SECTION 952x3. The Board of Commissioners shall appoint thicee 'persons who shall constitute and be known as the Civil Service 1 ';Commission, one of whom shall be the Commissioner of Public Safety. iiThe other commissioners shall be qualified electors of Salt Lake City, who are known to be heartily in favor of the Civil Service j System, Tat-mere---than..tw.o-members of said-commission; shall, at the time of their appointment be members of the same polite, yy i party. Each commissioner shall qualify by 1 � taring the constitutional oath of office and by giving bond in i !+ i the sum of $2000.00. No member of the commission shall receive 1 !lany compensation for his services as such. No member of the Civil Service Commission, except the Com- 1 missioner of Public Safety, shall, during his tenure ofcsffice, lhold any other public office, nor shall he be a candidate for any Bother office. SECTION 952x4. The Civil Service Commission may organize biy !selecting one of its members as chairman and shall select as sec- i, ijretary one of the officers or employes of the city available for such service, who, in the judgment of the commission, shall be bst !qualified for such position. Said secretary shall serve without' 'additional compensation and shall be the custodian of the books and papers of the commission, and act as clerk thereof. The Civil Service Commission shall make all necessary rules' • ';and regulations for the purpose of carrying out the requirements' lof this ordinance. .All such rules and regulations, together will. Ithe provisions of this ordinance shall be printed for distributi,n jby the Commission. SECTION 952x5. The following officers may be appointed from the classified u service and upon the expiration of their terms be returned thereto,' to-wit: chief of police, inspector of police, chief of detectives, 1111 r --*.A.in of polies and secretary to the chief of police. „ '' n IIM-■ Ti t I i J vacancy caused by death, resignation or otherwise. j .V SECTION 952x6, The classified service shall consist of the following officers and men in the police department of Sal Lake City, to-wit: lieutenants, patrolmen of the first grade, patrolmen of the second grade and patrolmen of the third grade. No appointment to any of the offices or grades of service above mentioned shall be made except under and according to the pro- 1 visions of this Ordinance and the rules and regulations of the 1 Civil Service Commission, provided, however, nothing in this section shall prevent the transfer of patrolmen as provided in Section 953, Revised Ordinances, Salt Lake City, 1913, as amen4ed. The following officers may be appointed from the classified 1 service and upon the expiration of their terms be returned thereto, to-wit: chief of police, inspector of police, chief o detectives and captain of police. j SECTION 952x'7. All applicants for places and offices in the I classified Civil Service of the police department shall be sub-; Jetted to examination, which shall be public, competitive and , open to all male citizens of the United States and qualified r electors of Salt Lake City between the ages of 21 and 35 each inclusive. Said examination shall be practical in everyokaiongitar- and shall relate to those matters which will fairly test the re`- d lative capacity of the persons examined to discharge duties of ' positions to which they seek to be appointed, and shall include tests of physical qualifications and health. Every applicant for examination shall pay Ito the City Treasurer the sum of 1''1.00 and shall not be examined until such sum has been paid. -3- SECTION 952x9. Applications for examination shall be upon b• lanks to be prepared and furnished by the commission, made i out in the handwriting of the applicant and subscribed and ii sworn to by him. All applications shall be accompanied by certificates from at least two reputable citizens of Salt Lake City, and shall state that they have personally known the appli+ t cant for at least six months and that he is a good moral characer, n• ot of dissipated or dissolute habits, nor addicted to intemper to { juse of intoxicating liquors, or the habitual use of drugs, that jhe is a citizen of the United States and a qualified elector ofI Salt Lake City, and that applicant is worthy and qualified to f ll 11 the position for which application is made. SECTION 952x10. The commission shall, during the first we k in October and April of each year and at such other times as ma be II deemed necessaty, hold the public competitive examinations pro d- j ed for herein, and shall give notice of the time and place of ,) holding such examinations by posting a written notice in a eon-I spicuous place in the Public Safety Building, and in the City atd it C• ounty Building, for at least one week preceeding the date of soh examination, and by publication at least once in each of the daily 1 newspapers of general circulation in the city. SECTION 952x11. The commission shall prepare a register o the persons whose average standing upon the examination is not A less than the minimum fixed by the rules and regulations, and ti 16 V'daa(_, ,(, who are otherwise eligible, and such persons shall take rank 1 upon the register as candidates for appointment in the order of 1 their relative results as determined by such examination, with- { ij out reference to priority of time of examination. The name of j any person who shall not have been appointed may remain upon th classified list for not more than one year. SECTION 952x12. The commission shall by its rules, provi it q for promotions in the classified service on the basis of ascer- tained merit and seniority in service and standing upon examina- tion, and shall provide in all cases where practicable that 1 vacancies shall be filled by promotion. All examinations for L !I j II ' r I { f J ! promotion shall be competitive among such members of the next lower rank established by the, commission, as desire to submit themselves to such examination, and it shall be the duty of the! 1 commission to submit to the Chief of Police the names of not more than three applicants having the highest rating for such a promotion. The method of examining, rules governing same, and method of certification shall be the same as near as may be, asl provided for applicants for original appointment. SECTION 95272.3. The Chief of Police shall notify the cm- 1 mission of each vacancy that may occur within the classified service and the commission shall thereupon certify to him the names and addresses of the three candidates, if there shall be so many eligible, standing highest upon the register for the j! position sought to be filled. The chief of police shall notify II the commission separately of each position to be filled and shall j( fill such places by appointment by the persons certified to him it by the commission. SECTION 952x14. REMOVALS. Every officer or employe in the classified civil service shall hold office until removed, re- i Isigned or pensioned. Any officer or employe in such service ,l may be removed by the chief of police without charges being pre- ferred and without trial, hearing or opportunity to be heard, with the consent of the Board of Commissioners, whenever in { their opinion the good of the service will be sub served thereby The chief of police shall upon removal of any man in the class ified service communicate to the civil service commission his j! reasons for making such removaljf the civil service commission shall believe that the reason assigned by the chief of police for such removal is inadequate or that such removal is in vio- lation of the spirit of the civil service ordinance or regula- tion, the removed person may be given an opportunity .to be 1 heard before such commission. The civil service commission mayl . make such investigation as it sees fit in case of removals, and' make full report of its findings to the board of commissioners —5— jbefore final action is taken by the Board of Commissioners upon i II the recommendation of the chief of police. The Board of Com- missioners may refuse to sustain the action of the chief of i j police in making such removal whenever it is of the opinion ti 'I that the good of the service will not be subserved. by such re moral or that such removal is in violation of the civil service • � regulations. SECTION 952x15. All present members of the police departH ! ment who desire to retain their positions shall within six months of the date of the passing of this ordinance submit them- selves to the civil service commission for examination and shall Ibe examined in the same manner and upon the same subjects as 1 ,1 applicants for appointment. No such person shall be retained• 1 1 in office or employed in the classified service who shall fails I to obtain the passing mark as provided by such civil service I commission in the case of applicants for original appointment, provided, however, this section shall apply only to men in the department without previous experience in the Salt Lake City I .Police Department who shall have been appointed since January I lst, 1918. The Chief of Police may employ any person for merely i temporary work in the Police Department without making such appointment from the certified list, but such employment shall not last longer than two months, and under no circumstances Ishall such temporary employe be appointed to a permanent position in the department unless he .hall have been duly certified by 1 the Civil Service Commission, as in other cases. SECTION 952±16. In ease of charges being preferred against any member of the Police Department by any citizen it shall bel the duty of the chief of police to immediately thereafter pro de iI for a hearing at which hearing the person making charges shall II have an opportunity to be heard, together with his witnesses and I the person under accusation shall also have ample opportunity II to present his side of the case, and either party may be repre- sented by counsel. The chief shall make full report of hie is it -6- • •• • 1 findings in writing to the Civil Service Commission, together with his recommendation, a copy of which shall be filed with the Civil Service Commission. The Civil Service Commission may, if any party of the controversy requests it, review the matter land take such action as it deems best. SECTION 952x17. No person in the classified service or 1 : seeking admission thereto shall be appointed, promoted, suspend-] j led, reduced or removed, or in any way favored or discriminated (,against because of his political or religious opinions or af- I filiations. I SECTION 952x19. Honorably discnargeci solale�.s, adi n4'w ` I marines who have serviced as such in the army, navy or marine 1 corps of the United States or in the National Guard of this stat shall be given full credit gained in such service, having due I : regard to the position for which the examination is had. SECTION 952x20. The Civil Service Commission shall provide i ( for adequate instruction to be given the mon employed in the police department which shall more adequately fit them for ef- ficient service. The subjects to be covered to include crimin- ology, micro-analysis, public health, criminal law and proceedur0 j -7- II I jand evidence, and such other subjects as may be deemed advisable by said commission. The commission shall make such rules and regulations with regard to the course of instruction to be given I , police officers as it may deem necessary and require obedience to the same. SECTION 952x21. The commission may fix by its rules the age at which the person in the service of the city appointed under Civil Service rules may be retired from the service, al men who. shall have reached the age of--re#re t.as fled 3r .the-cammiasian. and who shall be. retired by the Board of ComIIissioners, shall have been constantly in the. service of. II Salt Lake City for ten years next prior tO such date of retire- ment and who shall have served altogether.not less;than twenty- time years in the police department of Salt Lake City shall be entitled to a pension of 450.00 per month so long as he shall l` e. SECTION 952x22. In case any of the officials of the polio department not within classified service shall have been appoint- a ed to their position from the classified service at the termina- f tion of such office, such person shall be returned to the place ! ! in the classified service which he held prior to such appointment. SECTION 952x23. Any person vjolating any provisions of this ordinance shall upon conviction-bit e u be punished by a fine ix 9-rwme any ral-avy not exceeding $299.00 or by imprisonment in the city jail for a period not exceeding six months. The court may, in f jjimposing a fine, enter as part of the judgment that in default of the payment of the fund the defendant may be imprisoned in the city jail foraexceeding' period not onths.
