AN ORDINANCE .
An ordinance levying a tax and for the assessment of property or
the east side of Washington Street between Ninth South Street and
Fayette Avenue, in Sidewalk Distriot No. 44, for the construction of j
a cement sidewalk.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the City Council does hereby levy the tax and
; provide for the assessment of the same upon the property hereinafter
described in Sidewalk District No. 44, for the construction of a
joement sidewalk, to»wit:
In Lots 2 to 24, inclusive, Block 1, Hunter's Subdivision, Block
23, Five Acre Plat "A", and in Section 12, Township 1 south, Range 1
west, Salt Lake Meridian, abutting on the east side of Washington
Street between Ninth South Street and Fayette Avenue.
This tax is levied to defray the expense of constructing a oene
sidewalk five (6) feet wide and four (4) inches think upon the prop-
erty hereinbefore and hereinafter described to be especially affeotedi
and benefited by said improvement, and it is hereby adjudged, deter-
mined and established that said property will be especially benefits
thereby to the full amount of the tax hereby levied, and said parcels
of land are hereby assessed at an equal and uniform rate in accordano
with the linear foot frontage upon said portion of said street, front
ing upon and to a depth of twenty-five (25) feet back therefrom, and 1
the tax hereby levied and to be assessed upon said parcels of land is
four hundred thirty-seven and 12/100 ($437.12) dollars, or 74/100
( 0.74) dollars per front or linear foot of abutting property, there
being 690.70 feet of abutting property within the boundaries of the
lots, block and street above mentioned in said district, which is thel
total post and cost per front foot of said sidewalk, according to thel
contract entered into for the performance of said work and making
said improvement with J. F. Joknson, dated the 17th day of October,
1910, and the Treasurer is hereby authorized and directed to assess,
tin accordance with the provisions of this ordinance for the purpose
,therein mentioned:

The west side of Lots 2 to 24, inclusive, Block 1, Hunter's
'Subdivision, Block 23, Five Acre Plat "A", Big Field Survey; commend g
at the northwest corner of Lot 24, Block 1, Hunter's Subdivision,
Block 23, Five Aire Plat "A", thence north 10 feet, Section tax 12,
Township 1 south, Range 1 west, as the same are shown upon the offioi 1
plats of said city to a depth of twenty-five (26) feet back from said
street, and to collect said tax.
SECTION 2. Said tax shall become and be delinquent in five equa
y arly
'installments, with interest on the whole sum unpaid at the rate of
six per Dent per annum, payable at the time each installment is due-
to-wit: One-fifth thereof one year after the approval of the ordinan e
confirming the levy of the tax for the payment for such improvement;
one-fifth thereof in two years after such approval; one-fifth thereof'
in three years after such approval; one-fifth thereof in four years
after such approval; and one.-fifth thereof in five years after such
approval. One or more of said installments, in the order in which
they are payable, or the whole special tax may be paid at any time
within thirty days after the approval of the ordinance confirming the
levy of the tax, without interest. In the event of any installment
or the interest aforesaid not being paid on the date the same becomes
due, the whole amount of the special tax unpaid at the time said in-
stallment and interest are due, shall become due and payable, and
shall draw interest at the rate of eight per cent per annum until sal
of the property assessed; provided, one or more installments, in the

order in which they are payable, or the whole special tax unpaid may
be paid on the day any installment becomes due, 'by paying the amount
thereof and interest to said date.
SECTION 3. This ordinance shall take effect upon approval.
