AN ORDINANCE

AN ORDINANCE AMENDING Title 51 of the Revised Ordinances of Salt Lake
City, Utah, 1965, relating to zoning, by an addition and amendments thereto
as follows: adding a new section to Chapter 2 of said title, relating to
definitions, to be known as Section 51-2-11.1, and amending Section 51-5-8,
relating to exceptions to height regulations, Section 51-9-3, relating to
parking regulations.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
SECTION 1. That Chapter 2 of Title 51 of the Revised Ordinances of
Salt Lake City, Utah, 1965, relating to definitions, be, and the same hereby
is, amended by adding thereto a new Section 51-2-11.1, to read as follows:
"Sec. 51-2-11.1. Capitol Hill protective Area. "Capitol Hill
Protective Area" shall mean that area surrounding the Utah State
Capitol building bounded by the following streets: Beginning at
the intersection of State Street and North Temple Street, thence
west along North Temple Street to Main Street, thence north along
Main Street to Center Street, thence northwesterly along Center
Street to Girard Avenue, thence east along Girard Avenue and Girard
Avenue extended to the east edge of Memory Grove Park in City Creek
Canyon, thence southerly along the east edge of said Memory Grove
Park to the intersection of Ninth Avenue and "A" Street, thence
south along "A" Street to Fourth Avenue, thence west along Fourth
Avenue to Canyon Road, thence southerly along Canyon Road to Second
Avenue, thence westerly along Second Avenue to State Street and
North Temple Street, which is the point of beginning."
SECTION 2. That the first paragraph of Section 51-5-8 and subparagraph
(3) of said section of the Revised Ordinances of Salt Lake City, Utah, 1965,
relating to exceptions to height limitations, be, and the same hereby are,
amended to read as follows:
"Sec. 51-5-8. Exceptions to height limitations. The following
exceptions apply to the height regulations contained in this title
with the exception that no heights are permitted above the maximum
allowed under the airport height provisions, nor shall any of the
following exceptions apply to any property located in any zone within
the boundaries of the (Capitol Hill Arotective Area. * * *"

"Sec. 51-5-8. Exceptions to height limitations. * * *
"(3) Where a business "B-3" district or a commercial "C-1"
district completely abuts a residential "R-5", "R-6", "R-7" or a
commercial "C-3" or any industrial district the same height regula-
tions that apply to such adjoining zoning district shall apply to
the business "B-3" or commercial "C-1" district. Where a business
"B-3" district or a commercial "C-1" district abuts more than one
of the above-mentioned districts which allow a higher height than
in the "B-3" or "C-1" districts the more restrictive height provis-
ions of the abutting districts will prevail. This provision shall
apply to the main structure only and shall not apply to the height
of a free standing sign located on the premises, nor to a roof sign."
SECTION 3. That subparagraphs 2 and 3 of Section 51-9-3 of the Revised
Ordinances of Salt Lake City, Utah, 1965, relating to parking,be, and the
same hereby are, amended to read as follows:
"Sec. 51-9-3. For buildings other than one- to four-family
dwellings. * * *
"(2) For fraternity or sorority houses at least one parking
space for each five rooms or five guests for which the building
is designed or intended to accommodate.
"(3) For boarding and rooming houses, dormitories, hotels
one parking space for every two guests the building is designed
to accommodate."
SECTION 4. In the opinion of the Board of Commissioners of Salt Lake
City it is necessary to the peace, health and safety of the inhabitants of
Salt Lake City, Utah, that this ordinance become effective immediately.
SECTION 5. This ordinance shall take effect upon its first publication.
Passed by the Board of Commissioners of Salt Lake City, Utah, this 22nd
day of June, 1965.
