AN ORDINANCE AMENDING SECTIONS 1006, 1011, 1015, 1022, 1029 as amended, 1035,,S'nd 1040, and repealing Section 1030; of the Revised Ordinances of Salt Lake City, Utah, relating to Dairy and Milk Inspection. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That Section 1006 of the Revised Ordinances of Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspection, be and the same is hereby amended to read as follows: "SEC. 1006. LABELING AND PLACARDING. (a) All bottles, cans, packages, and other containers enclosing milk or any milk product defined in this chapter shall be plainly labeled or marked with: (1) the name of the contents as given in the defini- tions of this chapter; Gl (2) the grade of the contents; (3) the word 'pasteurized' only if the contents are pasteurized; (1 ) the word 'raw, only if the contents are raw; (5) the phrase 'for pasteurization' if the contents are to be pasteurized; (6) the name mad permit number of the plant at which the contents are pasteurized; and (7) in the case of Vitamin D milk, the designation 'Vitamib D Milk' and the source of Vitamin D and the Vitamin D content. The name of the producer or processor, permit number, and name and grade of the contents shall be in solid block letters not less than 1/8th of an inch in 59 • -2- height and shall be plainly legible and shall contain no marks or words which are misleading or conflicting. In case a hood or cover is used over a plug or other type cap, the wording on the under cap shall not be inconsistent with the wording on the hood or cover. (b) All proposed caps, cap stocks, hoods, parchment papa containers, single service, or otherwise, shall be approved by the Milk Division of the Board of Health before such caps, cap stocks, parchment paper or container is put into use. Sketches or drawings of such caps or containers shall be sub- mitted for inspection and approval before being used. (c) Where milk is distributed by any person, firm, cor- poration, or organization other than the processor or pasteur izer of such milk, all bottles, cans, packages and other con- tainers shall be plainly labeled with the name and permit num h ber of the processor or pasteurized in letters of equal size to those used to indicate the distributor, and shall be locat ed on the bottle, can, package, carton or other container in the semw relative location and position as the name and permi number of the distributor appears on the product sold and dis tributed. In no case shall the name, location, or permit num ber of the distributor be featured more conspicuously than is the name, location and permit number of the processor. All such labeling shall be approved by the Board of Health and shall contain no marks, words, illustrations or descriptive material not approved by the Board of Health. (d) All packages, cans, or containers used to transport raw milk for pasteurization shall bear a label showing the nfre of the producer, the permit number and grade of the contents. Milk cans shall be labeled with the above information plainly inscribed on a metal tag firmly soldered on the shoulder of the milk can. The tag shall be of a size and kind approved b' the Board of Health and all letters shall not be less than 1/8th of an inch in height. (e) Every restaurant, cafe, soda fountain, or other esta.- lishment serving milk or milk products shall display at all -3- times in a place designated by the health officer a notice prepared by the health officer, stating the lowest grade of milk and/or milk products served." SECTION 2. That Section 1011 of the Revised Ordinances of Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspec- tion, be aid the same is hereby amended by amending Items 4 and 5; Item 8 by amending provision (a) thereof; Item 10 by adding in and to said Item a new paragraph; and Item 26; which items and amend- ments shall read as follows: ITEM 4 as amended, which shall read as follows: "ITEM 4. DAIRY BARN FLOORS. The floors and gutters of al dairy barns in which cows are milked shall be construc#ed of concrete or other impervious and easily cleaned material ap- proved by the health officer and shall be graded to drain pro perly, and shall be kept clean and in good repair. No horses pigs, fowl, etc., shall be permitted in parts of the barn used for dairy purposes." ITEM 5, as amended, which shall read as follows: "ITEM 5. DAIRY BARN, WALLS AND CEILINGS. The walls and ceilings of all dairy barns shall be whitewashed once each year or painted once every two (2) years, or oftener, if nece-- sary, or finished in an Ep proved manner, and shall be kept clean and in good repair. In case there is a second story above that part of the barn in which cows are milked, the cei - ing-shall be tight. If the feed room adjoins the milking plat:, it shall be separated therefrom by a dust-tight partition and door. All grain feeds shall be stored in such a manner as to prevent easy access, ingress or egress to rodents. No feed shall be stored in the milking portion of the barn." ITEM 8 as amended by amending provision (a), which shall read as follows: "(a) The milk house or room shall be provided with a tig t floor constructed of concrete or other impervious material, ii good repair, and graded to provide proper drainage. The insi.ie dimensions of this milk house or room shall be not less than -4- 120 square feet in size and so constructed as to provide adequate space for all equipment and facilities." ITEM 10 amended by adding in and to said Item a new paragraph to read as follows: "All toilet rooms shall be equipped with doors, which doors shall be equipped with springs or other devices to make the said toilet room doors self-closing." ITEM 26 as amended, which shall read as follows: "ITEM 26. MISCELLANEOUS. (a) All vehicles used for the transportation of milk or milk products shall be so construct- ed and operated as to protect their contents from the sun and from contamination. All vehicles used for tramsportation of milk or milk products in their final delivery containers shall be constructed with permanent tops and with permanent or roll- down sides and back, provided that openings of the size neces- sary to pass the delivery man may be permitted in the sides or back for loading and unloading purposes. All vehicles shall be kept clean, and no substance capable of contaminating milk or milk products shall be transported with milk or milk products in such manner as to permit contamination. (b) The immediate surroundings of the dairy shall be kept in a neat, clean condition. (c) In all proposed new construction or major alterations, changes, and modifications in the dairy plant or buildings, plans and specifications of the proposed construction, altera- tion, change or modification shall be submitted to the Milk Division of the Salt Lake City Board of Health not less than thirty (30) days prior to such construction, change or modifi- cation in the existing building or buildings. The Milk Divi- sion shall review and either approve or disapprove such plans or specifications within five days from the receipt thereof." SECTION 3. That Section 1015 of the Revised Ordinances of Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspectior, Ile and the same is hereby amended by amending Items 5, 20, 22 and 23 thereof, which shall read as follows: -5- "ITEEM 5. MISCELLANEOUS PROTECTION FROM CONTAMINATION. The various milk-plant operations shall be so located and con- ducted as to prevent any contamination of the milk or of the cleaned equipment. All means necessary for the elimination of flies and rodents shall be used. There shall be separate rooms for: (a) the pasteurization, processing, cooling, and bottli operations; and (b) the washing and bactericidal treatment of containers Cans of raw milk shall not be unloaded directly into the pas- teurizing room. Pasteurized milk or milk products shall not be permitted to come in contact with equipment with which un- pasteurized milk or milk products have been in contact, unless such equipment has first been thoroughly cleaned and subjecte. to bactericidal treatment. Rooms in which milk, milk products cleaned utensils, or containers are handled or stored shall not open directly into any stable or living quarters. The pasteurization plaht shall be used for no other purposes than the processing of Grade A milk and Grade A milk products and the operations indident thereto, except as may be approved by the health officer, which approval must be uniform to all plants." "ITEM 20. CAPPING. Capping of milk and milk products id shall be done by approV41 mechanical equipment. Randcapping is prohibited. The cap or cover shall cover the pouring lip to at least its largest diameter." "ITEM 22. PERSONNEL, CLEANLINESS. All persons coming i contact with milk, milk products, containers, or equipment shall wear clean outer garments, such as caps, hair nets or suitable head covering and shall keep their hands clean at al times while thus engaged." "ITEM 23. MISCELLANEOUS. All vehicles used for transporta tion of milk or milk products shall be so constructed and operated as to protect their contents from the sun and from contamination. All vehicles used for the tranwportation of -6- milk or milk products shall be constructed with permanent top. and with permanent or roll down sides and back, provided that openings of the size necessary to pass the delivery man may be permitted in the sides or back for loading and unloading purposes. All vehicles shall be kept clean, and no substance capable of contaminating milk or milk products shall be trans ported with milk or milk products in such manner as to permit contamination. All vehicles used for the distribution of mil or milk products shall have the name of the distributor promi - ently displayed. Where ungraded or unpermitted milk is hauled in the same vehicle with permitted or graded milk, such unpermitted or un graded milk shall be placed in a separate compartment in such vehicle in such manner as to prevent the raising of the tem- perature of the permitted or graded milk. Such compartments in the vehicle shall be constructed in compliance with the rules and regulations of the Board of Health." SECTION 4. That Section 1022 of the Revised Ordinances 01 Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspection, be add the same is hereby amended to read as follows: "SEC. 1022. SPITTING. No person shall spit in any part of any room, vehicle, or other place used for the sale, stor- age, handling or transportation of milk or milk products, and the use of tobacco in any form in any such room, vehicle or place shall be unlawful." SECTION 5. That Section 1029 of the Revised Ordinances o Salt Lake City, Utah, 1944, as amended by ordinances passed by the Board of Commissioners on March 16, 1944, and May 25, 1949, relat- ing to Dairy and Milk Inspection, be and the same is hereby furthe amended by adding in and to said Section two new paragraphs to be known as (f) and (g), which shall read as follows: "(f) Any fees thirty (30) or more days' delinquent shall be subject to a ten percent penalty and for such legal fees a • court costs as are incurred in the collection of such fees and penalties." - "(g) The auditor of Salt Lake City shall have the right at any and all reasonable times to audit the books of any plant, separator, bottler, processor, distributor or producer referred to in this chapter." SECTION 6. That Section 1035 of the Revised Ordinances o Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspection, be and the same is hereby amended by amending paragraph (h) there- of, which shall read as follows: "(h) ICE CREAM MIX. Ice cream mix is the unfrozen mixtur. from which ice cream or any other frozen milk or cream produc is made. No ice cream mix shall contain any boracic or salicylic acid, formaldehyde or other chemical or preservative of any pathogenic bacteria add shall be graded into two grades to be known as A and B. GRADE "A". No more than 50,000 living bacteria per cubic centimeter after pasteurization shall be permitted in any ice cream mix, ice cream, other frozen milk or cream products or sherbet to be labeled as Grade A. GRADE "B". No more than 100,000 living bacteria per cub centimeter after pasteurization shall be permitted in any ice cream mix, ice cream, other frozen milk or cream product, or sherbet to be labeled as Grade B. The bacteria count for the above-graded ice cream mix shall be based upon the average for four (4) consecutive spe.i- mens or samples according to American Public Health Associa- tion Standard, and must be pasteurized by the method prescri.- ed in Section 1003 of this Chapter. It must at all times be transported and handled under such temperature and condition• as to check bacterial growth and prevent contamination." SECTION 7. That Section 1040 of the Revised Ordinances .f Salt Lake City, Utah, 19L44, relating to Dairy and Milk Inspection II be and the same is hereby amended to read as follows; "SEC. ;040. MISBRANDING. (a) No person shall sell, offe. for sale or advertise for sale any ice cream, ice cream mix, i 1 -8- frozen confection, as herein defined, or other frozen milk or cream product without first plainly labeling and marking the package or other container of such product with: 1. The name of the contents as given in the defini- tions in this chapter. 2. The name and permit number of the processor. (b) The above required information shall be in such loca- tion, size and colors as shall be first approved by the Board of Health and shall contain no words or marks not first ap- proved by the Board of Health, whiel requirement shall be uniform on all persons concerned."" SECTION 8. That Section 1030 of the Revised Ordinances of Salt Lake City, Utah, 1944, relating to Dairy and Milk Inspec- tion, be and the same is hereby repealed SECTION 9. In the opinion`of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 10.
