AN ORDINANCE AMENDING SECTIONS 103, 104, 105, 106, 107,
110, 113, 115, 116 and 120, Revised Ordinances of Salt Lake City,
1920, relating to sanitary inspection, and amending Chapter 5 of
the said Revised Ordinances of Salt Lake City, 1920, by adding in
and to said chapter three new sections to be known as Sections 122,
123 and 124.
Be it ordained by the Board of Commissioners of Salt
Lake City, Utah:
SECTION I, That Sections 103, 104,105,106, 107, 110,113,
115,116 and 120, Revised Ordinances of Salt Lake City, 1920, relat-
ing to sanitary inspection, be, and the same is hereby amended to
read as follows:
SECTION 103. DEFINITIONS. The term "garbage" as used in
this chapter shall be held to include and mean all animal and
vegetable refuse from kitchens of residence, hotels, cafes, re-
staurants and places where food is prepared for human consump-
tion, including all animal and vegetable refuse from such kit-
chens; provided,however, that such term does not include waste
from slaughter houses.
The term "market waste" as used in this chapter, shall in-
clude condemned or decayed or unsound vegetables, meat, fish
and fruit, and all waste and offal thereof from markets,
stores and f actories, and all vegetable waste and refuse from
such markets, stores and factories, provided,however, that
trade waste not specifically described in this definition
shall not be included in the term "market waste" nor in the
term "garbage", provided ft rher, that the term "market

waste* does not include waste from slaughter houses.
The term "stove ashes" as used in this chapter,
shall include the residue of material burned in stoves and
in furnaces in private residences, but not the residue from
furnaces in apartment houses, hotels, business horses, heat
ing or manufacturing plants. An apartment house is defined
to be a building comprising four or more suites designed
for separate housekeeping tenements with heat furnished in
common.
The term "trade waste" as used in this article,
shall include all discarded wooden boxes, barrels, broken
lumber, card board boxes, cartons, waste paper, leather, i
rubber, excelsior, cuttings, sweepings, rags and other in-
flammable waste materials and all discarded trade or manu-
facturing refuse from stores, factories or other places of
business which are not included within the definitions of
garbage, stove ashes and market waste.
SECTION 104. The Board of Commissioners may pro-
vide for the gathering, collecting and disposing of garbage
stove ashes and other refuse from the residences in the res -

dence section of Salt Lake City at public expense. The res -
dence section of Salt Lake City shall include all that part
of the city outside of the business district, which busines•
district is described as follows: Commencing at the south-
west corner of the: intersection of North Temple and State
Streets; thence west along the south side of North Temple
Street to the west side of West Temple Street; thence south
along the west side of West Temple Street to a point 10 rod
north of the north side of South Temple Street; thence west

to the east side of Third West Street; thence south to a
point 165 feet south of the south line of South Temple Street;
thence east to a point 165 feet west of the west line of Wet
Temple Street; thence south to a point 165 feet north of Ti st
South Street; thence west to the east side of First West

Street; thence south to a point 165 feet north of Second
South Street; thence west to the east side of Fifth West
Street; thence south to a point 165 feet south of the scout,
side of Second South Street; thence east to the east side
of Rio Grande Avenue; thence south to a point 165 feet
south of 'Third South Street; thence east to a point 165 fee
west from the west side of West Temple Street; thence south
to the south side of Fifth South Street; thence east to the
west side of Second East Street; thence north to the north
side of South Temple Street; thence west to the west side I
of State Street; thence north to the point of beginning.
SECTION 105. It shall be unlawful for any per-
son to haul or engage in the business of hauling garbage,
swill, manure, market waste, trade waste, night soil or
other refuse without first obtaining a license and paying
the license fee required by Section 1314.
It shall be unlawful for any person to make col-
lections of or haul or transport garbage, trade waste or
market waste in or from any part of the business district
of Salt Lake City as defined in this chapter, except betwe- '
the hours of eleven o'clock P. M. and six o'clock A. M. of
any day.
SECTION 106. It shall be unlawful for any person
to convey, transport or haul through or upon any of the
streets or alleys of Salt Lake City any garbage, swill,
manure, market waste, night soil, trade waste, or other
similar refuse, except in sanitary receptacles which shall
be strong, tight and covered so as to be inoffensive, and
especially constructed so that such materials may be trans-
ported without falling, leAki'1g or spilling; all such con-
veyances to have the approval of the Board of Health.
It shall be unlawful for any person to haul:.or
convey through the streets any garbage, paper in which gar-
bage is encased, swill, market waste, night soil or trade

waste, or similar refuse in any vehicle other than a vehi-
cle duly licensed and approved by the Board of Health and
having thereon the permit number as provided by ordinance.
f SECTION 107. It shall be unlawful for any per-
son to deposit or cause or permit to be deposited, or to
spill or permit to escape from any vehicle, garbage, mar-
ket waste, stove ashes, trade waste, or any other similar
refuse in or upon any street or alley in Salt Lake City;
or to deposit or cause or permit to be deposited any of
such materials upon any premises in said city without ex-
press permission from the Board of Health. The Board of
Health may give permit for the feeding of garbage or swill
upon premises properly equipped and maintained so as to
prevent the creation of a nuisance, orfer the depositing of
ashes and other dry material for filling purposes, or for
the burning of paper and other dry waste, at such places
as the Board of Health may designate and under such restric
tion as said. Board gray impose.
SECTION 110. It shall be unlawful for any person
other than a person duly licensed and holding a permit from
the Board of Health for such purpose to collect or convey
through the streets any garbage, paper in which garbage is
encased, market waste, swill, dead animals, night soil,
trade waste, or similar refuse, or to interfere in any man-
ner with any receptacle containing any such refuse, or to
remove any such receptacle from the location where same was
placed by the owner thereof, or to remove any of the con-
tents of such receptacles.

bage and refuse collection must be regularly hauled away an.
disposed of by the owners or occupants of the premises wher
on such garbage or refuse accumulates.
It shall be unlawful for any person to allow gar-

bage, stove ashes, market waste, trade waste, or other re-
fuse to accummulate upon his premises, or to fail to remove
same within twenty-foux hours after notification from the
Board of Health so to do.

SECTION 113. It shall be unlawful for any person
to sweep into or deposit any paper or other rubbish in any
gutter or diteh within the city limits, or to empty in Any
gutter or ditch any swill, house slops, contents of spit-
toons, or other filthy refuse.
It shall be unlawful for any person to throw or
deposit any dead animal or fowl, or any live animal or
fowl for purpose of drowning, in any reservoir, pool, canal., •
creek, or other stream or body of water within the city. 1
SECTION 115. It shall be unlawful for any person
to deposit, burn or bury any night soil in or on aany pre-
mises within the city limits. All night soil shall be dis-
posed of at the flushing station under directions of the
Board of Health.
SECTION 116. It shall be unlawful for any per-
son to burn garbage, market waste., or other offensive re-
fuse in the open air, or in any furnace or stove within the
city limits; provided, however, that trade waste and other
similar refuse may be burned at the city incinerating plant,
or other place designated by the Board of Health, All
trade waste not salvaged by the collector shall be inciner-
ated at the city incinerating plant or other place desig-
nated by the Board of Health,at the expense•of such collector.
SECTION 120. It shall be unlawful for any person
removing or engaged in the business of removing garbage,
trade waste, market waste, manure, night soil or other re-
fuse to fall to secure a permit from the Board of Health
for that purpose or to fail to have the word "scavenger"
and the number of his permit in large white letters on a
black background, plainly printed or attached to both sides

of the vehicle body; provided, however, that any vehicles
used by the city in maiming its collection shall have them
on the words, "Permit No. (giving number), Board of
Health;" the words "Board of Health" being in large letter-.
SECTION 2. That Chapter 5, Revised Ordinances of Salt
Lake City, 1920, be and the same is hereby amended by adding in
and to said Chapter three new Sections to be known as Sections
122, 123 and 124, which shall read as follows:
SECTION 122. It shall be unlawful for any persod
to deposit garbage or other wet refuse in wooden boxes,
barrels, or paste board cartons. All such receptacles wh,d
used as containers for garbage, or other wet refuse, shall
be considered refuse and removed by the garbage collector.
SECTION 123. All licensed collectors of garbage
or other f°efuse and city employes engaged in garbage and
refuse collection shall immediately, upon emptying recepta
ales, replace the cover thereon and set such receptacles i
upright position. All garbage collectors shall exercise
reasonable care in the handling of garbage and other refus:
and the receptacles containing the same.
SECTION 124. It shall be unlawful for any person
to wilfully break, deface, or injure any receptacle used t.
contain garbage or other refuse, or to do or permit anythi.g
to be done in connection with such retainers or the contents
thereof, which shall be offensive or filthy in relation to
any person, place, building-, premises or highway.
SECTION 3. Any person violating any provision of this
ordinance shall be punished as provided in Section 7, Revised
Ordinances of Salt Lake City, Il920.
SECTION 4. In the opinion of the Board of Commission- �
jers, it is necessary to the peace, health and safety of the in-
habitants of said city that this ordinance become effective im-
mediately.
SECTION 5. This ordinance shall take effect upon
