59 of 1905 - Ordinance 59 of 1905 – Repealing levy on Sidewalk Extension No. 77. AN ORDINANCE . An ordinance repealing an ordinance entitled "An ordinanc levying a tax and for the assessment of property on both sides of B Street from First Street to Ninth Street; on the north side of Fifth Street from B Street to E Street; and on the north side of Seventh Street from B Street to C Street, in Sidewalk District No. 24, for the construction of cement sidewalks", passed by the City Council June 7, 1905, and approved by the Mayor June 8, 1905. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That an ordinance entitled "An ordinance levying a j tax and for the assessment of property on both sides of B Street from First Street to Ninth Street; on the north side of Fifth Street) from B Street to E Street; and on the north side of Seventh Street from B Street to C Street, in Sidewalk District No. 24, for the con- struction of cement sidewalks", passed by the City Council June 7, 1905, and approved by the Mayor June 8, 1905, be and the same hereby! is repealed and re-enacted with amendments so as to read as follows: SECTION 1. That the City Council does hereby levy the tax end provide for the assessment of the same upon the property hereinafter described in Lots 1 and 4, Block 16; 2 and 3, Block 17; 2 and 3, Block 40; 1 and 4, Block 41; 1 and 4, Block 44; 2 and 3, Block 46; 2 and 3, Block 68; 1 and 4, Block 69; 1 and 4, Block 72; 1, 2 and 3, Block 73; 1 and 2, Block 74; 1 and 2, Block 75; 2 and 3, Block 96; 1 and 4, Block 97; 1 and 4, Block 100; 1, 2 and 3, Block 101; 2 and 3, Block 124; and 1 and 4, Block 125, all in Plat "D", Salt Lake City Survey, abutting on both sides of B Street from First Street to Ninth Street; on the north side of Fifth Street from B Street to E Street, and on the north side of Seventh Street from B Street to C Street, in Sidewalk District No. 24, said property having a frontage of 6,600 feet along said streets. This tax is levied to defray the expense of constructing -2- is cement sidewalks four (4) feet wide and four (4) inches thick upon said portions of said streets opposite the property here- inafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and es- tablished that the same will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of ' land are hereby assessed at an equal and uniform rate in ac- cordance with the linear foot frontage upon said portions of said streets fronting upon and to a depth of twenty-five (25) feet bank therefrom, and the tax hereby levied and to be as- sessed upon said parcels of land is five thousand and sixteen Lit ($5,016.00) dollars, or seventy-six hundredths (00.76) dol- lars per front or linear foot, which is the estimated total cost and estimated cost per linear foot of said sidewalks, and the Treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the pur- pose herein mentioned: Fronting on B Street: All of Lots 1 and 4, Block 16; all of Lots 2 and 3, Block 17; all of Lots 2 and 3, Block 40; all of Lots 1 and 4, Block 41; all of Lots 1 and 4, Block 44; all of Lots 2 and 3, Block 45; all of Lots 2 and 3, Block 68; all of Lots 1 and 4, Block 69; all of Lots 1 and 4, Block 72; all of Lots 2 and 3, Block 73; all of Lots 2 and 3, Block 96; all of Lots 1 and 4, Block 97; all of Lots 1 and 4, Block 100; all of Lots 2 and3, Block 101; all of Lots 2 and 3, Block 124; all of Lots 1 and 4, Block 125, Plat "D". Fronting on Fifth Street: All of Lots 1 and 2, Block 73; all of Lots 1 and 2, Block 74; all of Lots 1 and 2, Block 75, Plat "D". Fronting on Seventh Street: All of Lots k and 2, Block 101, Plat "D", Salt Lake City 111 11 -3- Survey, as the same are shwon upon the official plats of said City to a de th of tw ty-five (25) feet back from said streets, SECTION 2. Said tax payable in six equal installments which shall become and be delinquent as follows, to-wit: One- sixth of such tax s}ual become delinquent on the let day of September, 1905; off,-etrth thereof on the 2nd day of January, 1906; one-sixth thereof on the 2nd day of January, 1907; one- sixth thereof on the 24d day of January, 19081 one-sixth there- of on the 2nd day;ioif 34buary, 1909; and.oi -Sixth thereof on the 2nd day of January,' 1910. Each and every installment of said tax, except the first shall bear interest at the rate of six per cent per annum from the date of the approval of this ordinance until its delinquen- cy, and each and all of said installments shall bear interest at the rate of eight per cent per annum from date of delinquen- cy until paid. SECTION 3. This ordinance shall take effect upon approval. Sidewalk Extension No. 77.
