty-six thousand thirty-seven ($86,037.00) dollars, or seven and 89/100 ($7.89) dollar% ;per front or linear foot of abutting property for roadway 71 feet wite, there being 3300 feet of abutting property within the boundariee of the lots, blocks and street above mentioned in said district, which is the total oast and sent per front foot of said pavement, acoording to the contract entered into for the performance of said work and ;making said improvement with P. J. Moran, dated the 8th day of Augustl, I1910, and the Treasurer is hereby authorized and directed to assess jis aoeordanoe with the previsions of this ordinance for the purpose 11herein mentioned: Nighty Foot Roadway. All of Lots 1, 6, 7 and 8, Block 79, Plat "A". Seventy..eme Feet Roadway. (Bet. Forth Temple and First North Streets.) All of Lots 1, 6, 7 and 8. Block 97, Plat "A". Seventy-one Foot Roadway. (Bet. First North and Sixth North Streets.) All of Lots 1 and 8, Block 102; all of Lots 1, 6, 7 and 8, Bleak. ',116; all of Lots 1 and 8, Block 120; all of Lots 1, 6, 7 and 8, Block 1133; all of Lots 1 and 8, Block 138, Plat "A", Salt Lake City Survey, as the same are shown upon the official plats of said city, to a depth of twenty-five (25) feet back from said street, and to collect said tax. SECTION 8. Said tax shall become and be delinquent in ten equal: i,yearly installments, with interest on the whole sum unpaid at the -3- Irate of six per sent per annum, payable at the time each installment is due, to»wit: One-tenth thereof one year after the approval of the, ' ordinance confirming the levy of the tax for the payment for such im provenent; one-tenth thereof in two years after suoh approval; one- =tenth thereof in three years after such approval; one-tenth thereof in four years after such approval; one-tenth thereof in five years 'after such approval; one-tenth thereof in six years after such appro-; val; one-tenth thereof in seven years after such approval; one-tenth ;thereof in eight years after such approval; oae-tenth thereof in nine= ,years after such approval; and one-tenth thereof in ten years after 'such approval. One or more of sail installments, in the order in !which they are payable, or the whole special tax may be paid at any time within thirty days after the approval of the ordinance confirm- ing the levy of the tax, without interest. In the event of any in- stallment or the interest aforesaid, not being paid on the date the II same becomes due, the whole amount of the special tax unpaid at the jtime said installment and interest are due, shall become due and pay able, and shall draw interest at the rate of eight per Dent per annm until the sale of the property eaaessed; provided, one or more install- ments, in the order in which they are payable, or the whole special !tam unpaid, may be paid on the day any installment becomes due, by jpa*in* the amount thereof and interest to said date.
