Mr. Chairman Result AN ORDINANCE AN ORDINANCE PROVIDING FOR the licensing of chain scheme and sales devices. Be it ordained by the Board of Commissioners of Salt lake City, Utah: SECTION I. There is hereby created a new section in Chap- ter 33, Revised Ordinances of Salt Lake City, Utah, 1920, to be known as Section 1346, providing for the licensing of chain mer- chandising or sales devices, which said section shall read as fol- lows: section 1346. It shall be unlawful for any person to engage in, carry on, conduct, operate or promote the busi- ness of chain merchandising without first having procured a licensee as in this section provided. The words "chain merchandising"'as used herein shall be deemed to include any scheme or sales device for the distri- bution of Foods, wares or merchandise predicated upon the sale or distribution of coupons, tickets, receipts or contracts re- presenting value in money, Foods, wares or merchandise, which coupons, tickets, receipts or contracts may, at the option of the holder, be redeemed in _..oeds, wares or merchandise upon the payment of money or the rendition of services of any kind what- soever to the promoter of such scheme, or to the holder of coupons;, tickets, receipts or contract; or any chain scheme or sales device wherein the holder of coupons„ tickets, receipts -2- or contracts may receive money, goods, wares or merchandise by selling or disposing of similar coupons, tickets, receipt- or contracts, or by the payment of money. The license fee for the business of chain merchan- dicing shall be $250.00 per year, or any portion thereof, and a sum which shall equal twenty-five (25%) per sent of the cost or selling price of any coupons, tickets, receipts or contracts representing value,for each and every person employed or engaged in selling or distributing tickets, cou- pons, receipts or contracts. The license fee of :250.00 shall be collected at the time application for license is filed and the license fee imposed upon persons engaged in selling or disposing of coupons, tickets, receipts or con- tracts shall be collected from the applicant monthly by the license assessor. No license shall be granted unless and until the applicant shall have agreed to submit his books monthly to the license assessor for the purpose of establish- ing the number of persons engaged in selling or disposing of coupons, tickets, receipts or contracts, and shall have also filed a bond in the sum of $2500.00, which bond shall run to: (a) Salt Lake City and be conditioned upon the account- ' ing and payment to Salt Lake City by the principal of all license fees imposed by this ordinance. (b) Any person injured or damaged by reason of any false or fraudulent representation of the principal or his agents or by the failure of principal to fdtlfill any and all representations contained in any ticket, coupon, receipt or contract. SECTION 2. In the opinion of the Board of Commissioners t is necessary to the peace, health and safety of the inhabitants ,f Salt Lake City, that this ordinance become effective immediatel, .
