A franchise and right of way is hereby given and granted to The Pio Grande Western Railway Company, its successors and assigns, to lay, construct and operate a switch or spur standard gauge railroad track leading from a convenient point on its railwayline on F 'West test Street between Third and Fourth South Streets in Salt Lake City, Utah, about eight I rods north of the north side of Fourth South Street, and running thence northerly and easterly across Fifth West Street to and on Lot 5, Block 46, Plat "A," Salt Lake City Survey, jstriking said lot at a point about ten rods south of the northwest corner thereof; also an additional switch or spur standard gauge railroad track leading from a convenient point on the aforesaid spur, about twenty rods north of the north side of Fourth South Street, and running thence northerly jl. and easterly across Fifth Test Street on a curve to and on Lots 5 and 6, of the aforesaid Block, striking said Lot 5 at a point about seven rods north of the southwest corner thereof. - ,I Section 2. During the term of this franchise the grantee I shall be subject to the following_ conditions, viz: it (a) That said switches or spur tracks shall be laid upon and conform to the established grade of said street, and if said: grade is afterward changed by order of the City Council the I I grantee shall at its own ex-pense change the elevation of the it tracks so as to conform to the same. '' 4`7 I -2- 1 II (b) Whenever said Fourth West Street between Fifth and Sixth South Streets shall be paved, then said grantee, its jsuccessors and assigns, shall pave between the rails and for li a space of two feet outside of each rail with the same material as that used in the street pavement. II (c) Said grantee shall put in and maintain such crossings lover said switches or spur tracks as shall from time to time be required by the City Council. (d) The said switches or spur tracks shall be laid, and the road operated, so as to cause no unnecessary impediment I to the common and ordinary use of said street upon which it is laid. i (e) Good and sufficient boxes to convey water shall be laid and maintained in good condition at the expense of said 1 1 grantee in all the water ditches crossed by the said switches or spur tracks, so as to admit of free passage of water. 1 Section 3. Nothing in this grant shall be so construed 1 as to prevent Salt Lake City or its authorized agents from paving, sewering, laying gas or water main� ipes, altering, repairing or in any manner improving said West Street, but all such improvements shall be made with as little injury I as practicable to said spur tracks and the operation thereof. c 'on 4. This grant and all the terms and conditions thereof shall be accepted in writing by the grantee herein (within thirty days from the approval of this ordinance, other- wise the same shall be void and of no effect.
