WHEREAS, the Social Security Act has been so amended
by the Congress of the United States as to permit political sub-
divisions of the several states to extend to their employees and
officers the benefits of Old Age and Survivor's Insurance; and
WHEREAS, the Legislature of the State of Utah has enact-
ed legislation which enables the political subdivisions of the
State of Utah to take all action necessary to effectuate the cover-
age of all employees and officers under said Old Age and survivor's
Insurance System; and
WHEREAS, it is the opinion of the Board of Commissioners
of Salt Lake City that the present City Retirement Plan should be
terminated and that the Social Security System should be extended
to cover all city employees and elected officers, including City
Judges and other than those in the Classified Civil Service, and
that by so doing the best personnel will be retained and the effi-
ciency of the city government will be increased. And it is deemed
that payment by the city of its portion of the cost of said system
is a payment for a municipal purpose.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commission-
ers of Salt Lake City, Utah:
SECTION 1. That Section 136 of the Revised Ordinances of
Salt Lake City, Utah, an ordinance }passed by the Board of Commis-
sioners of Salt Lake City, Utah, on the 20th day of May, 1947, as
Bill No. 45, relating to a pension retirement system, be and the
same is hereby amended to read as follows:
"SEC. 136. SOCIAL SECURITY SYSTEM EXTENDED TO CITY EMPLOYEES
AND OFFICERS. (a) That the present City tension Retirement
System shall be and is hereby terminated as of December 31,1952.

(b) That all funds and credits existing and being a part Z
of the City Eension Retirement System shall be held in trust
by the City Treasurer to be disposed of in the future by order
of the Board of City Commissioners, excepr as is herein speci-4
fically provided.
(c) In no event shall any employee or officer who has
established a vested interest in the City Retirement System be
deemed to have lost such interest by the enactment of this
ordinance.
(d) The monthly pension of all retired city employees
participating in the City Retirement System or the City Dis-
ability Retirement System created by Section 137 of these
ordinances shall be paid from funds provided for that purpose
by the City.
(a) Salt Lake City shall become a participant in the
Federal Social Security System effective January 1, 1951.
(f) All of the benefits of Old Age and Survivor's Insur-!
ance of said Social Security Act are hereby extended to all
employees and elected officers, including City Judges of Salt;
Lake City, other than those in the classified civil Service
of said City.
(g) The Mayor and City Recorder are hereby authorized £o!
execute and deliver to the Utah Security Agency for its ap-
proval the plan or plans required under the provisions of Seci-
tion 5, Chapter 90, of the Laws of Utah, 1951, and of the
Social Security Act to extend coverage to said employees and
set
officers as/forth in paragraph (f) and to do all of the thins
necessary to that end.
(h) The City and each employee and official set forth
in paragraph (f) hereof shall make the payment required by
the Federal Insurance Contribution Act and the City Auditor
is hereby authorized and directed to deduct from all wages
and salaries due any such employee or official the required
amounts commencing with the first day of January, 1953.

(i) The City Treasurer is hereby authorized and directed
to make the payments to the Contribution Fund established by
Chapter 90 of the Laws of Utah, 1951, as required with refer-
ence to the period of January 1, 1951, to and including the
31st day of December, 1952, from both the City and each of the
employees or officials acquiring coverage under the Social
Security Act during all or any part of said period from the
present City's Pension Retirement Fund; provided, however,
that if the contribution of any such employee or official into
said City's Retirement Pension Fund is less than the amount
of his required retroactive contribution under said Federal
Contribution Act, that then and in such event each such em-
ployee or official shall immediately pay to the City Treasurer
the difference required, or in the event such employee or of-
ficial fails to immediately pay to the City Treasurer such
amount the City Auditor is directed to deduct from wages or
salaries to become due any such employee or official an amount
in installments to be determined by the Board of City Commis-
sioners sufficient to pay such difference.
(j) Any employee or official now paying into the present,
City Pension Retirement System shall upon termination, dis-
charge, resignation or death be refunded the balance of all
monies paid by him into the city's present pension retirement
fund remaining after deducting the amount required to be paid
by him under the Federal Contribution Act as retroactive pay-
ments as herein provided. In the event of death, payment of
these monies shall be made to the designated beneficiary or
the personal representative of said deceased.rr
SECTION 2. In the opinion of the Board of Commissioners,
it is necessary to the peace, health and safety of the inhabitants
of Salt Lake City that this ordinance shall become effective imme-'
diately.
SECTION 3. This ordinance shall ta}e effect .4pon its
first publication.
