Keyser / ;� ,4 Knight V �� Lee Mr. Chairman - - L / A ORDINANCE Result AN ORDINANCE LEVYING A TAX and for the assessment of pro- perty in Lighting District No. 9-B, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter deircribed in Lighting District No. 9-B, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor, to-wit: Lots 5 and 6 of Blk. 69, Lots 5, 6, 7 and 8 of Blk. 70, Lots 1 and 2 of Blk. 75 and Lots 1, 2, 3 and 4 of Blk. 76, Plat nA'1, Salt Lake City Survey, abutting on both sides of First South Street from West Temple Street to State Street in Salt Lake City. This tax is levied to defray the expense of providing for the operation, maintenance and patrolling of arc lamps and furnish- ing with electrical energy twenty-eight ornamental standards, each equipped with three 6.6 ampere luminous arc lamps (said arc lamps to be eighty-four (84) in number), seventy-six lamps to operate on the midnight schedule and to be supplied with electric current for the illumination of the same each night from fifteen minutes before dark until midnight and the remaining eight lamps to operate on the all-night schedule (the cost of operation of the all-night lamps being Six Thousand Five Hundred Fifty-three and 04/100 ($6,553,04) Dollars and same to be paid for by the city), for a period of ten years from SeptemV 16, 1935, to September 16,1945, 1 ! -2- said lamps to be illuminated by electric current; the circuits for the operation of said system of lamps to be underground, and the portions of said streets opposite the property hereinbefore and Thereinafter described to be especially affected and benefited by I1said improvement, and it is hereby adjudged, determined and estab- lished that said property will be especially benefited thereby to 1 1! the full amount of the tax hereby levied, and said parcels of land `;fare hereby assessed at an equal and uniform rate in accordance wit' I� ; the linear foot frontage upon and to the entire depth of the same 0 ownership back therefrom not exceeding 330 feet, and the tax hereb Illevied and to be assessed upon said parcels of land is Forty ' Thousand Forty-five and 69/100 ($40,045.69) Dollars or Sixteen and i' 029625/1000000 ($16.029625) Dollars per front or linear foot of abutting property, there being 2498.23 feet abutting said portion Iof said improvement and the cost of which operation, maintenance, patrolling and furnishing of electrical energy and the property Ilbenefited thereby is hereinafter set out and all within the bounda-t fries of the lots, blocks and streets above mentioned in said dis- trict, which is the total abutterst cost and cost per front foot 1 of said improvement according to the contract entered into for the IIperformance of said work and making said improvement with Utah Powr Rc Light Company, dated the 16th day of September, 1935, said levy ';to date and be effective from September 16, 1935, which is the datizi ( service began, and the City Treasurer is hereby authorized and di- � t I rected to assess in accordance with the provisions of this ordinance, for the purpose herein mentioned: FRONTING ON FIRST SOUTH STREET. On the south side: All of Lots 5 and 6, Blk. 69; all of Lots 5, 7 and 8, and the west 112.0 ft. and the east 2.23 ft. of (Lot 6, of Blk. 70; Plat "A", Salt Lake City Survey. On the north side: All of Lot 2 and the east 305.0 ft. of Lot 1, Blk. 75; all of Lots 1, 3 and 4 and the east 99 ft. of (Lot 2, Blk. 76; Plat "A", Salt Lake City Survey; as the same are (shown upon the official plats of said city to the entire depth of the same ownership back from said street and to collect said tax. -3- SECTION!I i II. That the assessment list made by the City Treasurer, as corrected, approved and completed by the Board of Equalization and neview of the property described in Section I of this ordinance in Lighting District No. 9-B of Salt Lake City for the purpose of providing for the operation, maintenance and patrol- filling of arc lamps and furnishing with electrical energy, is hereby Iconfirmed and the assessments made and returned in said completed 'lists and the report of the Board of Equalization and Review to !the Board of Commissioners of Salt Lake @ity are hereby ratified, approved and confirmed. SECTION III. Said tax shall be payable in advance in ten equal yearly installments, as provided by law and ordinance with interest on the whole sum unpaid at 7 per cent per annum until due Viand thereafter at the rate of ten per cent (10%) per annum until paid; provided, however, that one or more of such installments in the order payable, or the whole tax may be paid without interest within fifteeh (15) days from the date this ordinance becomes ef- fective, and any such payments within said fifteen (15),days will be allowed also a discount of three per cent (3%). One or more installments in the order in which they are payable, or the whole special tax, may be paid after said fifteen days and before the first installment becomes due by paying the same with interest fro4 the date of levy to the date such first installment is due. One or more installments in the order in which they are made payable, or the whole special tax, may be paid on the day any installment becomes due by paying the amount thereof and interest to the date of payment. In the event any installment aforesaid is not paid on the day the same becomes due, the whole amount of the special tax unpaid at the time said installment is due shall become due and payable and shall draw interest at the rate of ten per cent (10%) per annum until paid.
