AN ORDINANCE %:.tEIdDING CN PTEF fiVII of the revised Ordi-
nances of'Salt Lake City, 1920, relating to public offenses, by
adding thereto three new Sections to be known as Sections 1623,
1624 and 1625.
Be it enacted by the '3oard of Commissioners of Salt Lake
City, Utah;
SECTION 1. That Chapter _J,vII of the Revised Ordinances
of Salt Lake City, 1920, be and it is hereby amended by adding there-
to three new Sections relating to false ar fraudulent advertising,
said Sections to be 'mom as Sections 1623, 1624 and 1625 and to
read as follows:

It shall be unlawful for any person engaged in business in Salt
Lake City with intent to sell or in any wise dispose of merchan-
dise, service or anything offered by such person directly or in-
directly to the public for sale or distribution, or with intent
to increase the consumption thereof, or to induce the public in
any monner to enter into any obligation relating thereto, or to
acquire title thereto, or an interest therein, to make, publish,
diseeminate, circulate, or place before the public, or cause di-
rectly or indirectly to be made, published, disseminated, circu-
lated or placed before the public in this city in a newspaper or
other publication, or in the form of a book, notice, bond-bill,
poster, bill,circular, pamphlet, or letter, or iii any other way,
on advertisement of any sort regarding merchandise, service, or
anything so offered to the public, which advertisement contains
any assertion, representation or statement of fact ihich is
false or untrue in any respect, or which is deceptive or mis-
leading as defined in this ordinance.
SECTION 1624. DEJ;I+ELS NOT DISCLOSING TRUE CILLRACTL`4. It
shall be deemed deceptive end misleading advertising and unlaw-
ful for any person engaged in the business of buying and selling
new or secondhand articles of goods, wares and merchandise, or
other property, real or..ipersonal, or who is engaged in the busi-
Hess of furnishing any kind of service, to advertise by means
of "liner ads" in a newspaper, or otherwise, such articles,

property or service for sale in a manner indicatir; that the
sale is being made by a householder or private party not engaged
in such business; and every person engaged in any such business
such
shall in advertising/goods, wares, or merchandise, property or ,

service for sale, either through "liner ads", or otherwise,
affirmatively end clearly indicate that the seller is engaged
in such business and is not a private party.•
SECTION 1625. DEC_PTIVE iifD LIISLEADING AIZVEiifI»li:G1 SECONDS.
It shall be deemed deceptive and misleading advertising and un-
lawful for .any person in a newspaper or other publication, or in
any other manner hereinbefore set out, to offer to the public,
for sale or distribution, any merchandise which is secondhand or

used merchandise, or ,-which is defective in any manner, or which
consists of articles or units or parts known as "secohds" o-r
blemished merchandise, or which has been rejected by the menu- P
facturer thereof as not first class, unless there be conspicuously
displayed in direct connection with the name and description of
• such merchandise and each specific article, unit or part thereof,'
an unequivocal statement, phrase or word which will clearly indi-
cate that such merchandise or each article, unit or part thereof
so advertised is secondhand, used, defective or consists of "se-
conds", or iS blemished merchandise, or has bean rejected by the
manufacturer thereof as not first class, as the fact may be.
SECTIOII 2. In the opinion of the Board of Commissioners it is
necessary for the peace, health and safety of the inhabitants of Salt
Lake City that this ordinance take effect i_noeddately.

SECTION 3. This ordinance shall take effect upon its first
publication.
