Romney Tedesco Mr. Chairman . . -- / /AN ORDINANCE Result i AN ORDINANCE LEVYING A TAX and for the assessment of pro- perty in Lighting District .No. 8-D, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Lighting District No. 8-D, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor, to-wit: Lots 1, 2, 3 and 4 of Blk. 52, and Lots 5 and 6 of Bik. 39, Plat HAI', Salt Lake City Survey, abutting on both sides of Fourth South Street from Main Street to State Street in Salt Lake City. This tax is levied to defray the expense of providing for the operation, maintenance and patrolling of arc lamps and furnish- ing with electrical energy fourteen ornamental standards, each equipped with two 6.6 ampere luminous arc lamps (said lamps to be twenty-eight (28) in number), twenty-four lamps to operate on thelf; midnight schedule (1 A.M. war daylight savings time) and to be sup- plied with electric current for the illumination of the same each night from fifteen minutes before dark until midnight (1 A.M. war daylight savings time), and the remaining four lamps to operate on the all-might schedule (the cost of operation of the all night lamps being Two Thousand, Four Hundred Forty-eight and 00/100 ($2,448.00) Dollars and same to be paid for by the city), for a period of ten -2- years from October 5, 1944, to October 5, 1954, said lamps to be illuminated by electric currents the circuits for the operation of said. system of lamps to be underground, and the portions of said streets opposite the property hereinbefore and hereinafter describ ea to be especially affecteu and benefited by said improvement, and it is hereby adjudged, determined and established that said pr.- perty will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assesse at an equal anu uniform rate in accordance with the linear foot frontage upon and to the entire depth of the same ev:nership back therefrom not exceeding 330 feet, and the tax hereby levied and to be assessed upon said parcels of sand is Eleven Thousand, Seven H dred Fifty and 40/100 (t11,750.40)doliars or Nine and b53r35j103000i 49.653235) Dollars per front or linear foot of abutting property . there being 1,217.25 feet abutting said portion of said istprovemen' and the cost of which operation, maintenance, patrolling and fur- nishing of electric energy and the property benefited thereby is hereinafter set out, and air within the bounuaries of the iots, blocks and streets above mentioned in said district, which is the total abutters+ cost and cost per front foot of said improvement accorning to the contract entered into for the performance of said work and making said improvement with Utah Pov,er & Light Company, dated the 5th day of October, i944, said levy to date and be ef- fective from October 5, 1944, which is the date service began, and the City Treasurer is hereby authorized and directed to assess in ' accordance with the provisions o_ this ordinance, for the purpose ,r� herein mentioned; FRONTING ON THE NORTH SIDE OF 4TH SOUTH S'Th)-UNIT. SECTION II. that the assessment list made by the City Treasurer, as corrected, approvea and completed by the hoard of Equalization and heview of the property describes in Section I of this ordinance in Lighting District So. a-h of Salt Lake City for the purpose of providing for the operation, maintenance and patrol,- ling of arc lamps and furnishing with electrical energy, is hereby confirmed, and the assessments made and returned in said completed lists and the report of the Board of equalization and heview to the Loam of Co,muissioners of halt Lake City are hereby ratified, ap- proved and confirmed. SECTION III. Said tax shall be payable in ten equal yearl installments, with interest on any delinquent installment unpaid at the rate of ten per cent per annum, which interest shall be charged from and after the due date of each installment, to-wit: one-tenth hereof fifteen days after the ordinance levying the tax for the payment of the improvement becomes effective; one-tenth thereof in .ne year thereafter; one-tenth thereof in two years thereafter; onei- enth thereof in three years thereafter; one-tenth thereof in four ears thereafter; one-tenth thereof in five years thereafter; one- 'enth thereof in six years thereafter; one-tenth thereof in seven ears thereafter; one-tenth thereof in eight years thereafter; one- oath thereof in nine years thereafter; provided, however, that one r more of such installments in the order payable, or the whole tax, lay be paid without interest within fifteen (15) days from the date -his ordinance becomes effective. , 1t Default in the payment of any such installment of princi- sal when one shall cause the whole of the unpaid principal to becom . ,,?, ue and payable immediately, and the whole amount of the unpaid prir- ripal shall thereafter draw interest at the rate of ten per cent pet nnum until paid, but at any time prior to the date of sale or fore Iiosur•e the owner may pay the amount of all unpaid. installments pass 'tie, with interest at the rate or ten per cent per annum to date of -4- payment on the delinquent installments, and all accrued costs, and shall thereupon be restored to the right thereafter to pay in instli- ments in the same manner as if default naa not occurred.
