WHEREAS, by an ordinance duly passed by the Board of City Commissioners of Salt Lake City, Utah, on the 8th day of November, 1932, entitled: "AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF SEVEN HUNDRED THOUSAND DOLLARS ($700,000.00) REFUNDING BONDS OF SALT LAKE CITY, UTAH, SERIES OF NOVEMBER 1, 1932," there was authorized the issuance of Refunding Bonds of Salt Lake City, Utah, in the amount of Seven Hundred- Thousand Dollars ($5700,000.00), dated November 1, 1932, bearing interest at the rote of four and one-quarter ner cent (4b%) per annum, payable semi-annually on January 1 and July 1 in each year, couunencing July 1, 1933, the fa-rat coupon attached to said bonds providing for the payment of interest due from November 1, 1932, the date thereof, to Ju3' 1, 1933, said bonds being in denominations of One Thousand Dollars (1,000.00) each, numbered from one (1) to seven hundred (700), both inclusive, ,ayable serially in numerical order Seventy Thousand Dollars ( 7o,on0.00) on v�. January 1 in each of the years 1934 to 1943, both inclusive, and WHEREAS, all of said bonds were duly and lawfully issued and sold and bonds in the amount of Two Hundred Ten Thousand Dollars ($210,000.00), being bonds numbers one (1) to two hundred ten (210), both inclusive, have heretofore matured and have been paid, end bonds numbers two hundred eleven 4c2 (211) to seven hundred (700), both inclusive, are now outstanding and are legal and valid and binding obligations of Salt Lake City, Utah, on which the interest has promptly been paid at maturity, and none of said bonds has ever been adjudicated to be invalid and there is no litigation sending or threatened involving the validity of said bonds or any of them. WHEREAS, bonds numbers two hundred eleven (211) to two hundred eighty (280), both inclusive, in the amount of Seventy Thousand Dollars ($70,000.00) are due and payable January 1, 1937, but due to the necessity of meeting other obligations and to the fact that the final date for the - 9 - payment of taxes for the current year has been extended by the County Commissioners of Salt Lake County from November 30 to December 20, 1936, funds for the payment of said Seventy Thousand Dollars ($70,000.00) bonds will not be available for the payment thereof on January 1, 1937, there being no money in the sinking fund of said City available for the payment ) of said bonds, although funds will be available for the payment of the interest due on January 1, 1937. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF CITY COMMISSIONERS OF SALT LAKE CITY, UTAH: Section 1. That for the purpose of paying and redeeming Seventy Thousand Dollars ($70,000.00) Salt Lake City Refunding Bonds, Series of November 1, 1932, dated November 1, 1932, and due and payable January 1, 1937, numbered from two hundred eleven (211) to two hundred eighty (280), both inclusive, in denomination of One Thousand Dollars ($1,000.00) each, there shall be issued Refunding Bonds of Salt Lake City in the amount of Seventy Thousand Dollars ($70,000.00), to be dated January 1, 1937, bearing interest at the rate of two and one-half per centum (2 ) per annum, payable semi-annually on January 1 and July 1 in each year, commencing July 1, 1937, in denomination of One Thousand Dollars ($1,000.00) each, numbered from one (1) to seventy (70), both inclusive, due and payable January 1, 1944, and known as "Salt Lake City Refunding Bonds, Series of January 1, 1937." Said bonds and each of them shall be in substantially the following form, to-wit: — 3 — UNITED STATES OF AMERICA STATE OF UTAH SALT LAKE COUNTY SALT LAKE CITY REFUNDING BOND SERIES OF JANUARY 1,1937 No. _ $1,000.00 KNOW ALL MEN BY THESE PRESENTS: That Salt Lake City, in Salt Lake County, State of Utah, hereby acknowledges itself to be indebted, and for value received hereby promises to pay to the bearer hereof the sum of ONE THOUSAND DOLLARS ($1,000.00) in lawful money of the United States of America, on the first day of January, A. D., 1944, at The National City Bank of New York, in New York City, New York, with interest thereon at the rate of two and one—half per centum (2t1) per annum from date until paid, payable semi—annually in like money on January 1 and July 1 in each year, commencing July 1, 1937, said interest to maturity being represented by interest coupons hereto attached. This bond is issued for the purpose of refunding legal and valid outstanding bonded indebtedness of said City and is one of a series of bonds of like date and amount and known as "Salt Lake City Refunding Bonds, Series of January 1, 1937," issued under and pursuant to the provisions of the Constitution and Laws of the State of Utah. The Board of Commissioners of Salt Lake City shall annually levy a sufficient tax to pay the interest on this bond as it falls due and also to constitute a sinking fund for the payment of the principal thereof as the same falls due. It is hereby certified, recited and declared that all conditions, acts and things essential to the validity of this bond exist, have happened and have been done and that every requirement of law affecting the issue hereof has been duly complied with, and that this bond is within every debt and other limit prescribed by the Constitution and Laws of said State, and that the full faith and credit of said Salt Lake City are hereby irrevocably pledged to the punctual payment of the principal and interest of this bond, according to its terms. All the covenants, statements, representations and agreements contained in said bonds and coupons and all recitals and representations of this ordinance, are hereby considered and understood and it is hereby ordained and declared that said covenants and promises therein are the covenants and promises of said Salt Lake City and the the representations and statements therein are the representations and statements of said City, and it is further stated and represented that Salt Lake City is a municipal corporation of the first class under the Constitution and Laws of the State of Utah. iff - 5 - Section 2. The interest falling due on said bonds on July 1, 1937, shall be paid out of the general fund of said. City, and for the purpose of reimbursing said general fund for said payment of interest and to meet the interest falling due on said bonds on January 1, 1938, and on July 1, 1938, and in order to provide a sinking fund for the payment of said bonds at maturity, there shall be levied in the year 1937 on all taxable property in said City, in addition to all other taxes, a direct tax sufficient to produce the sum of $12,625.00, being $2,625.00 for interest and 410,000 for principal, and thereafter in order to provide for the payment of the interest on said bonds as the same matures and to provide a sinking fund for the payment of the principal of said bonds at maturity, there shall be levied in each of the years 1938 to 1942, inclusive, a direct annual tax on all taxable property in said City, in addition to all other taxes, sufficient to produce the sum of 411,750.00, being $1,750.00 for interest and 410,000.00 for principal, and in the year 1943 there shall be levied on all taxable property in said City, in addition to all other taxes, a direct annual tax sufficient to produce the sum of $10,875.00, being $875.00 for interest and$1A000.00 for principal. Said taxes, when collected, shall he applied solely for the purpose of paying the interest and principal of said bonds respectively and for no other purpose whatever until the indebtedness so contracted under this ordinance, principal and interest, shall have been fully paid, satisfied and discharged, but nothing herein contained shall be so construed as to prevent said City from applying any other funds that may be in the treasury and available for the purpose to the payment of said interest or principal, as the same respectively mature, and the levy or levies herein provided for may thereupon to that extent be diminished, and the sums hereinbefore provided for to meet the interest on said bonds and to discharge the principal when due, are hereby appropriated for that purpose, and said amount for each year shall also be included in the annual appropriation bills passed by the Board of Commissioners of said Salt Lake City in each year respectively, and if at any time the proceeds of any f ' _ 6 _ tax levy are not sufficient to pay either the interest on or the principal of said bonds as the same mature, said interest and principal shall be paid from and be a first charge against the general fund of said City. Section 3. Said bonds and each of them shall be signed by the Mayor and the City Treasurer and attested by the City Recorder and the coupons attached to said bonds shall be signed by the facsimile signature of the City Treasurer. The Mayor and City Treasurer are hereby authorized and directed to sign, and the City Recorder to attest and affix the seal to each of said bonds, and the acts of said Mayor, City Treasurer and City Recorder in so doing are and shall be the act and deed of Salt Lake City. Section 4. Said bonds shall be issued in place of the bonds to be refunded in such a way that the indebtedness of said City shall not be • increased through the issuance of said Refunding Bonds. Section 5. That all ordinances and resolutions or parts of ordinances and resolutions in conflict with the provisions hereof, be and the same are hereby repealed, and after said bonds are issued, this ordinance shall be and remain irrepealable until said bonds and the interest thereon shall have been fully paid, satisfied and discharged as herein provided. Section 6. The City Recorder is hereby instructed and directed to cause copy of this ordinance to be published immediately in one issue of Salt Lake Telegram , a daily newspaper of general circulation in and printed and published in Salt Lake City, Utah. Section 7. That an emergency is hereby declared, and in the opinion of the Board of City Commissioners because of the necessity of raising funds with which to meet maturing obligations of said City, it is necessary for the peace, health and safety of the inhabitants of Salt Lake City that this ordinance take effect immediately. _ 7 _ l-(' Section S.
