(Closure of a portion of an alley)
AN ORDINANCE CLOSING THE NORTH 150 FEET OF A 17 FOOT
ALLEY LOCATED AT APPROXIMATELY 75 EAST NORTH OF HOLLYWOOD
AVENUE (1980 SOUTH) BETWEEN MAJOR STREET AND STATE STREET.
WHEREAS, Petition No. 122 of 1981 submitted by O. C.
Tanner Company has requested the closure of the northern 150
feet of a 17 foot wide alley at approximately 75 East and
North of Hollywood Avenue; and
WHEREAS, a review of said petition indicates that the
alley is not necessary for use as a public street and the
closure thereof will be in the interest of the public and
private property owners.
Therefore, be it ordained by the City Council of Salt Lake
City, Utah:
SECTION 1. That the northern 150 foot portion of a 17 foot
wide alley running parallel between Major and State Streets north
of Hollywood Avenue between Lots 5-16 of Block 2 of the State
Street Addition, in Salt Lake City, Utah, more particularly
described below, be, and the same hereby is, closed and declared
no longer to be needed or available for use as a public street,
avenue, alley or pedestrian way.
Commencing at the southwest corner of Lot 5, Block 2,
State Street Addition, a subdivision of Lot 19, Block
6, Five Acre Plat "A", Big Field Survey; thence run-
ning north 150 feet, more or less, along the west lines
of Lots 5-10 to the northwest corner of Lot 10; thence
west 17 feet to the northeast corner of Lot 11; thence
south along the east lot lines of Lots 11-16 150 feet,
more or less, to the southeast corner of Lot 16; thence
east 17 feet to the point of beginning.
Said closure is made expressly SUBJECT TO all existing rights
of ways and easements of all public utilities of any and every
description now located on, in, under or over the confines of
the above described property, and also SUBJECT TO the rights of
entry thereon for the purpose of obtaining, altering, repairing,
replacing, removing, or rerouting said utilities and all of them.
Said closure is also SUBJECT TO any existing rights of
way or easements of private third parties.
SECTION 2. In the opinion of the City Council of Salt
Lake City, it is necessary for the peace, welfare, health and
safety of the inhabitants of said city that this ordinance
become effective immediately.
SECTION 3. This Ordinance shall take effect upon the date
of its first publication.
Passed by the City Council of Salt Lake City, Utah, this
28th day of July _, 1981.
