": l Murdoch - - - _ Mr.Chairman - - AN ORDINANCE Result - - - AN ORDINANCE LEVYING A TAX and for the assessment of pro- perty (Sidewalk Extension No. 232) for the purpose of constructing concrete sidewalk. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described (Sidewalk Extension No. 232) for the purpose of constructing concrete sidewalk, to-wit: Lots 1, 2 & 3 of Blk. 8, Progress Heights 2nd Add.; Lots 23 to 26 incl. of Blk. 1, Lots 27 to 34 incl. of Bik. 2 and Lots 25 and 26 of Blk. 3, of East Westminster Add.; Lots 1, 2, 57 and 58 of Elmer Heights Sub.; Lots 28 to 36 incl. and 77 to 80 incl. of Sunnyside Add.; Lots 1 to 20 incl. of Blk. 'AI, Lots 1 to 4 incl. of Blk. +Bt, Lots 1 to 6 incl. of Bik. IC', Lots 1 to 9 incl. of Blk. 'D', Lots 1 to 18 incl. of Blk. 'Et, and Lots 1 to 7 incl. of Bik. 'F', of Imperial Add.; also Lots 19 and 20 all in Blk. 9, 5-Acre Plat ICI, Big Field Survey. The tax is levied to defray the expense of constructing concrete sidewalk five (5) feet wide on the west side of 16th East Street from 175 ft. south of Garfield Avenue to 113.88 ft. south of Hollywood Avenue; the east side of 16th East Street from Garfield Avenue to 21st South Street; both sides of Imperial Street from West- minster Avenue to 21st South Street and both sides of Westminster Ave- nue from 16th East Street to the east boundary line of Imperial Addi- tion; and replacing four (4) foot sidewalk with five (5) foot sidewalk on the west side of 16th East Street from 113.88 ft. south of Holly- wood Avenue to 21st South Streetjsaid sidewalk to be four (4) inches d -2- thick; upon the portions of said streets opposite the property her-- inbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determin- ed and established that said property will be especially benefited thereby to the full amount of the tax hereby levied and said par- cels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon and to the entire depth of the same ownership back therefrom not exceeding 330 feet, and the tax hereby levied and to be assessed upon said parcels of land is Three Thousand Seven Hundred Twenty-two and 79/100 ($3,722.79) Dollars; Three Thousand Four Hundred Sixty-four and 92/100 ($3464.9'2) Dollars or 76/100 ($.76) Dollars per front or linear foot of abutting property for constructing five (5) foot sidewalk, there being 4559.11 feet abutting said portion of said improvement, and Two Hundred Fifty-seven and 87/100 ($257.87) Dollars or 76/100 ($:76) Dollars per front or linear foot of abut- ting property for replacing four (4) foot sidewalk with five (5) foot sidewalk, there being 339.30 feet abutting said portion of said improvement; within the boundaries of the lots, blocks and streets above mentioned, which is the total abutters! cost and cost per front foot of said sidewalk, according to the contracts entered into for the performance of said work and making said improvement, and the Treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance, for the purpose herein mentioned; FIVE (5) FOOT WALK. SECTION 2. That the assessment list made by the City Treasurer, as corrected, approved and completed by the Board of Equalization and Review of the property described in Section I of this ordinance (Sidewalk Extension No. 232) of Salt Lake City, for the purpose of constructing a sidewalk upon said portions of said -4- streets, is hereby confirmed, and the assessments made and returned in said completed lists and the report of the Board of Equalization and Review to the Board of Commissioners of Salt Lake City are here- by ratified, approved and confirmed. SECTION 3. Said tax shall be payable in five equal yearly installments as provided by law and ordinance with interest on the whole sum unpaid at the rate of six per cent per annum, payable at e E; the time each installment is due; provided, however, that one or more w of such installments in the order payable, or-:the whole tax, may be paid without interest w thJn *teen (15) d$ysfrom(the date this ordinance becomes of tiVe. (fie or more-installments in the order in which they are pay► bbe,�or t1,e whole special tax, may be paid after said fifteen daasMand before the first installment becomes due by paying the samw with interest from`the Gate bf bevy to the date such first installment is due. One or more installments in the order in which they are payable, or the whole special tax, may be paid on the date any installment becomes due by paying the amount thereof and interest to the date of payment. Default in the payment of any such installment of principal or interest when due shall cause the whole of the unpaid principal or interest to become due and pay- able immediately and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per cent per annum un- til paid, but at any time prior to the date of sale or foreclosure, the owner may pay the amount of all unpaid installments past due with interest at the rate of ten per cent per annum to date of pay- ment on the delinquent installments, and all accrued costs, and shall thereupon be restored to the right thereafter to pay in installments in the same manner as if default had not occurred. 7- SECTION 4.
