Home My WebLink About54 of 1981 - Closing a 100 foot portion of Major Street, formerly known as Cascade Street, North of Hollywood Ave SALT LAKE CITY ORDINANCE No. 54 of 1981 (Closing a 100 foot portion of Major Street, formerly Cascade Street north of Hollywood Avenue) AN ORDINANCE CLOSING A 100 FOOT PORTION OF MAJOR STREET, FORMERLY KNOWN AS CASCADE STREET, NORTH OF HOLLYWOOD AVENUE AT APPROXIMATELY 1960-1970 SOUTH. WHEREAS, based on the review of Petition No. 122 of 1981 submitted by O. C. Tanner Company requesting the closure of a portion of the northern 100 foot portion of Major Street north of Hollywood Avenue at approximately 1960-1970 South; and WHEREAS, a review of said petition indicates that closure would be contrary to the resolution of the City, but, in lieu thereof, that closure would be appropriate based upon the find- ings that said portion of the street is no longer necessary for use as a public street, avenue or alley, but should be closed, with the public interest being retained for anticipated transfer at fair market value to abutting property owners based on cer- tain conditions and rervations: Therefore, be ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the northern 100 foot portion of the 66 foot wide Major Street (50 East) between Lots 14-17 of Block 1 and Block 2 of the State Street Addition (Book C, Page 108) , north of Hollywood Avenue in Salt Lake City, Utah, more particu- larly described below, be, and the same hereby is, closed and declared no longer to be needed or available for use as a public street, avenue, alley or pedestrian way, but that the public's interest therein shall be reserved for a contemplated transfer for the fair market value. Commencing at the northeast corner of Lot 14, Block 1, State Street Addition, a subdivision of Lot 19, Block 6, Five Acre Plat "A", Big Field Survey in Salt Lake County; thence running south 100 feet, more or less, along the west line of Major (formerly Cascade) Street to the southeast corner of Lot 17; east 66 feet, more or less, to the southwest corner of Lot 17 of Block 2 of said subdivision; thence running north 100 feet, more or less, along the east line of Major Street to the northwest corner of Lot 14 of Block 2; thence run- ning west 66 feet to the point of beginning. Containing 6,600 square feet. � 1• Said closure is expressly SUBJECT TO all existing rights of ways and easements of all public utilities of any and every description, now located on, in, under or over the confines of the above described property, and also SUBJECT TO the rights of entry thereon for the purpose of obtaining, altering, repair- ing, replacing, removing or rerouting said utilities and all of them. It is expressly noted that the existing water mains, fire hydrants, and sprinkler system connections within said property must be reserved as part of said utility easement. Said closure is also SUBJECT TO any existing rights of ways or easements of private third parties. Further, said closure is SUBJECT TO the retention and reservation by the City of a fire lane to provide ingress and egress to the abutting premises for purposes of providing fire protection. SECTION 2. In the opinion of the City Council of Salt Lake City, Utah, it is necessary for the peace, welfare, health and safety of the inhabitants of said city that this ordinance become effective immediately subject to the terms hereof. SECTION 3. This ordinance, after the date of its first publication, shall not be recorded with the Recorder of Salt Lake County until the contemplated transfer is completed and presented concurrently for recording.
