Board of City Commissioners, City and County Building, Salt Lake City, Utah. Gentlemen: I respectfully submit herewith the copy of a proposed Ordinance which has been prepared under mandate of the Utah State Legislature and which provides a pen- sion for the appointive employees of Salt Lake City Corporation, who can qualify thereunder. All members of your honorable body have worked long and carefully in collaboration with representatives of the employees' group in the preparation of this Ordi- nance, and all members of your honorable body are earnest- ly in favor of the pension provision. In moving the adoption of the Ordinance, I respectfully submit that we unanimously favor the prin- ciple of an employees pension, but that we are not satis- fied with the Ordinance in its present form. Romney • !/ 1 ✓ „ .•' Tedesco Mr. Chairman . . `/� KAN.O1 DINANCE Result AN ORDINANCE AMENDING CHAPTER I of the Revised Ordinances of Salt Lake City, Utah, 1944, as amended by an ordinance passed by the Board of Commissioners on the 29th day of August, 1945, by adding in and to said Chapter a new section to be known as Section 138 providing for the creation and maintenance of a pen- sion retirement system,pursuant to Chapter 24 of the Session Laws of Utah, 1945. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTiON I. That Chapter I of the Revised Ordinances of Salt Lake City, Utah, 1944, as amended by an ordinance passed by the Board of Commissioners on the 29th day of August, 1945, be and the same is hereby amended by adding in and to said Chapter a new section to be known as Section 138 providing for the creation and maintenance of a pension retirement system pursuant to Chapter 24 of the Session Laws of Utah, 1945, which shall read as follows: "SEC. 138. PENSION RETIREMENT SYSTEM CREATED.(a)A pension retirement system is hereby established for the benefit of tlae employees of Salt Lake City. (b) Any employee who has reached or shall reach the age of sixty years and who has been an employee of the City for twenty years, whether continuously or not, at the option of the Board of Commissioners, or who has reached or shall reach the age of sixty-five years and has been an employee of the City for twenty years, whether continuously or not, at his own request, may be retired from active service at any time on or after July 1, 1947, and receive a monthly pension for the remainder of his life in an amount equal to one-half of Y CIC -2- his average monthlywage or salaryduring the five g years next Preceding his retirement, but in no event shall any such pen- sion exceed One Hundred ( 100.00) Dollars per month. reached (c) y^employee who has or shall reach the age of sixty-five years and who has been an employee of the City for ten years, whether continuously or not, at the option of the Board of Commissioners, or at his oven request, may be retired from active service at any time on or after July 1, 1947, and receive a monthly pension for the remainder of his life in a amount equal to one-half of his average monthly wage or salar during the five years next preceding his retirement, but in n. II event shall any such pension exceed Fifty ($50.00) Dollars per month. (d) The Pension Retirement System shall be sustaine. by monies provided in equal shares by the City and by Payroll deductions from the wages and salaries of employees. Commenc- t- on the first day of January, 1946, and on the first day of each month thereafter there shall be deducted from the monthl wage or salary, not in excess of $200.00, of each employee three (3%) per cent thereof, and the same together with a sum equal to the total of such deductions which shall be paid at the same time by the City shall be deposited with the City Treasurer in a special fund designated as the Pension Retire- ment Fund. (e) The Pension Retirement Fund shall be devoted exclusively to the payment of pensions and other amounts due to employees under this Pension Retirement System, and these shall be paid out by the City Treasurer upon order of the hoard of Commissioners and not otherwise. I (f) Upon order of the Board of Commissioners the City 'Treasurer shall invest in securities lawful for the in- vestment of funds of the City, such part of the Pension Retire- e ment Fund as in its judgment is not necessary to the payment of current charges against it, and upon its order he shall re- convert the same into money. -3- (g) Any employee whose employment shall be terminat- ed by discharge or resignation•shall be refunded the total of all monies deducted from his salary or wage, and if he again becomes an employee he shall pay into the Pension Retirement Fund the amount refunded and be restored to the position in the Pension Retirement System which he held at the time of hi- discharge or resignation. (h) The term "employee" as used in this ordinance means any person, including appointive officers and heads of departments, other than elected officers and those in the classified civil service, now or hereafter employed by the City. (i) All persons who are employees of the City on thj effective date of this ordinance shall be entitled to credit toward retirement the entire time of prior employment, whether continuous or not, but no one who becomes an employee after that date shall be entitled to credit toward retirement the time of any previous employment, provided that everyone who was in the employment of the City at the time he entered the Armed Service of the United States during "World War II" shall be deemed to have been an employee during the time of such service if within thirty days after its termination he returned to such employment and, if his return is subsequent to January 1, 1946, he pays into the Pension Retirement Fund the total amount that would have been deducted from his wage or salary had his return been on or prior to that date. (j) The terms "City" and "Salt Lake City", as used in this ordinance, mean tle municipal corporation of Salt Lak- i City. (k) The administrative expense of the Pension Re- ' tirement System shall be borne by the City. SECTION 2. This ordinance shall not go into effect until the twentieth day after its publication nor until the thirtieth iday after its passage but shall be effective at the expiration of... such twentieth day after publication or such thirtieth day after I� -4- I final passage or whichever of said days is the most remote from the final passage of this ordinance.
