AN ORDINANCE AMENDING Items 1, 2, 4, 5, 8, 12, 13 and 14 of Subsection
(e) of Section 18-4-4 and further amending such section by adding thereto a
new Subsection (k) relating to and regulating miscellaneous food handling
establishments used for the manufacture, packing, packaging, storage, sale,
processing or distribution of any food products.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
SECTION 1. That Items 1, 2, 4, 5, 8, 12, 13 and 14 of Subsection (e)
of Section 18-4-4, be, and the same hereby are, amended, and that Subsection
(k) of Section 18-4-4, be, and the same hereby is, enacted, to read as follows:
"Sec. 18-4-4. * * *
(e) * * *
"Item 1. Floors. The floors of all rooms in which food or
drink is stored, prepared or handled or in which utensils and
equipment are washed shall be kept clean, in good repair and the
intersections of floors and walls shall be impervious to water
and shall be provided with ample drainage.
"Item 2. Walls and ceilings. The walls and ceilings of all
rooms in which food, drink or food products are handled, prepared
or processed shall be of such material as to be readily cleanable,
smooth and impervious to moisture and light colored finish.
"* * *
"Item 4. Lighting. All rooms or places in which food,
drink or food products are prepared, processed, cooked, mixed,
baked, exposed, bottled, packed, packaged, handled, stored, manu-
factured, sold or offered for sale shall be properly and adequately
lighted so that all parts thereof may be readily inspected and to
facilitate cleaning operations. Any lighting that provides less
than fifteen (15) foot candles at working surfaces shall be deemed
inadequate.
"Item 5. Ventilation. All places in which food or drink is
prepared, cooked mixed, baked, bottled, packed, handled or manu-
factured shall be provided with ventilating hoods and ducts or with
other mechanical means to carry off into the outside air any steam
gases, odors, vapors, dust and excessive heat that may be generated
in the process of cooking, baking or processing so as to render the
same harmless to persons and products therein.

"Item 8. Lavatory facilities. Hand washing facilities con-
veniently located to the place of work shall be provided which
shall include hot and cold running water, soap and approved sani-
tary towels. The use of a common towel is prohibited. No employee
shall resume work after using the toilet, smoking, coughing, sneez-
ing or after contact with any substances which may contaminate or
adulterate food or food products without first washing his hands.

"Item 12. Disposal of wastes. All wastes shall be properly
disposed and all garbage and trash shall be kept in suitable con-
tainers or receptacles in such a manner as not to become a nuis-
ance or food and harborage for vermin, rodents and flies. All
plumbing shall comply with Salt Lake City and the state of Utah
plumbing code.
"Item 13. Refrigeration. All readily perishable foods and
drink except fruits and vegetables shall be kept at or below 45°F.
except when being prepared. For egg breaking operations refrigera-
tion facilities shall be available for cooling egg meats thoroughly
and quickly to preserve them and prevent deterioration during the
time the egg meats are being held. In any case where liquid eggs
are to be held more than eight (8) hours, provision shall be made
so that egg meat temperature is reduced to 40°F. or below within
thirty (30) minutes after breaking and is maintained at 40°F. or
below until drying or freezing. Waste water from refrigeration
equipment shall be disposed properly. Ice shall be handled and
stored in an approved manner.
"Item 14. Wholesomeness of food and drink. All food and
drink shall be clean, wholesome, free from spoilage, and so pre-
pared as to be safe for human consumption. No food or drink
shall be prepared in a private home. All materials that are
prepared or manufactured into food or drink products shall be
from approved sources. All food, drink, ingredients and food
products shall be clean, free from spoilage and in the case of
egg slurries, frozen whole eggs and similar products the same
shall be certified by the Utah state department of agriculture
to be free of salmonella or other pathogenic organisms, and shall
contain no eggs classified as incubator rejects or eggs from fowl
other than chickens. When eggs from ducks, turkeys, guinea or
geese are offered for sale they shall be processed separately
from chicken eggs and must be so labeled as to designate origin
of such eggs. Establishments such as bakeries, restaurants, and
other food establishments shall use eggs of no lesser agricultural
department standard than Grade "B" for the manufacture of such
items as cream pies, chocolate eclairs, french pastries, meringue,
salad dressing, hollandaise sauce or any other product in which
insufficient heat is to be applied to render same safe for human
consumption.

"(k) Plants which package eggs for resale or which manu-
facture egg products shall comply with the following conditions:
"A. General Conditions.

"(1) All shell eggs and egg products shall be subjected to
continuous inspection throughout each and every processing operation.
Any shell egg or egg product which is not processed in accordance
with this title or is not fit for human food shall be removed and
segregated prior to any further processing operation in connection
with the production of egg products.
"(2) Shell eggs or egg products which are not fit for human
food shall be placed in a conspicuously marked container which con-
tains a denaturant of such character as will prevent such products
from being used as human food or in the case of shell eggs they
shall be treated in such a manner as to preclude their use as human
food.
"(3) Eggs containing diffused blood in the albumen or on the
yolk shall not be used in the preparation of egg products and such
eggs shall be destroyed.
"(4) Each person who is to handle any exposed or unpackaged
egg products shall wash his hands immediately prior to handling
any such products or any utennsils which contain, or are to contain
such products, and shall maintain clean hands while handling any
exposed or unpacked egg products.
"(5) No other ,product or material shall be processed, stored
or handled in any room, compartment or place where any shell eggs
or egg products are processed, stored or handled, except as may be
approved by the health authority. The freezer room may contain
other frozen products which do not create an objectionable condi-
tion or odor.
"(6) All utensils and equipment which are contaminated during
the course of processing any shell eggs or egg products shall be
removed from use immediately and shall not be used again until
cleaned and sanitized.
"(7) Any ingredient added in the processing of any egg
product shall be clean and fit for human food.
"0) Packages or containers for egg products shall be clean
when being filled with any egg products and all precautions shall
be taken to avoid soiling or contaminating the surface of any
package or container liner which is or will be in direct contact
with such egg products. Frozen or liquid egg containers shall be
of new material and shall not be re-used.
"(9) Egg meat shall be processed in such manner as to insure
the removal of spots, shell particles and foreign materials.
"(10) All utensils and equipment shall be sanitized at the
start of each day's processing operations. All utensils and equip-
ment shall be kept clean and sanitary during all processing
operations.
"B. Labeling. All egg and egg product containers shall bear
a label or shall be stamped on the body of the container with (1)
the name and place of business of the manufacturer, packer or
processor (2) an accurate statement of the quantity of the contents

in terms of weight or measure 'tt'3) an accurate statement as to the
description of the contents (4) a code or date for identification
of each lot. This code or date identifies the contents with a
specific date, run or batch of the product. The time period
during which each code lot is packed should be as short as
practicable but in no case longer than one day.
"C. Operations and Quality.
"(1) All eggs from ducks, turkeys, guinea and geese shall be
segregated and if processed they shall be processed separately and
each container of such product shall be conspicuously marked and
identified.
"(2) Shell eggs shall be sorted and classified as edible,
inedible,eggs from other than chickens, or loss, in a manner set
forth in Utah state department of agriculture standard.
"(a) All loss or inedible eggs shall be placed in a designated
container and handled as set forth in A-2 of this subsection (k) .
For the purpose of this ordinance inedible and loss eggs are defined
to include black rot, white rots, mixed rots, green whites, eggs
with diffused blood in albumen or on yolk, crusted yolks, stuck
yolks, developed embryos, at or beyond the blood ring stage, moldy
eggs, sour or musty eggs and any other filthy and decomposed eggs
including the following:
"(1) Any egg with visible foreign matter other than removable
blood and meat spots in the egg meat.
"(2) Any egg with any portion of the shell membrane missing,
ruptured, broken or which has a portion of the shell in excess of
pinch square missing even though shell membrane is intact.
"(3) Any egg with conditions which make washing or cleaning
such as to not completely remove all adhering dirt or other material
from the shell of the egg prior to the breaking operation.
"(4) Any egg with conditions which make washing or breaking
without contaminating the contents impossible.
"(5) Any eggs that are adulterated as defined in this title.
"(b) Edible eggs include all eggs which are fit for human
food and which are not defined as inedible or loss. Edible eggs
include eggs from which blood spots have been removed.
"(c) Incubator reject eggs, `incubator clears' and ova from
slaughtered birds of any species shall not be brought into any egg
or egg products plant for any purpose whatsoever.
SECTION 2. In the opinion of the Board of Commissioners of Salt
Lake City it is necessary to the peace, health and safety of the inhabitants
of Salt Lake City that this ordinance become effective immediately.

SECTION 3. This ordinance shall take effect upon its first
publication.
Passed by the Board of Commissioners of Salt Lake City, Utah, this
7th day of July, 1964.
