AN ORDINANCE AMENDING (TITLE 18 of the Revised Ordinances of Salt Lake City, Utah, 1955, entitled "HEALTH". by adding a new chapter to said title to be known as Chapter 8 of said title entitled "Children's Care Centers", providing for the regulation of the operation and maintenance of Children's Care Centers, requiring a license for the operation and maintenance of such centers, prescribing standards and requirements for Children!s Care Centers and for their operation and maintenance, specifying the responsibilities and functions of the Board of Health and Health Commissioner in connection with such facilities. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 18 of the Revised Ordinances of Salt Lake City, Utah, 1955, be, and the same hereby is, amended by adding thereto a new chapter to be known as Chapter 8 of said title, entitled "Children's Care Centers", to read as follows: "Sec. 18-8-1. CHILDREN'S CARE CENTERS DEFINED. A Children's Care Center, for the care of children, is hereby defined to be any building, structure, establishment or place which is used in whole or in part for the paid care, during the day or night, of two (2) or more children, who are not related by blood or marriage. "Sec. 18-8-2. LICENSE REQUIRED. It shall be unlawful for any person to conduct, operate, carry on or maintain a Children's Care Center, as herein defined, without first obtaining a license from the Salt Lake City License Assessor and Collector and a permit from the Salt Lake City Board of Health so to do. "Sec. 18-8-3. PROCEDURE TO OBTAIN LICENSE. Every person desiring to obtain a Children's Care Center license shall make an application therefor to the License Assessor and Collector of Salt Lake 4Q 108 .200 1.58 Q.P. City. The application shall include such information and data, under oath, respecting the Children's Care Center for which the license is requested as the Board of Health may prescribe, including a description of the center and service and a statement of the personnel and program that are to be used therefor. The application shall be accompanied by the sum of Ten Dollars ($10.00) license fee, which sum, if the license is granted, shall be paid to the City Treasurer, or be returned to the applicant if the application is denied. In addition said applicant shal.l pay to the said License Assessor and Collector the sum of One Dollar ($1.00) as an inspection fee. "Sec. 18-8-4. PERMIT. Upon receipt of such application the License Assessor and Collector shall refer the same to the Health Depart- ment, showing the receipt of the $1 .00 inspection fee above referred to, whereupon the Health Commission, or his authorized representative, shall make an inspection of the premises to be used as a Children's Care Center. If the premises are found to be in compliance with the City Ordinances and rules and regulations of the Health Department a permit may be issued by the Health Department to conduct such center. The Board of Health shall cause a copy of such permit to be filed with the License Assessor and Collector. No license shall be Issued without such copy of permit having been so filed. In the event the premises upon such inspection are found not in satisfactory compliance with the ordinances and the rules and regulations of the Health Department, no such permit shall be issued and no license shall be issued. "Sec. 18-8-5. SUSPENSION AND REVOCATION OF PERMIT. The permit referred to in Sec. 18-8-4 hereof may be suspended or revoked by the Health Commissioner upon the violation by the holder of any of the terms of this ordinance, whereupon the license issued shall automatically be suspended or revoked. Except as hereinafter provided, the suspension or revocation or said permit shall take effect thirty (30) days after written notice by the Health Commissioner to the permittee advising the latter of the contemplated suspension or revocation and setting forth the reasons for such.action. At any time before expiration of said 30 day period, permittee may request a hearing on said proposed suspension or revocation before the Board of City Commissioners, which Board shall rat t08 200 1.58 Q.P. -3- pass finally upon the matter of such suspension or revocation. The notice to the permittee, hereinabove referred to, shall advise him of the right to such hearing. When in the opinion of the Health Commis- sioner there exists an emergency which may endanger the public health or safety, the Health Commissioner is empowered to declare an emergency and immediately suspend any or all such permits as may be required, without a hearing or prior notice. The operation of any such Center without having in full force and effect a permit from the Health Department to operate shall be in violation of this ordinance and each day of operation without such permit being in full force and effect shall be construed as a separate violation and punishable as such. "Sec. 18-8-6. DURATION OF PERMIT AND LICENSE. Permit and license provided for in this ordinance shall expire at the end of one (1) year from date of issuance of the license, unless sooner revoked or su- rendered. Application for license and permit shall be made annually and payment of the fees above specified shall be made annually. "Sec. 18-8-7. NEW OR ALTERED FACILITIES. Applicants or licensees proposing to build new buildings or facilities for, or to make any major alterations of, a Children's Care Center shall submit plans and specifications for such buildings, facilities or alterations to the Health Department, and the same shall be built or made in compliance with the ordinances of Salt Lake City and the rules and regulations of the Health Department. "Sec. 18-8-8. INSPECTIONS. It shall be the duty of the Health Commissioner, or his authorized representative, to visit and inspect all Children4s Care Centers for the purpose of determining the sanitary conditions therein and to determine whether the same are being conducted in compliance with this ordinance and the rules and regulations of the Health Department. The findings of such inspections shall be recorded In duplicate by the person making the inspection, one copy of which will be conspicuously posted and maintained by the licensee on an inside wall of the establishment, and the other copy shall be filed with the Board of Health. For the purpose of determining the sanitary conditions of such centers the Health Commissioner, or his Rer 108 r 200 1-58 Q.P. -4- authorized representatives, shall use as a guide the following items: "Item 1. Administration. A qualified operator or a qualified assistant shall be present in Children►,s Care Centers whenever children are being cared for. "Item 2. Records. Each child shall be examined by a licensed medical doctor before beigg admitted to the Children!. Care Center. The parent shall provide 4he operator with a doctor's certificate showing the child to be free from communicable disease. There shall also be on file the up-to-date immunization record of the child as well as the name, address and phone number of the family doctor and the person to be notified in case of emergency. "Item 3. Floors. Floors shall be of easily cleanable construction, smooth and in good repair. "Item 4. Walls and Ceilings. Walls and ceilings shall be smooth, kept in good repair and cLean. "Item 5. DoorSand Windows. Outer windows and doors shall be effectively screened and outer doors shall be self closing. "Item 6. Toilet Facilities. Toilet facilities must comply with the plumbing code, be adequate and convenient, ventilated to outside, no direct openings to kitchen,,Af16MAYtiAfMAAAtAAWA i€A1§ 10411€14. Individual towels available for each child. "Item 7. Lightinq, Ventilation and Heating. Artificial or natural light shall be adequate, all rooms shall be properly ventilated and an adequate heating plant available in good working order. "Item 8. Safe Hot and Cold Water. Safe hot and cold water is to be available under pressure from an approved source. "Item 9. Sewage Disposal. Liquid wastes shall be disposed of in public sewers or as approved by the Board of Health. "Item 10. Construction of Utensils and Equipment. All utensils, dishes, glassware and cooking equipment of approved quality, easily cleanable and in good repair. "Item 11. All Utensils and Dishes. All utensils, dishes and similar equipment shall be washed by one of the following approved methods: (1) Washed, rinsed, and sterilized in a three (3) compartment sink, or properly washed and sterilized in 1700 F water for 2 minutes. "Item 12. Garbage. Garbage shall be stored in clean, washable approved containers. Surroundings kept clean, free from trash or garbage improperly stored. "Item 13. Food and Equipment Storage. Food should be properly stored above floor. All food from approved sources only. All perishable foods kept in a refrigerator at 503 F. All utensils and equipment stored so as to be protected from contamination of flies, rodents, dust, etc. "Item 14. State R-.u)ations. Bedding and clothing shall be clean and sanitized and laundry properly stored, not in food service area or in bed rooms. Safety rails or guards shall be placed wherever needed. Medicine shall be kept in locked cupboard. "Item 16. Miscellaneous.. Yard area shall be clean and free from trash and such hazards as fish ponds, swimming pools, etc. "Sec. 18-8-9. RULES AND REGULATIONS. The Health Department may make and enforce rules and regulations, not inconsistent with the provisions of this ordinance, governing the operation and maintenance of Children's Care Centers to cover the items set out in Sec. 18-8-8, and covering such other matters as shall be in the interest of public health and sanitation, and the enumeration of the items set out under Sec. 18-8-8 shall not be construed as a limitation upon the general powers and duties of the Health Commissioner in inspecting and regulating such Centers. "Sec. 18-8-10. RIGHT OF ENTRY. The Health Commissioner, or his authorized representative, shall have the right to enter all such centers at any reasonable time for the purpose of making necessary inspections and investigations. "Sec. 18-8-11. DUTY OF HEALTH COMMISSIONER. The Health Commissioner shall be charged with the duty of enforcing and administering the provisions of this ordinance." SECTION 2. In the opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance shall take effect immediately. SECTION 3. This ordinance shall take effect at once upon its first publication.
