AN ORDINANCE AMENDING Sections 15-14-27, 15-14-28, 15-14-29, 15-14-30 and 15-14-31, of the Revised Ordinances of. Salt Lake City, Utah, 1965, relating to flammable liquids--service stations, and adding thereto seven (7) new sections to be known as Sections 15-14-32, 15-14-33, 15-14-34, 15-14-35, 15-14-36, 15-14-37 and 15-14-38, to permit and regulate self service stations dispensing Class I flammables. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 15-14-27, 15-14-28, 15-14-29, 15-14-30 and 15-14-31 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to flammable liquids--service stations, be, and the same hereby are, amended to read as follows: "Sec. 15-14-27. Automatic dispensing units. The installation and use of unattended coin operated self service dispensing devices or any other unattended and unsupervised self-service dispensing devices for Class 1 liquids is prohibited. "Sec. 15-14-28. Control of delivery nozzle. Hose nozzle valves of either the manual or automatic-closing type for dispensing Class 1 liquids into a fuel tank or into a container shall be held manually open during the dispensing operation from any service station dis- penser accessible to the public. A listed automatic-closing type nozzle withetat a latch-open device is permitted only when all dispensing of Class 1 liquids is to be done by the service station attendant. "Sec. 15-14-29. Latch-open device not permitted at self-service. If the dispensing of Class 1 liquids at a service station available and open to the public is to be done by a person other than the service station attendant, the nozzle shall be a listed automatic- closing type without a latch-open device. "Sec. 15-14-30. Remote control dispensing. Where self-service dispensing units are in operation they shall be controlled from a remote station, a control room so located that the operator will at all times have a clear and unobstructed view of all dispensing islands shall be provided. The use of indirect reflections or other mechanical devices may not be employed to accomplish such view. "Sec. 15-14-31. Two way communication system. Where dispensing units are controlled from a remote station, a two way communication system of the public address type shall be provided to facilitate direct and individual communication between the control room and each dispensing island." 47 -2- SECTION 2. That Chapter 14 of Title 15, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to flammable liquids--service stations, is hereby amended by adding thereto seven (7) new sections to be known as Sections 15-14-32, 15-14-33, 15-14-34, 15-14-35, 15-14-36 15-14-37 and 15-14-38, to permit and regulate self service stations dispensing Class 1 flammable liquids, to read as follows: "Sec. 15-14-32. Attendant on duty at all times. There shall be one or more attendants on duty at all times when the station is open to the public, whose primary function while the self- servicing gasoline dispensing equipment is in use is to supervise the dispensing of Class 1 liquids by the self-service customer. At all times that Class 1 liquids are being dispensed, the attendant shall remain within the confines of the control room wherein the remote control device is located and within arm's length of such device, together with maintaining appropriate and adequate aobservation and control of dispensing activities. Upon leaving the control room he shallshut off all dispensing devices under his supervision. "Sec. 15-14-33. Operation of equipment by attendant. All attendants shall be thoroughly instructed in the operation of the public address system, the fire extinguishing apparatus, the operation of the dispensing units and safety regulations for the dispensing of Class I liquids. Instructions for operations of dispensing devices shall be conspicuously posted near each dis- pensing device. The dispensing unit shall be shut off when patrons do not follow instructions. The operator shall refuse service to any customer who is smoking, or who appears for any reason to be unable or incompetent to operate the self-servicing equipment or who is attempting to fill any container that is not authorized by these ordinances for the transporting or storing Class I liquids. "Sec. 15-14-34. Automatic locking devices. All dispensing devices for Class I liquids shall be provided with an automatic locking device which prevents the reuse of the unit after the hose has been replaced until the units have been manually unlocked. A computing pump that automatically prevents reuse until a reset device is operated remotely may be approved as complying with the provisions of this section. "Sec. 15-14-35. Locking dispensing units. Each dispensing device for Class I liquids at a self service remote controlled dis- pensing station shall be kept locked or otherwise maintained inoperable at all times that the station is unattended. "Sec. 15-14-36. Smoking prohibited during fueling. There shall be no smoking on the driveway of service stations in the areasused for fueling motor vehicles, dispensing flammable anti-freeze or the receipt of flammable liquids by tank vehicle. Conspicuous signs prohibiting smoking shall be posted within the sight of the customer being served, with letters at least four inches high. "Sec. 15-14-37. Engines to be off during fueling. The engines of all vehicles being fueled shall be shut off during the fueling operation. 4 -3- "Sec. 15-14-38. Fire control devices. Suitable fire control devices, such as portable fire extinguishers, shall be available to locations where fires are likely to occur.
