46 of 1905 - Ordinance 46 of 1905 – Franchise to O.S.L.R.R. Company to cross certain streets and alleys of the AN ORDINANCE. AN ORDINANCE GRANTING PERMISSION TO THE OREGON SHORT LINE RAILROAD COMPANY, ITS SUCCESSORS AND ASSIGNS, TO CROSS CERTAIN STREETS AND ALLEYS DP THE C1TY OP SALT LAKE. WHEREAS, the Oregon Short Line Railroad Company proposes to construct a line of single track railroad from a point on its railroad as now maintained and operated on Third West Street between Eighth South and Ninth South Streets in the city of Salt Lake, thence southwesterly on a curve to the right, passing through Lot One (1) in Block Eight (8) Plat "A" and across Ninth South Street into Lot Eleven (11), Block One (1), and through Block Two (2), Geneva Addition, thence westerly to and across the Jordan River, as indi- cated by the line shown in yellow upon the map or blue print hereto attached, marked"Exhibit A", hereby referred to and made a part of this ordinance; and WHEREAS, the said Oregon Short Line Railroad Company has purchased or is intending to acquire the lands abutting on both sides of its proposed line as shown on the map herewith presented; and the line of railroad to be constructed herein described is for the purpose of giving access to the trains of the San Pedro, Los Angeles & Salt Like Railroad Company to the new passenger terminals to be constructed between Third and Fourth West Streets at the intersection of South Temple street; NOW THEREFORE, in consideration of the premises, be it ordained by the City Council of the City of Salt Lake, State of Utah, as follows: SECTION I. That the said Oregon Short Line Railroad Company, its lessees, successors and assigns, have the authority and consent of the said City Council, and permission is hereby granted to cross at grade with its necessary tracks in carrying out the construction and operation of the tracks herein referred to substantially as 46 -2- shown by the map herewith presented, the following streets, towit: 1st. The west half of Third West street between Eighth South and Ninth South streets; 2nd. Ninth South street between Third West and Fourth West streets; 3rd. Goodhue Avenue; 4th. Fourth West street; 5th. Woodbine Avenue in Fountain Place Sub-division; 6th. Fifth West street; 7th. Sixth West street; 8th. Seventh West street; 9th. Eighth West street; SECTION 2. The rights, privileges and franchises hereby granted and confirmed are for the term of one hundred years from and after the passage of this ordinance, and are granted upon the following conditions, viz: (1) That all of said railway tracks shall be laid upon and over and conform to the established grade of the several streets,upon which they may be laid, and if such grade is afterward changed by order of the City Council, the said grantee shall at its own expense change the said track so as to conform to the same. (2) The said grantee shall, wherever the said tracks are crossed by streets and alleys, make and maintain such, reasonable crossings as shall enable the traveling public to cross over the rails of such track and shall make and maintain such other crossings of said track as shall from time to time be required by the City Council. (3) The said grantee, its lessees, successors and assigns shall lay and maintain sufficient'boxes or pipes to convey all the water required to :flow along the said streets crossed by said rail- way tracks, the same to be of such dimensions as will permit the -3— free passage of all water ordinarily flowinF in or along such streets, and said grantee, its lessees, successors and assigns shall during the life of this franchise maintain and Xeep said boxes or pipes in repair.
