Green Stewart Mr. Chairman-- I Result AN ORDINANCE AN ORDINANCE CREATING FOUR NE4 SECTIONS IN CHAPTER 33, Revised Ordinances of Salt Lake City, 1920, to be known as SEC- TIONS 1345, 1346, 1347 and 1348, relating to licensing of solici- tors. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That there is hereby created in Chapter 33, Revised Ordinances of Salt Lake City, 1920, four new sections to be known as Sections 1345, 1346, 1347 and 1348, relating to li- censing of solicitors, to read as follows: SECTION 1345. A solicitor within the meaning of this ordinance is defined to be any person who goes from house to house or from place to place in Salt Lake City sell- ing or taking orders for, or offering to sell or take orders for goods, wares or merchandise for future delivery, or for services to be performed in the future, or for the making, manufacturing or repairing of any article or thing whatsoever for future delivery, provided, however, that this ordinance shall apply only to solicitors who demand, accept or receive payment or deposit of money in advance of final delivery. SECTION 1346. It shall be unlawful to act as solici- tor within the meaning of this ordinance without first secur- ing a license from the license assessor and collector. The license fee required to be paid by solicitors within the meaning of this ordinance shall be the sum of -2- Fifty it III (450.00) Dollars per year payable in advance; and provided,that where application is made after July 1st of any year the fee for the balance of the year shall be li Twenty-five ( 25.00) Dollars. SECTION 1347. Any person desiring a license to engage as a solicitor within Salt Lake City shall make ap- plication therefor to the license assessor and collector, on forms to be provided, stating the name and address of the ap- plicant, and the kind of goods offered for sale, or the kind or services to be performed. Such application shall be ac- companied by a bond in the penal sum of 4500.00 executed by a surety company or by two responsible freeholders residing in Salt Lake City (or in lieu thereof a cash bond of equal amount), conditioned upon the making of final delivery of the goods ordered, or services to be performed, in accordance with the terms of such order, or failing therein, that the advance payment on such order be refunded. Any person ag- grieved by the action of any such solicitor shall have a right of action on the bond for the recovery of money or damages, or both. Such bond shall remain in full force and effect, and in case of a cash deposit, such deposit shall be:., retained by Salt Lake City, for a period of ninety days after the expiration of any such license, unless sooner released by the Board of Commissioners. . SECTION 1348. All orders taken by licensed solici-- ' tore shall be in writing, in duplicate, stating the terms thereof and the amount paid in advance, and one copy shall be given to the purchaser. SECTION 2. Any person violating any provision of this ordinance shall, upon conviction thereof, be punished by fine in any sum not exceeding Two Hundred Ninety-nine (4299.00) Dollars or by imprisonment in the city jail for a period not longer than 1 six months or by both such fine Ar imprisonment. }.v , 11111 I i SECTION 3. In the opinion of the Board of Commissioners. it is necessary to the peace, health and safety of the inhabitants 1 of Salt Lake City that this ordinance become effective immediately. SECTION 4.
