(Embezzlement Defined and Obtaining Money
or Goods Under False Pretenses
AN ORDINANCE AMENDING SECTIONS 32-3-2 AND 32-4-1 OF THE
REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, AS AMENDED,
RELATING TO EMBEZZLEMENT DEFINED AND OBTAINING MONEY OR GOODS
UNDER FALSE PRETENSES.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Sections 32-3-2 and 32-4-1 of the Revised
Ordinances of Salt Lake City, Utah, 1965, as amended, relating to
embezzlement defined and obtaining money or goods under false
pretenses, be, and the same hereby are, amended as follows:
Sec. 32-3-2. Embezzlement defined. Embezzlement is the
fraudulent appropriation of money or property by a person to whom
it has been intrusted. It shall be unlawful for any person to be
guilty of the embezzlement of money or other property of value
not exceeding one hundred dollars. Upon any prosecution for
embezzlement, it is sufficient defense that the property was
appropriated openly and avowedly, and under a claim of title
preferred in good faith, even though such claim is untenable.

Sec. 32-4-1. Obtaining money or goods under false
pretenses. It shall be unlawful for any person by false or
fraudulent representation or pretense, to obtain from another
person any chose in action, money, goods, wares, merchandise,
chattels, effects or other valuable thing, with intent to cheat
or defraud any person of the same, within the limits of Salt Lake
City; provided, the value of the property so obtained does not
exceed one hundred dollars.
SECTION 2. This Ordinance shall take effect immediately
upon its first publication.
