Harrison . . . r Holley. \ r.?.c<.a- �', / f< c Mr. Chairman . 7 Result AN ORDINANCE AN ORDINANCE AMENDING Title 2 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to aeronautics, by adding thereto a new chapter to be known as Chapter 19, providing for an airport council and defining the nature, personnel and duties of such council. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 2 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to aeronautics, be, and the same hereby is amended by adding thereto a new chapter known as Chapter 19, providing for an airport council and defining the nature, personnel and duties, said chapter to read as follows: "CHAPTER 19" AIRPORT COUNCIL "Sec. 2-19-1. Creation. Title. Composition. Qualifications. There is hereby created an official body of the city to be known as the airport council, which body shall consist of seven members; it being provided, however, that one member of the council shall be the duly elected, qualified and acting commissioner of the city department to which the airport is assigned. Members of the air- port council shall not be appointed as the representative of any particular aviation activity. "Sec. 2-19-2. Appointment. Oath of office. The members of the airport council shall be appointed by the Salt Lake City Commission. The members of the council shall, within ten days after being notified of their appointment, sign the oath of office required by law to be signed by city officers and file the same in the office of the city recorder. "Sec. 2-19-3. Term of office. Vacancies. Two members of the airport council shall be appointed for a term of two years; two members for a term of four years and two members for a term of six years; providing, however, that after the initial terms of two, four and six years, all subsequent terms of office shall be for a period of six years. The term of office of each member of the airport council shall commence on the 1st day of September, 1967, and he shall serve until his successor is appointed and 53 -2- qualified, unless the appointment is made to fill a vacancy, in which case he shall hold office for the unexpired term of the person who ceased to be a member of the airport council and whom he is succeeding; providing, that if the council mem- ber representing the Salt Lake City Commission shall cease to be a member of the Salt Lake City Commission for any reason or shall cease to be in charge of the city department to which the airports are assigned, such occurrence shall automatically terminate his term of office as a member of the airport council and another city commissioner shall be appointed to the airport council. Vacancies in the airport council shall be reported to the city commission with appropriate recommendations by the city commission member of the council. Nothing in this section shall be construed to limit the number of terms a council member may serve. "Sec. 2-19-4. Organization. Quorum. The members of the airport council shall meet within ten days after receiving notice of their appointment, and organize by the election of a chairman and a vice-chairman from their own number, and they shall designate a secretary who may be either a member of the council or another suitable person as the council may see fit. Four members of the airport council shall constitute a quorum for the transaction of business at any stated meeting or meeting regularly called. "Sec. 2-19-5. Powers and duties generally. The airport council shall act in an advisory capacity to the city commission in the supervision, management, planning, operation and improve- ment of Salt Lake City Municipal Airports No. 1 and No. 2 and shall have such authority over the airports and property pertaining thereto as may be granted from time to time by the Board of City Commissioners. "Sec. 2-19-6. Authority to adopt rules and regulations, etc. The airport council is hereby empowered to adopt such rules and regulations, and to establish such fees and charges, to govern the municipal airports as it may deem just and proper, or as the city commission may direct; subject, however, to supervisory control and approval of the city commission. "Sec. 2-19-7. Executive officer. Appointment. The airport council may designate an executive officer to act for the council in the transaction of routine or specified business as the council may determine. "Sec. 2-19-8. Granting of franchises. Execution of contracts, etc. The city commission hereby expressly reserves to itself full authority to grant any and all franchises, and to execute all con- tracts, leases or other legal instruments in connection with the municipal airports. "Sec. 2-19-9. Meetings. The airport council shall meet at least once during each calendar quarter, and at such other times at the call of its officers or at the request of the city commission. "Sec. 2-19-10. Remuneration. Members of the airport council shall receive no compensation for their services as members of the airport council or for any personal expense they may incur as mem- bers of the council. 53 -3- "Sec. 2-19-11. Removal from office. Any member of the airport council may be removed from office by the city com- mission for cause, prior to the normal expiration of the term for which he was appointed. "Sec. 2-19-12. Funds. All funds received from fuel, taxes, rentals, concessions or any other source at Salt Lake Airport No. 1 and Salt Lake Airport No. 2 shall be placed in an airport fund and kept separate and apart from all other city funds. The col- lection, accounting and expenditure of all airport funds shall be in accordance with existing fiscal policy of the city. SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication.
