AN ORDINANCE GRANTING THE SIGHT TO TUE SALT LAKE & OGDEN RAIL':IAY COMPANY TO USE A PORTION OF FIRST WEST STREET IN SALT LAKE CITY, UTAH, FOR TIT PURPOSE OF LAYING AND OPERATING RAILROAD TRACKS. * * * * * * BE IT ORDAINED BY THE BOARD OF COMiMISSIONERS, OF SALT LAKE CITY, UTNH: Section 1. That the Salt Lake & Ogden Railway Company, a corpor- ation, its successors and assigns, be, and they are, hereby granted the right and privilege of constructing, maintaining and operating a double track aye from the tracks to be built by said Company in said First West Street to the east property line of said First West Street, distant about one hundred fifty feet south of the south side of Socond South Street, and extending into and upon the private property of the said Salt Lake & Ogden Railway Company on the east side of said First West Street. Section 2. Said Railway Company, its successors or assigns, are hereby. 4-a44.ted tie right and privilege to operate said double track railway eye, when constructed, by electric power, compressed air, but shall not be permitted to use steam for the operation of cars on said tracks. Said tracks shall be built by said Company, its successors or assigns, by and under the direction and supervision of the City Engineer of Salt Lake City, and the work of construction shall in good faith be begun within ninety days from the passage hereof. Section 3. That said tracks shall he laid so as to conform to the grade of said street at this, time, and said Salt Lake & Ogden Rail- way Company, its successors or assigns, shall alter the same so as to conform to such obain e of grade as the Board of Commissioners of Salt Lake City shall, from time to time, make. Section 4. Said Company, its successors or assigns, shall leave no material in said street, and shall leave the street, upon completion of said tracks, in as good condition for travel by teams, vehicles and pedestrians as it is at the present time. Section 5. The right to construct and operate said aye shall be subject to all of the conditions of the franchises heretofore granted f; Salt Lake City to the Salt Lake & Ogden Railway Company for the con- struction of tracks in the streets of Salt Lake City. Section G. This franchise shall extend until the first day of July, 1955. Section 7. The Grantee shall file with the City Engineer,before actual work of construction under this ordinance, a blue print showing the exact location and character of construction of the ayes authorized to be constructed hereunder. Section 8. Said Grantee shall, within sixty days after the passage mf this ordinance, file an acceptance hereof, in writing, with the Recorder of Salt Lake City, otherwise the same shall be nmll and void.
