AN ORDINANCE
Result
AN ORDINANCE GRANTING to the Bamberger Railroad Company,
and its successors and assigns, a franchise and right of way to
construct, maintain and operate a single spur track upon Third
West Street in Salt Lake City, Utah, from the east track of the
Company, as now constructed in Third West Street in Salt Lake City,
Utah, to the property line on the east side of said Third West
Street.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. A franchise and right of way is hereby granted
to the Bamberger Railroad Company, its successors and assigns, to
construct, maintain and operate a single spur track together with
the necessary poles and overhead wires upon Third West Street,
Salt Lake City, Utah, the center line of said spur track being de-
scribed as follows:
Commencing 9.12 feet east and 377.65 feet south of the
city monument at the intersection of Third North and Third
West Streets; running thence southeasterly on a curve to the
left having a radius of 285.5 feet for 56.9 feet, more or
less; thence on a curve to the left, having a radius of 150
feet for 104.3 feet, more or less to the east property line
of Third West Street at 41.5 feet, more or less, north of
the southwest corner of Lot 3, Block 115, Plat A, Salt Lake
City Survey, said spur track is more particularly shown on
the attached blueprint, which is hereby made a part of this
ordinance.
SECTION 2. That the right and privileges granted in this
ordinance are specifically made subject to all the rights, duties,
responsibilities, conditoons, provisions and obligations as the
same are set out in that certain franchise heretofore and on the
4th day of December, 1946, granted to the grantee herein, and said
rights herein conveyed are hereby declared to be governed and con-
trolled by said franchise and the terms thereof, except insofar as

the same may be repugnant to or in conflict with the terms of this
ordinance.
SECTION 3. The right hereby conferred shall expire on th
Ijlst day of January, 1975.
SECTION 4. Unless this franchise and all the terms and
conditions thereof shall be accepted in writing by the grantee
herein within thirty days after this ordinance becomes effective,
and unless said track be constructed within one year from the
effective date thereof, then this ordinance shall be null and void.
SECTION 5. In the opinion of the Board of Commissioners
it is necessary to the peace, health and safety of the inhabitants
of Salt Lake City that this ordinance become effective immediately.
SECTION 6. This ordinance shall take effect upon its
first publication.

'gentlemen:
At a meeting of the Board of Commissioners held
June 11, 1957, your petition No. 399 stating that you have the
approval of the Interstate Commerce Commission by an order dated
April 1, 1957, and of the Public Service Commission of Utah
dated lone 4, 1957, to transfer all of your assets and properties
to the Bamberger Railroad Company, and submitting an Assignment
of Franchise for filing in the Office of the City Recorder, and
requesting approval by the City for the transfer of such properties
and the authorizations and franchises heretofore issued by Salt
Lake City in accordance with Title 16, Revised Ordinances of Salt
Lake City, 1955, was taken up foe consideration.
The petition was filed, the Assignment was approved,
the Board of Commissioners expressly consenting thereto, and the
City Recorder was directed to so notify you.
A copy of this letter was ordered attached to the
franchises granted to the Bamberger Railroad Company and to the
Salt Lake Rail and Bus Terminal Company by Salt Lake City.
